Bayview Terrace Apartment Resident Rules and Regulations THESE RULES AND REGULATION HAVE BEEN SET IN A SINCERE EFFORT TO PROMOTE YOUR SAFETY AND SECURITY. YOUR COOPERATION WIIL BE APPRECIATED. Residency Requirements: Residents must meet age eligibility requirements and/or be over age 18 and have a qualifying disability. All property rentals are handled through our corporate office on 2705 Mill Bay Road. 2. Rent payments: All rents are due on the first day of each month and are payable at the Bayview Terrace office. A late charge of $5.00 will be added to the rent of the 6th day, plus a $1.00 per day charge for each day after the 6th day. Any rent not paid by the 10th of the month will be considered delinquent and a NOTICE TO PAY RENT OR VACATE will be issued. 3. Responsibility for damage: Residents must keep their dwellings clean, dispose of rubbish, garbage, properly use all appliances, prevent insect infestation, (resident is responsible for the cost of insect control when infestation is caused by resident's negligence). Resident is responsible for any damage if done deliberately or as a result of negligence. 4. Smoking: Smoking is permitted only in designated units and in designated areas in the building. Smoking is prohibited on the first and second floors, in common areas, elevators, and hallways. 5. Garbage: All garbage, papers, refuse, (boxes must be broken down and flat), must be deposited in the dumpster located at the east end of the building. All wet garbage must be wrapped. The dumpster lid must be closed after you deposit garbage. The dumpster does have a locking mechanism on it, please use it correctly and do not bend the bar by yanking on it. Instructions are located near the locking mechanism. 6. Moving: Moving in or out of the premises is not permitted between the hours of 8:OOPMand 8:OOAM. 7. Flammable liquids: No paints, oils, gasoline or other flammable or hazardous materials may be stored in the apartments. 8. Foul language: All residents and guests (adults, teens and children) will refrain from using foul language while on the premises. 9. Excess noise: Excess noise is defined as any noise loud enough to be disruptive to others. All residents and guests will refrain from making excess noise in the halls, community room, laundry room, and all common areas including the back terrace and parking lots. Quiet hours are in effect from 8PM-8AM. 10. Guests: Visits encompassing overnight stays shall not exceed 3 days in a month or 30 days per year without prior written approval of the management. Residents are responsible for the actions of their guests and agree to reimburse the owner for any vandalism or damages caused by the guest. Children under 12 years of age cannot be in the building or surrounding common areas without the supervision of an adult. All children 12 years or younger will have an adult with them at all times. 11. Roof: Residents and guests are not permitted access to the roof. This access is for the owners and employees only. 12. Drapes: No Venetian blinds, awnings, aluminum foil, draw shades, or non-conforming curtains or drapes shall be installed on windows without the written consent of the management. 13. Laundry room: The laundry room is located on the 3rd and 4th floor, provided for the resident's convenience. All equipment is coin operated and is to be used by the resident with the understanding that the management does not assume responsibility for failure of this equipment to perform properly or for damage to clothes as a result of its use. The management is not responsible for any injury to a resident by reason of uses of this equipment. Cooperation with other residents is requested in the use of the laundry room. Management is not responsible for any clothing or articles stolen, damaged or left. 14. Parking areas: There are designated parking spots for those residents who own vehicles and several designated spots for visitors. Residents are responsible for their visitors to park in those areas marked for visitor parking. NO PARKING IS ALLOWED IN FRONT OF THE BUILDING—THE AREA IS A "NO PARKING ZONE" AND IS POSTED AS SUCH. No automobiles, trailer, boats, motorcycles, campers or other motorized vehicles shall be parked or stored on the premises without written permission of the management. All inoperative motorized vehicles will be removed from the premises at the vehicles owner's expense upon 72 hours posted notice on the vehicle. 15. Waterbeds or water furniture: No waterbeds or water furniture are permitted without special insurance (to be purchased by the resident) and written approval from the management. 16. Bicycles, etc.: All wheeled apparatus (including bicycle, tricycle, baby carriage, motorcycles) may not be ridden across or parked on the sidewalks, grass or planted areas. These items may not be stored in any public areas except as specified by the management. 17. Maintenance and tenant concerns: All concerns, requests, and maintenance issues shall be made in writing directly to the management. Maintenance repair tickets are posted on the office door. In the case of an emergency maintenance issue the maintenance manager can be called at 654.6255. Unresolved issues should be taken directly to the Property Manager's representative who can be reached at 486.3215. 18. Damage: Management is not responsible for fire, theft, or damage to personal effects anywhere on the premises. For your security you should keep your apartment door locked at all times. WE recommend that all residents have RENTERS INSURANCE to insure their personal belongings. 19. Pets: As stated in your Rental/Lease Agreement, pets are not allowed on the premises without approval and written permission of the management. We do require a $500.00 Pet Deposit on approved pets, plus the completion of all necessary paperwork. 20. Emergency: In case of a urgent medical or facility issue the twenty-four hour staff an be reached by going to the nursing station on the first floor or by pulling the emergency pull cord located in each apartment. No form of harassment will be tolerated, including harassment for the following reasons: race, national origin, religion, disability, pregnancy, age, military status, or sex. Special attention should be paid to the prohibition of sexual harassment. The Adminishator, Emergency Administrator or shift supervisor have a responsibility to keep the workplace free of any form of harassment, and in particular, sexual harassment. STAFFING POLICY Bayview Terrace Assisted Living employs one full-time Administrator, CNAs, caregivers, and nursing staff, year-round. Second shift begins at 3:00 p.m. and ends at 11:00 p.m.. Third shift begins at 11:00 p.m. and ends at 7:00 a.m. the next day. The workday is a 24 hour period beginning at 7:00 a.m. The work week is Sunday through Saturday. After one year of full time employment, the employee will get one week (40 hours) of paid vacation. There are 8 paid holidays, they are New Years Day, President's Day, Memorial Day, July 4th , Labor Day, Veteran's Day, Thanksgiving Day, and Christmas Day. You get holiday pay only if you work on the holiday. Only one employee will be allowed to leave the island at a time. One employee will be allowed to take vacation per month. Vacation is limited to 30 days per calendar year, any employee who is gone longer than 30 days will be considered to have quit their job and will be replaced. Vacation requests are approved by the administrator only and will depend on work load. There will also be a 2 -week window between two employees approved vacation. TARDINESS. It is the policy of Bayview Terrace Assisted Living that unless it is an emergency employee tardiness will not be tolerated. Bayview Terrace Assisted Living requires that an employee who is running late for his/her shift, call Bayview Terrace Assisted Living immediately so that the Home can have time to make other arrangements to meet the resident's needs. REPEATED TARDINESS MAY BE GROUNDS FOR DISMISSAL. ABSENCES. It is the policy of Bayview Terrace Assisted Living that unless there is an emergency, illness, or significant personal business to which the employee needs to attend, that employees make a commitment to be present and ready to tend to their duties on a regular schedule as contracted. The well-being of the Home's residents depends greatly on the constancy and dependability of the employee's presence. If an employee is not coming to work he/she must notify the Bayview Terrace Assisted Living as soon as reasonably possible so that the Home can have time to make other arrangements to meet the residents' needs. REPEATED ABSENCES OF A NON-EMERGENCY, NON-HEALTH RELATED NATURE, WILL BE GROUNDS FOR DISMISSAL PRIVACY. RESS CODE. It is the policy of Bayview Terrace Assisted Living that while maintaining the home environment for the residents, it will conduct its day-to-day operations in a professional manner. This is to include manners as well as appearance of its employees. Bayview Terrace Assisted Living requires that its employees dress in clean, comfortable, attractive clothes, wear their hair neatly combed, and wear sensible shoes that can serve towards the type of work they are undertaking at the Home. Bayview Terrace Assisted Living prohibits the use of tank tops, cut-offs, open-toe sandals, see-through garments or bare midriffs, as well as strong scents of perfumes or other cosmetics. EMPLOYEE VISITORS. It is the policy of Bayview Terrace Assisted Living to maintain standards of professional conduct in the Home during its 24-hours of operation. Impromptu or planned visits to employees from their family members, friends, significant others, business associates, and others, are strongly discouraged while the employee is on duty, except under the following circumstances: (a) Emergency; (b) If coming to assist at Bayview Terrace Assisted Living in specific tasks as a volunteer, or temporarily engaged worker; (c) If specifically invited by Bayview Terrace Assisted Living administrator or supervisor on duty for special occasion such as holiday, memorial service, cook-out or other celebration; and (d) All employee guests must abide by Bayview Terrace Assisted Living Code of Ethics and Non-Negotiable Conduct Expected of all Employees, observe good conduct and place the well- being and interests of the residents and the home first. When off duty, employees may NOT use Bayview Terrace Assisted Living equipment, furniture, supplies or other property. Employees may use equipment while on duty and ONLY for activities that are directly related to the Home. The following is a non- exhaustive listing of unlawful, dangerous or reckless conduct which Bayview Terrace Assisted Living will consider as grounds for the immediate dismissal of an employee: (a) Any action or inaction, which will place Bayview Terrace Assisted Living at risk or jeopardize the best interests, safety and/or well-being of the home. its residents and staffi (b) Any breach of security, confidentiality or disclosure of proprietary information such as, but not limited to, removing from the Home any Bayview Terrace Assisted Living office or residents' records, documents, books, computer disks, files or copies of such items, without a written consent from employer and/or resident/resident representative; (c) Stealing, hiding or borrowing other people's property (d) Lack of performance; • Not phoned, un-excused absenteeism; • Repeated absenteeism; Repeated tardiness; (f) Dishonesty, such as, but not limited to, calling in sick to obtain time off under false premises; (g) Intentional and willful starting and/or spreading false, derogatory, demeaning or libelous rumors about matters concerning Bayview Terrace Assisted Living , its residents, staff, contractors, visitors, neighbors or suppliers; (h) Insubordination such as, but not limited to, refusal to abide by "Standards of Care", "Code of Ethics" or "Performance Policies", or to follow up on an order from the Administrator or supervisor on duty; Bayview Terrace Assisted Living 11 Employee Handbook of Policies and Procedures 2/21/03 (i) Fighting with and/or making threats to another employee, a resident, guest, contractor, vendor, official or neighbor of Bayview Terrace Assisted Living; (j) Intentional and willful damaging of Bayview Terrace Assisted Living or residents' property; (k) Possession, use or being under the influence of alcohol, non - prescription illegal drugs or any controlled substances while on duty at Bayview Terrace Assisted Living; (1) Intentional and /or willful physical, verbal, mental or other abuse of a resident, fellow staff member, visitor, contractor or neighbor; (m) Intentional and/or willful physical or other abuse of an animal; (n) Any other action or inaction which the home believes is not in its best interests or that of the residents. NOTE: These policies apply equally to all hired employees of Bayview Terrace Assisted Living, regardless of seniority or position. NON- EXgIAUSTIVE LIST OF EMP O'= EE RIGHTS Under AS 23.10.43 0 et.seq. 1. TIMELY WAGES. The employee will receive fair and legal wages for his/her straight time and over -time work on a timely basis. (No employee may arbitrarily remain on the job past quitting time, unless the Administrator or Services Coordinator has been notified and the Administrator or Services Coordinator has given specific authorization for it. In case of an emergency, the employee will do everything possible to contact the Administrator or the Services Coordinator, first.) 2. ENVIRONMENT. The employee will be provided a safe, efficient environment conducive to helping him/her conduct his/her tasks on a timely, productive manner. 3. SETTING. The employee will be provided a work setting free of any harassment of a sexual, racial, political, personal or religious nature. 4. TIME OFF. The employee will have a right to express his/her business-related or resident-care concerns and opinions to the employer, in an appropriate manner, without retaliation from the employer. 6. The start date of employment will be on and the conditions of employment will be as follows: 1. There will be an initial probationary period of three (3) months. During this period of time Bayview Terrace Assisted Living will take a close look at work habits and attitude in order to determine whether the employment relationship should be continued. At the end of the three months the Administrator or services coordinator of Bayview Terrace Assisted Living will conduct a review session with the employee to communicate to the employee whether he /she is or isn't going to be retained on a permanent basis. 3. Bayview Terrace Assisted Living operates 365 days a year, and as such, adheres to normal operating hours during holidays. The employee is expected to work his /her normal schedule on holidays. The employer will make every attempt to rotate employees throughout the holidays so that no one employee is bound to work the entire length of any given holiday. 4. The salary is per hour. 5. Pay periods are as follows: a) The 1st through the 15th of each month. The following is a non - exhaustive list of conduct which will not be tolerated and which may be grounds for dismissal: Bayview Terrace Assisted Living 16 Employee Handbook of Policies and Procedures 2/21/03 (a) Any action or inaction, which will place Bayview Terrace Assisted Living at risk or jeopardize the best interests, safety and /or well -being of the home, its residents and staff; (b) Breaches of security, confidentiality or disclosure of proprietary information such as, but not limited to, removing from the home any Bayview Terrace Assisted Living office or residents' records, documents, books, computer disks, files or copies of such items, without a written consent from employer and/or resident /resident representative; (c) Stealing, hiding or borrowing other people's property, the latter without specific consent of the owner in advance; (d) Lack of performance; (e) Not phoned, un- excused absenteeism; (f) Dishonesty, such as, but not limited to, calling in sick to obtain time off under false premises; (g) Intentional and willful starting and/or spreading false, derogatory, demeaning or libelous rumors about matters concerning Bayview Terrace Assisted Living its residents, staff, contractors, visitors, neighbors or suppliers; (h) Insubordination such as, but not limited to, refusal to abide by "Standards of Care" and "Employee Policies and Procedures ", or to follow up on an order from the administrator or supervisor on duty; (i) Fighting with and/or making threats to another employee, a resident, contractor, supplier, neighbor or visitor of Bayview Terrace Assisted Living); (j) Intentional and willful damaging of Bayview Terrace Assisted Living or residents' property; (k) Possession, use, or being under the influence of alcohol, non - prescription illegal drugs or any controlled substances while on duty at Bayview Terrace Assisted Living; (1) Intentional and/or willful physical, verbal, mental or other abuse of a resident, fellow staff member, visitor, contractor or neighbor; (m) Intentional and /or willful physical or other abuse of a pet; (n) Any other action or inaction, which the home believes, is not in its best interests or that of the residents. 7. Bayview Terrace Assisted Living is a smoke -free facility, and no smoking of cigarettes, cigars or any other materials is allowed outside of the designated areas. It is imperative that for the safety and well-being of the residents, the employees and the home, ALL employees follow these standards at all times. SAFE ENVIRONMENT PER ISAAC 30.750 - 18AAC 30.890 1. Hand washing a. Before food preparation/serving b. After coming into contact with body fluids c. After toileting self and residents d. After handling soiled clothing, linens, laundry 2. Disinfection a. Toilets and hand-wash sinks must be cleaned and sanitized daily with heavy duty bacteria-killing agents. Floors and walls must be kept clean at all times. b. No personal equipment shall be shared by the residents. c. Any equipment and fixtures shared by residents will be cleaned and disinfected by staff. d. Furnishings shared by residents will be cleaned and disinfected by staff Bedding and personal linens a. Clean bedding and personal linen must be provided at least once a week, or more as often as needed. A supply of clean linen, sufficient to provide changes when needed, must be available. Resident's personal laundry will be done weekly or as needed by staff, unless resident is able and wants to do this him/herself. b. Staff will wear protective gloves when handling laundry soiled with blood or feces. c. Laundry soiled in blood or feces will be washed in hot water, laundry detergent and Clorox. 5. Using gloves a. When there is direct contact with blood or feces, or items soiled with either. b. Employee has cuts, chapped hands, dermatitis, etc. c. Employee is to come in contact with non - intact skin of residents. d. When performing ADL services. e. When cleaning toilets, bedpans, and portable toilets. f. When disinfecting equipment and fixtures. 7. Heating a. Portable electric heaters MUST be equipped with tip -over switches and must be kept out of the reach of children or of adults with impaired judgment. 12. Sanitary installations a. Hot -water temperature controls must be provided and maintained so that hot water delivered to the plumbing fixtures is not less than 100 degrees Fahrenheit and not more than 120 degrees Fahrenheit. 12. Water supply a. The Home has an ample supply of potable water available. b. Water pressure of not less than 15 pounds per square inch or more than 80 pounds per square inch must be provided and maintained at all fixtures. Medicine requiring refrigeration must be stored in a manner that will not contaminate food. Any medicine kept in a refrigerator must be labeled with the name of the user, the name of the medicine and the dosage. Medicines must be grouped together. 2. Safety a. Poisonous or dangerous substances and compounds must be identified and kept in storage areas that are inaccessible to adults with impaired judgment. NUTRITION 1) Meals a) Special and modified diets must have physician's written orders and must be taken into consideration and provided at the appropriate meal times. MANAGING ILLNESS 1.Caring for illness or change in resident's condition. a. When a resident has an illness or injury, it must me IMMEDIATELY reported to the Administrator or services coordinator. The Administrator or services coordinator will determine the next step of care. b. If Administrator is away from the Home the employee will follow Emergency Procedures on page 29. The employee will contact the Administrator as soon as possible. c. When a resident's illness of injury worsens or is serious, the Administrator will notify the family and/or physician. d. Arrangements are made in advance between the resident's doctor, the resident and their guardian and the KFD Non - Emergency Dispatch offices, so that at the time of death, a paramedic and maybe a police officer respond to the Home without sirens and lights, as a non - emergency situation. The paramedic will determine that the resident in fact has died. With Comfort One it is not necessary for a police officer to respond nor conduct a brief investigation. Give the resident's full name and say that he /she is dead at this time and you are requesting a paramedic.. 4. Give the complete address of Bayview Terrace Assisted Living. 5. Give the phone number of Bayview Terrace Assisted Living. If this procedure is followed a paramedic and an ambulance, and maybe a police officer will arrive without lights and sirens at the Home. The paramedic will determine that the resident has died. The police officer will conduct an initial investigation, generally this will consist of a visual inspection of the deceased and of the surrounding area; a determination of the names of those persons present in the Home at the time of death; discussion with the person in charge at the home as to times and events leading up to the death, and a consultation with the paramedic. The Administrator will then contact the funeral home of the family's choice to request they send personnel to remove the body. IMPORTAIVT• 1. If you call 911 there will be a full -coded response with lights and sirens by the paramedics and the police. 2. If the resident still has vital signs when the paramedics arrive at the Home and the Home requests transport without resuscitation, the medics will NOT comply with the request. 3. In all cases, the police officer has the right to institute full investigation. This should not be construed to mean anyone is suspected of wrongdoing. A 65-year old male resident is not breathing" 911 is an emergency response number. It is answered by the Kodiak Police Department Emergency Dispatcher. Depending on the nature of the emergency, they send out either Kodiak Police Department (KPD) or Paramedics (EMS). While the dispatcher is asking you questions, she/he is also talking to KPD or EMS and they have already dispatched either the Fire Department or the Paramedics. The dispatcher NEEDS TO KNOW: o YOUR LOCATION- "Bayview Terrace Assisted Living an Assisted Living Home" o THE PHONE YOU CAN BE REACHED AT DI CASE OF DISCONNECT — Bayview Terrace Assisted Living Phone Number © THE PROBLEM — "He was eating dinner and suddenly stopped breathing" Dispatcher will go through a series of questions from a "diagnosis card", ANSWER THEM QUICKLY AND TO THE POINT. "Is he able to talk to you?" "No" "Did he choke on something?" "I think he did... " "What did he choke on?" "A piece of meat" The dispatcher is relaying this information to the EMS ambulance that is on their way. The dispatcher will give you instructions on what to do while help arrives. Before hanging up the dispatcher will also advice the following: Reassure the patient that help is on the way. O Do not give the patient any food or drink. • Rest them in a position that is comfortable for THEM. (This is very important!) o Have medications handy. • Unlock the front door or the best entryway door to get in, (EMS has a key to get into the building). e Turn on the outside lights. O Call 911 back immediately if patient gets worse. If you have a language barrier, tell the dispatcher WHAT LANGUAGE YOU SPEAK. You: "I speak Chinese!" Dispatcher: "Please remain on the line" You will hear a dial tone while the dispatcher connects you to an interpreter. STAY ON THE LINE until the interpreter comes on the line. (They have interpreters for over 100 languages, and they are on call 24-hours a day. This system really works!) A staff member must be present with residents during exit procedures. 4. When all residents are accounted for, they, along with the staff, are to gather and wait under the awning at the Senior Center. FIRE SAFETY There will be a minimum of two (2) fire drills a year. All fire drills will be logged and recorded by the Administrator. There are * fire extinguishers in the home; upstairs or on the mainfloor it is located on the *• Downstairs it is located *. a. PREVENT SMOKE, FIRE OR THP., ENVIRONMENT WHICH BREEDS THEM - This is a moral, personal and professional responsibility of ALL staff and management of Bayview Terrace Assisted Living Fire doubles in size at the rate of every 30 seconds. A family house will be completely consumed in about 3 minutes 1. Never leave cooking unattended. Watch out for towels, paper towels, napkins, tablecloths, basket cloths, and straw baskets coming in contact with stove burners or oven. 2. Never place items next to heaters, water heaters, or radiators 3. Never let garbage accumulate. 4. Never let grease accumulate in ovens, stoves or toasters. 5. Test smoke detectors every month following the manufacturers' instructions. 6. Immediately unplug any appliance that smells like smoke or starts to smoke. 7. Never leave iron, oven, fan, space heaters, candles, and Christmas lights unattended. 8. Flush used matches down the toilet. 9. Wash cleaning rags used for silver, brass and copper polishing immediately. 10. Never store bags of lawn or flower clippings next to the house. b. IN THE EVENT OF SMOKE OR FIRE, RESP ND QUICKLY - Call the fire department at 911. Follow fire response plan set in place by Home. FIRE RESPONSE PLAN - First priority is the protection of LIFE. • ALERT - Upon smelling or seeing smoke or flame, immediately call 911 and rouse residents. 2. EVACUATE - Immediately evacuate all individuals. Before opening a door test it. If it is hot DO NOT OPEN IT, but use alternative escape route such as window. If door is cold, brace your shoulder against it and open it cautiously. Be ready to slam it shut if smoke or heat rush in. In smoke, crawl down low on the floor to avoid deadly smoke. Get out fast. Everyone will meet at the senior center. Don't go back inside once you are out. Make sure everyone else stays out, too. 3. CONFINE - Confine the fire or smoke by closing all doors behind you as you are evacuating the Home. d. TO FIGHT OR NOT TO FIGHT A FIRE - FIGHT ONLY IF FIRE IS NO LARGER THAN THE SIZE OF A KITCHEN GARBAGE CAN. 1. Use fire extinguishers. If grease fire in the kitchen, SMOTHER with towels. e. KEEP FIRE EXITS CLEAR ALWAYS - All designated EXITS, including window exists, must constantly be clear of furniture, equipment, shopping bags, plants, ornaments, brick- a-brack or laundry piles. f. KEEP HALLWAYS CLEAR ALWAYS - These are the main ways of egress into the exits. Furniture, laundry, plants, boxes left even for a few minutes may block the way in an emergency. Emergencies happen when least expected. g. FIRE DRILLS - These will be conducted with the active participation of staff, residents and neighbors, and with the cooperation and involvement of the local fire jurisdiction. Drills will not be conducted between 9 p.m. and 7 a.m.. Drills will be documented and logged by the Administrator. Drills will serve to test the staff and residents' ability to respond during a fire, test smoke alarms and fire fighting equipment. h. CONDUCTING A FIRE DRILL - The Administrator will utilize a Fire Drill Evaluation form in documenting the occurrence of the drill and any corrective action required. The purpose of the drill is to test and maintain the staff and residents' level of ability and readiness to respond during a fire. Before conducting the drill the Administrator will: Bayview Terrace Assisted Living 31 Employee Handbook of Policies and Procedures 2/21/03 Obtain a blank copy of a Fire Drill Evaluation form Document the fire drill scenario on this form Contact the local fire department and notify them of the intent of the Home to conduct a drill and the specific time Residents will be notified and appropriate explanations made The Administrator may use any of the following scenarios for the drill: activate smoke detector; ask a staff member impromptu what they would do in case of a grease or other kind of fire; use a safety cone or a cloth to designate an area where a fire has originated and figure out responses and exits in accordance with the simulated marked location of the fire. Fire drills should last no longer than five (5) minutes. Upon termination of the drill notify the fire department and respond to any questions, concerns, observations made by staff and residents. Complete the Fire Drill Evaluation form. USING A FIRE EXTINGUISHER Pull the pin out. 2. Aim extinguisher nozzle at base of fire. 3. Stand back 6 - 10 feet. Spray Sweep the extinguisher stream at base of fire. 4. DISASTER POLICIES AND PROCE L URES 1. BEING PREPARED - It is the duty and responsibility of all Bayview Terrace Assisted Living management, staff and personnel to prepare for and respond to any and all emergencies. The goal is to protect people, their belongings and the assets of the Home. The Home's "Disaster Preparedness Plan" is on the following page. 2. BEING CAPABLE - It is the policy of Bayview Terrace Assisted Living that all current employees be fully trained and familiarized in the elements of the Disaster Preparedness Plan. That all employees, regardless of position or time of hire, be capable of assisting in the response to an emergency disaster. It is expected that any disruption will be minimized and a return to normalcy will be the highest priority. 3. DISASTER DRILLS - Will be conducted at least twice annually to determine the level of Bayview Terrace Assisted Living 32 Employee Handbook of Policies and Procedures 2/21/03 readiness of the Home to respond in times of internal and /or external disasters. The drills will be designed in the least disruptive manner possible, and will be conducted in consultation with the local fire marshal. Frequent but short visits, rather than rare and lengthy ones, appear to better serve the residents in terms of comfort, enjoyment and continuity of their life events. Children and pets are welcome, but we ask that the well-being of other residents be seriously taken into consideration. Family members who wish to spend the night with a resident can do so, but must first request permission from the Home Administrator or services coordinator, and they must bring their own sleeping bag or day bed. Lengthy stays are not allowed. RESIODENCY LIVING QUARTERS - We have 20 private apartments in our home. Once a resident agrees to move in we consider that this is to be his/her home. As such we encourage each resident to make himself/herself at home by decorating their apartment with personal brick-a-brack, photographs, pictures, plants, favorite old chairs, lamps, comforters, afghans, etc. PETS - Small dogs, cats, turtles, birds, fish are welcome. Snakes or other reptiles are not allowed by law, since they carry Salmonella, and can be extremely hazardous to elderly and infants. All pets must be maintained in good health and well-groomed by the resident, or by a contracted groomer or animal technician, at resident/owner's expense. Resident will need to sign a Pet Policies and Agreement prior to residency. Employees are under no circumstances required to care for the needs or maintenance of a resident's pet. Employees are required to report any violations of the Pet Policies and Agreements which they observe and which in any way endangers or hampers the well-being of the resident, other residents or staff. TV, RADIO, STEREOS OR CB'S - Volume must never be so loud as to disturb the serenity of the home. All equipment must have volume turned down low between 8 p.m. and 8 am, unless resident uses earphones. Some residents use music to relax them into sleep at night, and into waking them up in the morning. Bayview Terrace Assisted Living 37 Employee Handbook of Policies and Procedures 2/21/03 PET POLICIES AND AGREEMENT Bayview Terrace Assisted Living in compliance with 18AAC.30.805, accepts only small dogs, cats, birds, turtles and goldfish in the resident's apartment, and strictly adheres to the State's standards of sanitation and safety. Pets must be of a disposition that do not in any way endanger or hamper the well -being of the resident, other residents, the staff and other pets. Anxious, vicious, noisy, destructive and/or untrained animals will not be accepted. Resident must provide proof of animal's clean bill of health, through a veterinary health certificate, no older than 30 days from the time of admission. Resident must have in place an arrangement in writing as to what will happen to the pet should the resident not be able to keep it any longer due to resident's illness, death or termination of the pet agreement. Maintain pet in good health, and periodically groomed, exercised or trained by resident or by hired pet care giver, at the pet owner's expense. 2. Residents may consume a reasonable and moderate amount of alcoholic beverages, provided it in no way conflicts with doctors' orders, instructions or medications. 7. Intentional and/or willful physical, verbal or other abuse of other residents, staff, visitors and pets will not be tolerated and may be grounds for termination of a residential services contract. Actions which are due to the resident's medical/mental condition will not be considered intentional/willful, but will be discouraged in as much as possible, and will be looked into for possible repetitive patterns which may lead to termination of the residential services contract. 8. Residents may not engage in any lewd and lascivious conduct which may lead to the embarrassment or discomfort of other residents or staff, or to the disruption of the serenity of the family environment of the Home. Displays of such conduct will be grounds for termination of the residential services contract. 9. SI EN 9 Under Alaska Statute 47.33.300 A resident of an assisted living home has the right to (1) live in a safe and sanitary environment; (2) be treated with consideration and respect for personal dignity, individuality, and the need for privacy, including privacy in (A) a medical examination or health-related consultation; (B) the resident's room or portion of a room; (C) bathing and toileting, except for any assistance in those activities that is specified in the resident's assisted living plan; and (D) the maintenance of personal possessions and the right to keep at least one cabinet or drawer locked; (3) possess and use personal clothing and other personal property unless the home can demonstrate that the possession or use of certain personal property would be unsafe or an infringement of rights of other residents; (4) engage in private communications, including (A) receiving and sending unopened correspondence; (B) having access to a telephone, or having a private telephone at the resident's own expense; and (C) visiting with persons ofthe resident's choice, subject to visiting hours established by the home; (5) close the door of the resident's room at any time, including during visits in the room with guests or other residents, provided this in no way endangers or compromises the safety and well- being of the resident or the home; (6) at the resident's own expense unless otherwise provided in the residential services contract, participate in and benefit from community services and activities to achieve the highest possible Bayview Terrace Assisted Living 41 Employee Handbook of Policies and Procedures 2/21/03 level of independence, autonomy, and interaction in the community; (7) manage the resident's own money; (8) participate in the development of the resident's assisted living plan; (9) share a room with a spouse if both are residents of the home; (10) have a reasonable opportunity to exercise and to go outdoors at regular and frequent intervals, when weather permits; (11) exercise civil and religious liberties; (12) have access to adequate and appropriate health care and health care providers of the resident's own choosing, consistent with established and recognized standards within the community; (13) self-administer the resident's own medications, unless specifically provided otherwise in the resident's assisted living plan; (14) receive meals that are consistent with religious or health-related restrictions; (15) receive the prior notice of relocation of the home or the home's intent to terminate the residential services contract of the resident required by AS 47.33.080 and 47.33360, respectively; (16) present to the home grievances and recommendations for change in the policies, procedures, or services of the home; (17) at the resident's own expense unless otherwise provided in the residential services contract, have access to and participate in the advocacy or special interest groups; (18) at the resident's own expense unless otherwise provided in the residential services contract, intervene or participate in, or refrain from participating in, adjudicatory proceedings held under this chapter, unless provided by this section or by other law. (19) reasonable access to home files relating to the resident, subject to the constitutional right to privacy of other residents of the home. (b) An assisted living home may not establish or apply a policy, procedure, or rule that is inconsistent with or contrary to a right provided by this section or by other law. Bayview Terrace Assisted Living 42 Employee Handbook of Policies and Procedures 2/21/03 OHIBITEJ ACTIONS ilk Y THE SSISTED LIVING HOME Under Alaska Statute 47.33.330 (a) An assisted living home, including staff of the home, may not (1) deprive a resident of the home of the rights, benefits, or privileges guaranteed to the resident by the law; (2) enter a resident's room without first obtaining permission, except (A) during regular, previously announced, fire, sanitation, or other licensing inspections; (B) when a condition or situation presents an imminent danger; (C) as required by the resident's assisted living plan to provide services specified in the residential services contract; or (D) for other vital health and safety reasons; (3) impose religious beliefs or practices upon a resident or require a resident to attend religious services: (4) place a resident under physical restraint unless the resident's own actions present an imminent danger to the resident or others; (5) place a resident under chemical restraint; this paragraph does not prevent a resident from voluntarily taking tranquilizers, or other medication, prescribed by a licensed physician; (6) compel a resident to perform services for the home, except as contracted for by the resident and the home or as provided for in the resident's assisted living plan; or (7) restrain, interfere with, coerce, discriminate against, or retaliate against a resident for asserting a right specified bu this chapter or by other law. (b) An assisted living home may not physically restrain a resident unless the home has a written physical restraint procedure that has been approved by the licensing agency. The home shall terminate the physical restraint as soon as the resident no longer present an imminent danger. (c) An owner, administrator, employee, or agent of an assisted living home may not act as a representative of a resident. Protection from Retaliation. Under AS 47.33.350, an Assisted Living Home may not take retaliatory action against a resident of the home if the resident, or the resident's representative a, exercises a right provided by AS 47.33, 7 AAC 75, or by law; b. appears as a witness, or refuses to appear as a witness, in an adjudicatory proceeding regarding the home; c. files a civil action alleging a violation of assisted living licensing statutes; or d. claims a violation of assisted living licensing statutes before a state or federal agency having jurisdiction over the home or its employees. 2. Resident's Grievance Policy and Procedure. Under AS 47.33.340, an Assisted Living Horne must establish a written grievance procedure for handling complaints of residents. The procedure must provide for the following rights of residents: a. the right to present both a written and oral explanation of the resident's grievance; b. the right to have an advocate or representative of the resident's choice attend meetings concerning the resident's grievance; and c. the right to be notified in writing, within 30 days after the filing of the grievance, of the final decision of the home regarding the grievance. Bayview Terrace Assisted Living will hear and attempt to resolve all grievances in a fair and timely manner. PROCE URES: 1. The aggrieved person, or person acting on his/her behalf, will meet with the person against whom the complaint is directed, or with the person who is most involved in the conditions resulting in the complaint. This meeting will be informal and designed to provide a solution that will not require further discussion. Cases of verbal or physical abuse shall be reported to directly to the Administrator, *. 2. If a solution cannot be reached, the aggrieved (or representative) may ask the Administrator for an appointment. The meeting must be held within five (5) days of receipt of the grievance. The Administrator shall remain the last and final avenue for the hearing of resident grievances. 4. The application shall be made on a form provided by the community development department and accompanied by the required fee and site plan. All applications shall be available for public inspection. (Ord. 83-40-0 33(part). 1983). 17.66.030 Investigation. An investigation of the variance request shall be made and a written report provided to the commission by the community development department. The findings required to be made by the commission shall be specifically addressed in the report. (Ord. 83-40-0 33(part). 1983). 17.66.040 Public hearing and notice. The conunission shall hold a public hearing on each properly submitted application for a variance within thirty (30) days after the filing of the application. The applicant shall be notified of the date of such hearing. The community development department shall send to each Owner of property within a minimum distance of three hundred (300) feet of the exterior boundary of the lot or parcel of land described in the application, notice of the time and place of the public hearing, a description of the property involved, its street address, and the action requested by the applicant. For the purposes of this chapter, "property owner" means that land owner shown on the latesttax assessment roll. Notice shall also be provided in accordance with state law by legal publication in local newspapers. (Ord. 83-40-0 33(part). 1983). 17.66.050--17.66.080 17.66.050 Approval or denial: Within forty (40) days after the filing of an application, the commission shall render its decision, unless such time limit has been extended by common consent and agreement of the applicant and the commission. • A. Approval. If it is the finding of the commission, after consideration of the investigator's report and receipt of testimony at the public hearing, that the use proposed in the application, or under appropriate conditions or restrictions, meets all of the following, the variance shall be granted: 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to other properties in the same land use district;. 2. That the strict application of the provisions of this title would result in practical difficulties or unnecessary hardship; - 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety or general welfare; 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan; 5. That actions of the applicant did not cause special conditions or financial hardship or inconvenience from which relief is being sought by a variance; and 6. That granting the variance will not permit a prohibited land Use in the district involved. B: Denial. If the commission finds, after consideration of the investigator's report and receipt of testimony at the public hearing, that it cannot make all of the required findings in subsection A of this section it shall deny the variance. The commission, in granting the variance, may establish conditions under which a lot or parcel of land may be used or a building constructed or altered; make requirements as to architecture, height of building or structure, open spaces or parking areas; require conditions of operations of an enterprise; or make any other conditions, requirements or safeguards that it may consider necessary to prevent damage or prejudice to adjacent properties or detrimental to the borough. When necessary, the commission may require guarantees in such form as deemed proper under the circumstances to ensure that the conditions designated will be complied with. (Ord. 83-40- o 33(part). 1983). 17.66.070 Effective date. The decision of the commission to approve or deny a variance shall become final and effective ten (10) days following such decision. Singleton, Jr., Judge of the Superior Court, affirmed the decision of the Board of Adjustment relating to variances for lot size and sideyard invasion for the Kodiak Elderly Housing Project. The decision of the Board of Adjustment with regard to the variance' for parking places was reversed. I am certain that your counsel, Richard Garnett, III, has advised you of this decision and perhaps provided you with a copy. In that decision the court stated that: In order to insure fairness, uniformity and reasonable control on discretion, consistent with the zoning ordinance, Ordinance No.-§17.57.010(a)(b) should be amended to specifically provide for senior citizen housing if it is determined that a lessor number of parking spaces, per dwelling unit is de8irable. Since the decision relates to only one portion of three consolidated cases, it is not a final judgment that is appealable at the present time. It is, therefore, possible Kodiak Island Borough Planning & Zoning Commission December 1, 1980 Page Two that an appeal would be taken from the decision by Lorraine Dayton after conclusion of the consolidated cases. Nevertheless, it appears that some action can be taken by you and Sunset Development to resolve this portion of the case. As Sunset Development Company has indicated' in the past, they would be willing to complete either the landscaping provided for in the approval of the parking variance, or they will provide the parking spaces required by the existing ordinance. Obviously, we could not proceed with landscaping unless a new ordinance was adopted, as indicated by Judge Singleton's decision, modifying the parking space requirements for elderly housing projects. If you would anticipate recommending such a change to the Assembly, I would appreciate being so advised. Conversely, if you would want our clients to provide the parking spaces as required by the existing ordinance, we will anticipate doing that work during the 1981 construction season. Kindest regards.
