We have located eleven (11) case files in the department that appear to be relevant to the request. Staff estimates that the eleven (11) case files total about 300 pages of information, plus or minus 50 pages. Some of the files contain information that has not been two -hole punched and bound into the folders. In addition, there are about eight (8) oversized maps that would need to be copied separately. The oversized maps appear to be about 24 by 36 inches in area. As an alternative to the cost of copying complete files, which may or may not contain information that the requestor is seeking, the Department can make the files available for review in the department during normal business hours. We normally provide the files for review at the conference table in the department with a pad of sticky- notes. The customer may then tab the relevant file pages for later copying, rather than copying the whole files. I am attaching a copy of the labels of the various case files for review by the requestor. The Department of Environmental Conservation has reviewed your February 20, 1995 request for issuance of an Air Quality Control Permit to Operate. Based on our.review of your request, the Department finds: 1. ' the A -K Construction Tarmac transportable asphalt plant is an new facility consisting of a ADM, 60 tons per hour, Drum Mix Plant with a wet scrubber and one 175 kw Caterpillar diesel - electric generator with annual emissions of any one air contaminant of less than 250 tons; 2. the asphalt plant includes an air contaminant emission control unit to comply with Department's air quality emission standards set out in 18 AAC 50.050 and is an industrial process with a throughput greater than 5 tons per hour, and therefore is a source described in 18 AAC 50.300(a)(1 ) (A); John Zbitnoff -2- A-K Construction Company DRAFT 3. the soil remediation unit is subject to the following State Air Quality Control regulations: A. 18 AAC 50.050(a) (1) opacity for all fuel burning equipment, • B. 18 AAC 50.050(b) (5) particulate matter, C. 18 AAC 50.050(c) sulfur compound emissions, D. 18 AAC 50.050(f) fugitive emissions, 4. the asphalt plant is subject to the New Source Performance Standards (NSPS) as set out in 40 CFR'60, Subpart 1. 5. the asphalt plant has been found to be consistent with the Alaska Coastal Management Program and permit conditions are stipulated pursuant to 6 AAC 50, General Concurrence Determination No. 27. Therefore, as provided by 18 AAC 50.400, Air Quality Control Permit to Operate No. 9525 -AA002 is granted and enclosed. Please note that there are 29 conditions of the permit. Violation of any one of these conditions may result in revocation or suspension of the permit in accordance with 18 AAC 50.310. The permit expires April 30, 2000, and you must request renewal, at least thirty days prior to that date for continued operation of the facility. Violation of any condition of this permit may subject you to civil or criminal penalties as provided in AS 46.03.760, AS 46.03.765, AS 46.03.780, and AS 46.03.790. Permit conditions are stipulated pursuant to 6 AAC 50 and Air Quality Control Regulations 18 AAC 50, and are necessary to ensure that operation of your facility is consistent with the Alaska Coastal Management Program and Alaska Air Quality Control Regulations. This permit does not relieve you from the responsibility to apply for any other permit or approval required by the Department or the U.S. Environmental Protection Agency. Condition 3 prohibits the burning of material regulated as hazardous wastes as defined in 18 AAC 62 and 40 CFR 261. You must obtain permits from the U.S. Environmental Protection Agency if you wish to burn wastes defined as hazardous. Condition 4 requires notification when the unit is starting operations at a new location or starting operations for the season. This would include notifying the Department when you plan the initial start-up of the plant. John Zbitnoff _ -3- A-K Construction Company Condition 7 limits the fuel sulfur content to 0.5 percent, by weight. The fuel sulfur content is further restricted in certain coastal zone areas which have potential sulfur dioxide problems. The facility's correctly proposed location on Kodiak Island will not require the use of fuel with a sulfur content of 0.3 percent or less. Conditions 11 through 18 cover the source testing requirements. A source test must be conducted within 180 days of start-up of the facility. The source test must be performed at the maximum rated capacity of the facility or the maximum anticipated rate. Subsequent operations will be limited to the feed rate used in the source test, until such time that another source test is conducted at a higher rate that demonstrates compliance with the emission limits. Conditions 15 and 17 requires the permittee to submit the schedule and results of the source test to both the Department and to the Kodiak Island Borough. The submittal to the Borough should be sent to Don Alexander, Environmental Engineer, Kodiak Island Borough, 710 Mill Bay Road, Kodiak, Alaska, 99615 -6340. During the inspections under Condition 23, the Department's representatives will abide by all valid and reasonable health and safety related rules or procedures prescribed by the Permittee, while . within the boundaries of the facility. Exhibit A lists the equipment covered by the permit. Exhibit B lists the potential emissions from this equipment. In issuing this permit, the total emissions of each air contaminant from all existing pieces of equipment have been considered. ANY net change in emissions must be considered when determining the applicability of 18 AAC 50.300(a)(6)(C) when any future modification or series of modifications to this facility are proposed which would increase emissions of a regulated air contaminant. In Exhibit B, the appropriate emission rates based on emission factors have been listed. The new operating permit program mandated by the Clean Air Act Amendments of 1990 requires the collection of fees, a portion of which may be based on the actual or allowable emissions= from the facility. The State is currently seeking EPA approval to implement the new 'operating permit program, but the program will be administered by the EPA if that effort fails. In either case, it is expected that the new operating permit program will be in place by late 1995. In; "the interim, the Department has implemented program fees, 18 AAC 50.415 and emission fees, 18 AAC 50.420." The emission fees became effective August 10, 1994. The interim emission-fee regulation applies to all facilities that hold an air permit under the existing air quality control regulations, as set out in 18 AAC 50.300. The emission fee rate is $3.30' per,ton, of emissions. 'Fees will be assessed on emissions of particulate matter, sulfurdioxide, carbon monoxide, ozone, nitrogen oxides, lead; John Zbitnoff -4- A-K Construction Company DRAFT volatile organic compounds, and up to 4,000 tons per year of reduced sulfur compounds or ammonia. Fugitive emissions are also included in this regulation. Within 30 days after issuance of a new permit, a facility may submit an estimate of their actual emissions for this fiscal year (July 1,, 1994 - June 30, 1995). The emissions should be calculated using emission factors from the EPA's publication AP-42, and should be submitted to the Department's Central Office, Juneau, Alaska. Other emission factors may be used with prior approval from the Department's Central' Office. They will review each estimate against the facility's previous year's operating reports. The estimate will be approved if it: 1) includes each regulated air contaminants; 2) is calculated using AP-42; and 3) is not less than the facility's previous year's actual emissions. Certain specific variations are allowed with prior written approval. If a facility does not submit an estimate of its actual emissions within 30 days after permit issuance, the Department will estimate the facility's emissions based on AP-42 emission factors and the facilities previous year's operation reports. However, this is a billable activity, and the Department will charge $65 per hour spent reviewing files and calculating emissions. The current permit lists the total allowable emissions from your facility in Exhibit B. State regulations, 18 AAC 50.300(8), allows the owner or operator to .request physical or operational limitations in order to reduce the facility's allowable emissions. If you wish to reduce the' allowable emissions from your facility, please make such a request in writing, specifying the physical or operational limits to be incorporated into the permit. When making waste management decisions, you are requested to consider pollution prevention techniques in order to prevent and minimize present and future pollution. Please consider waste management options which: 1) minimize pollution entering the air, land, and water; and 2) promote waste management practices in the following order of priority: source reductions, recycling/reuse, treatment, and disposal. Department regulations provide that if you disagree with this decision you may request an adjudicatory hearing in accordance with 18 AAC 15.200-910. The request should be mailed to the Commissioner, Alaska Department of Environmental Conservation, 410 Willoughby Avenue, Suite 105, Juneau, Alaska 99801-1795, by certified mail, return receipt requested. A copy of the request shall also be sent to the undersigned. Failure to submit a request within thirty days of service of this letter shall constitute a waiver of your right to administrative review of the decision. In addition, any other person who disagrees with this decision may request an adjudicatory hearing within thirty days of service of the enclosed permit. Any hearing granted will be limited to issues related to the issuance of this permit. This permit authorizes the operation of this facility only as described in the original permit application and modifications as requested in the documentation listed in Exhibit F including the equipment listed in Exhibit A. Operation of the facility is subject to each condition, of this permit including each requirement set forth in Exhibits C and D of this permit, and the emission limits, standards, fuel specifications, and operating limits set forth in Exhibit B of this permit. Where the permit differs or is more stringent, the permit requirement applies. LOCATION: The facility will be located at 12583 Middle Bay Drive, Kodiak, Alaska, (Longitude 152° 32' W, Latitude 57° 43' N) and at other subsequent locations in accordance with the notification requirements of Condition 5. STANDARD CONDITIONS: A. COMPLIANCE WITH AMBIENT STANDARDS & EMISSIONS STANDARDS, LIMITS, AND SPECIFICATIONS, 1. Permittee shall comply with the State Ambient Air Quality Standards and increments established by State Air Quality Control Regulations 18 AAC 50.020 (a) and (b). Permittee shall perform modeling to demonstrate compliance with ambient air quality standards and increments, if requested to do so by the Department, for areas which are in non-attainment or in areas which are suspected to be at least 80% of the standard or the increment. Permittee shall comply with whichever are the most stringent of following applicable emission standards, limits, and specifications: State Air Quality Control Regulations 18 AAC 50.050(a)(1), (b)(5), (c), and (f), and those set out in Exhibit B of this permit. B. OPERATING AND MAINTENANCE REQUIREMENTS 3. Permittee shall not process any material that meets the definition of Hazardous Waste under 40 CFR 261, 18 AAC 62, 18 AAC 75.140(a) or requires Federal authorization for treatment under the Toxic Substances Control Act. 4. Permittee shall notify, in writing, and obtain approval from the appropriate Area Service Center of the Department 15 days prior to operation, relocation or initiation of a new remediation project by submitting two copies of the Relocation/Operation form, as shown in Exhibit F. Permittee shall also send a copy of the Relocation/Operation form to the Division of Governmental Coordination and any affected coastal district(s). 5. Permittee shall install, maintain, and operate, in a,manner consistent with the manufacturer's recommended procedures, fuel burning equipment, procesaNaquipment, and monitoring and testing equipment to provide optimum control of air contaminant emissions during all operating periods. Permittee is prohibited from operating the facility at a rate higher than source testing shows compliance. 6. Permittee shall inspect every component of the air emission control device prior to the first operation of the,facility each year and prior to operations after each relocation of the facility, and repair or replace any component which shows signs of deterioration. 7. Permittee shall not burn any diesel fuel with a sulfur content greater than 0.50%, by weight. Permittee shall not burn any diesel fuel with a sulfur content greater than 0.30%, by weight, in a Coastal Resource Service Area (CRSA), without prior approval of the Department.- 8. Permittee shall maintain a minimum pressure drop of water across the scrubber at all times for which source testing derrionstrates compliance. Permittee shall operate the asphalt plant at a capacity no greater than the maximum 1-hour average for which the source test demonstrates compliance. Permittee shall not operate the asphalt plant, prior to the first source test, at a capacity greater than 40 tons per hour, one hour average. 10. Permittee shall control all sources of fugitive emissions to prevent release of . material beyond the property line of the facility, including the following: 1. material piles, contaminated and treated ii. material and product conveyors loadout hopper, pugmill (if applicable) iv. emissions control system v. roadways under the control of the permitted' Permittee shall promptly repair any holes in ducts, shrouds, conveyors or malfunctioning equipment which contributes to release of fugitive dust beyond the facility boundaries. C. SOURCE TESTING. REQUIREMENTS 11. Permittee shall conduct source tests, within 180 days of initial startup or within 60 days of achieving maximum production, which ever is sooner, in order to ascertain concentrations and mass emission rates of particulate matter on asphalt plant listed in Exhibit A. Tests shall be conducted according to the methods described in Exhibit C. 12. If there are any changes or modifications to a source which would trigger any increase in emissions, permittee shall perform source tests of the source within 90 days of the change or modification using the applicable reference methods specified in Exhibit C. 13. Permittee shall conduct source tests at the maximum rating of the source, or at the maximum anticipated operating rate in accordance with the Reference Methods as specified in 40 CFR 60, Appendix A, unless otherwise specified by the Department. 14. Permittee shall submit a complete plan for conducting the source tests to the Southcentral Area Service Center of the Department, within sixty (60) days of receiving a request and at least thirty (30) days prior to the scheduled date of the test. Permittee shall give the Southcentral Area Service Center written notice with a schedule ten (10) days prior to each series of tests required under this permit. Permittee shall also give the same notice for the initial source test to the environmental engineer of the Kodiak Island Borough. 16. Permittee shall collect and report those parameters pertinent to the control device employed as listed in Exhibit C of this permit. 17. Permittee shall submit the results of the test, in the format set out in "Source Test Report Outline" (STRO), Volume 111, Section 1V.3 of the State Air Quality Control Plan (18 AAC 50.620) to the Department within forty- five (45) days following completion of the set of tests. Particulate Emission results (Section D-1 of the STRO) must be reported to the Department within fifteen (15) days after the completion of the testing. Permittee shall also submit the results for the initial source test to the environmental engineer of the Kodiak Island Borough. 18. Permittee may be required to source test any equipment, at any time, if deterioration is suspected or- deemed necessary by the Department to ascertain compliance with applicable standards or emission limits. D. CONTINUOUS MONITORING AND ROUTINE TESTING REQUIREMENTS 19. Permittee shall continuously monitor the pressure drop across the control device and record representative values for each day of operation, as stipulated in Exhibit D. Permittee shall also install, operate, and maintain process monitors, as described by Exhibit D, in accordance with 18 AAC 50.520. -• , E. REPORTING OF EXCESS EMISSIONS 20. Permittee shall notify the appropriate District Office by telephone or facsimile promptly, but not later than 24 hours, of any equipment or process failures which increase air contaminant emissions beyond normal levels, or of any change in operating conditions, or of any other circumstance which may result in emissions which exceed the limits or standards specified in this permit or applicable regulations. The permittee shall, as part of the notification, include the nature of occurrence, date of incident, expected duration, and a general description of the weather, and, if applicable, the steps taken to minimize emissions and avoid recurrence. Permittee shall submit a written report to the Department within five (5) working days of the incident if a facsimile was not sent under the above condition. 22. The permittee shall submit all oral and written reports and notices required by this permit and/or any applicable regulation to the Department's appropriate District Office, unless the permit expressly indicates otherwise. F. ACCESS TO THE FACILITY 23. Permittee shall allow access to the facility promptly, at any reasonable time, to the Department's representatives and any other person authorized or contracted by the Department, in order to conduct inspections or tests to determine compliance with this permit and State environmental laws and regulations. G. PERIODIC REPORTING AND RECORDS MANAGEMENT 24. Permittee shall submit two copies of the Facility Operating Report as described in Exhibit E of this permit to the Department's appropriate Regional Office for each calendar quarter by January 30th, April 30th, July 30th and October 30th each year. 25. Permittee shall maintain test results, monitoring instrument data or record charts, maintenance records and other applicable data in active files, available to an inspector, for not less than one year and have them accessible, on request, to the Department for not less than three years. 26. Permittee shall notify the Department, in writing, whenever it plans an expansion, modification, or other change in the facility's process or operation which might result in an increase in air emissions or discharges, from the facility. Permittee shall comply with 18 AAC 15.100. 27. Permittee shall clearly display a copy of this permit and keep a copy of the State Air Quality Control Regulations 18 AAC 50 on file, at the permitted facility location. The permit expires April 30, 2000, and you must request renewal at least thirty days prior to that date for continued operation of the facility. Violation of any condition of this permit may subject you to civil or criminal penalties as provided in AS 46.03.760, AS 46.03.765, AS 46.03.780, and AS 46.03.790. Permit conditions are stipulated pursuant to 6 AAC 50 and Air Quality Control Regulations 18 AAC 50, and are necessary to ensure that operation of your facility is consistent with the Alaska Coastal Management Program and Alaska Air Quality Control Regulations. This permit does not relieve you from the responsibility to apply for any other permit or approval required by the Department or the U.S. Environmental Protection Agency. Condition 3 prohibits the burning of material regulated as hazardous wastes as defined in 18 AAC 62 and 40 CFR 261. You must obtain permits from the U.S. Environmental Protection Agency if you wish to burn wastes defined as hazardous. • John Zbitnoff A-K Construction Company -3- Condition 5 requires notification when the unit is starting operations at a new location or starting operations for the season. This would include notifying the Department when you plan on initial, start-up of the plant. Condition 9 limits the fuel sulfur content to 0.5 percent, by weight. The fuel sulfur content is further restricted, in certain coastal zone areas which have the potential sulfur dioxide problems. The facility's correctly proposed location on Kodiak Island will not require the use of fuel with a sulfur content of 0.3 percent or less. Condition 17 through 24 covers the; source testing requirements. A source test must be conducted within 180, days of start-up of the facility. The source test must be performed at the maximum rated capacity of the facility or the maximum anticipated rate. Subsequent operations will be limited to the feed rate used in the source test, until such time another source test is conducted at a • higher rate that demonstrates compliance with the emission limits. During the inspections under Condition 18, the Department's representatives will abide by all valid and reasonable health and safety related rules or procedures prescribed by the Permittee, while within the boundaries of the facility. Exhibit A lists the equipment covered by the permit. Exhibit B lists the potential emissions from this equipment. In issuing this permit, the total emissions of each air contaminant from all existing pieces of equipment have been considered. ANY net change in emissions must be considered when determining the applicability of 18 AAC 50.300(a)(6)(C) when any future modification or series of modifications to this facility are proposed which would increase emissions of a regulated air contaminant. In Exhibit B, the appropriate emission rates based on emission factors have been listed. In Exhibit F, the Department's Southcentral Office has included references to State Statutes and Regulations for every permit condition. The references state which statute or regulation allows the Department to include the condition. This should make it easier for the Permittee or others reading the permit to better understand the permit and its conditions. It should also reduce the number of questions regarding permit conditions. John Zbitnoff -4- A-K Construction Company The new operating permit program mandated by the Clean Air Act Amendments of 1990 requires the collection of fees, a portion of which may be based on the actual or allowable emissions from the facility. The State is currently seeking EPA approval to implement the new operating permit program, but the program will be administered by the EPA if that effort fails. In either case, it is expected that the new operating permit program will be in place by late 1995. in the interim, the Department has implemented program fees, 18 AAC 50.415 and emission fees, 18 AAC 50.420. The emission fees became effective August 10, 1994. The interim emission fee regulation applies to all facilities that hold an air permit under the existing air quality control regulations, as set out in 18 AAC 50.300. The emission fee rate is $3.30 per ton of emissions. Fees will be assessed on emissions of particulate matter, sulfur dioxide, carbon monoxide, ozone, nitrogen oxides, lead, volatile organic compounds, and up to 4,000 tons per year of reduced sulfur compounds or ammonia. Fugitive emissions are also included in this regulation: Within 30 days after issuance of a new permit, a facility may submit an estimate of their emissions for this fiscal year (July 1, 1994 - June 30, 1995). The emissions should be calculated using emission factors from the EPA's publication AP-42, and should be submitted to the Department's Central Office, Juneau, Alaska. Other emission factors may be used with prior approval from the Department's Central Office. They will review each estimate against the facility's previdus year's operating reports. The estimate will be approved if it: 1) includes each of the above air contaminants; 2) is calculated using AP-42; and 3) is not less than the facility's previous year's actual emissions. Certain specific variations are allowed with prior written approval. If a facility does not submit an estimate of its emissions within 30 days after permit issuance, the Department wiIl estimate the facility's emissions based on AP-42 emission factors and the facilities previous year's operation reports. However, this is a billable activity, and the Department will charge $65 per hour spent reviewing files and calculating emissions. The current permit lists the total allowable emissions from your facility in Exhibit B. State regulations, 18 AAC 50.300(8), allows the owner or operator to request physical or operational limitations in order to reduce the facility's allowable emissions. If you wish to reduce the allowable emissions from your facility, please make such a request in writing, specifying the physical or operational limits to be incorporated into the permit. COMPLIANCE WITH AMBIENT STANDARDS & EMISSIONS STANDARDS, LIMITS, AND SPECIFICATIONS Permittee shall comply with the State Ambient Air Quality Standards and increments established by State Air Quality Control Regulations 18 AAC 50.020 (a) and (b). Permittee shall perform modeling to demonstrate compliance with ambient air quality standards and increments, if requested to do so by the Department, for areas which are in non- attainment or in areas which are suspected to be at least 80% of the standard or the increment. Permittee shall notify, in writing, and obtain approval from the appropriate Regional Office of the Department 15 days prior to operation, relocation or initiation of a new remediation project by submitting two copies of the Relocation/Operation form, as shown in Exhibit E. Permittee shall also send a copy of the Relocation/Operation form to the Division of Governmental Coordination and any affected coastal district(s). 6. Permittee shall install, maintain, and operate, in a manner consistent with the manufacturer's recommended procedures, fuel burning equipment, process equipment, and monitoring and testing equipment to provide optimum control of air contaminant emissions during all operating periods. Permittee is prohibited from operating the facility at a rate higher than source testing shows compliance. 7. Permittee shall inspect every component of the air emission control device prior to the first operation of the facility each year and prior to operations after each relocation of the facility, and repair or replace any component which shows signs of deterioration. 9. Permittee shall not burn any diesel fuel with a sulfur content greater than 0.50%, by weight. Permittee shall not burn any diesel fuel with a sulfur content greater than 0.30%, by weight, in a Coastal Resource Service Area (CRSA), without prior approval of the Department. 12. Permittee shall maintain a minimum pressure drop of water across the scrubber at all times for which source testing demonstrates compliance. Permittee shall operate the asphalt plant at a capacity no greater than the maximum.1-hour average for which the source test demonstrates compliance. Permittee shall not operate the asphalt plant, prior to the first source test, at a capacity greater than 40 tons per hour, one hour average. 16. Permittee shall control all sources of fugitive emissions to prevent release of material beyond the property line of the facility, including the following: 1. material piles, contaminated and treated ii. material and product conveyors iii. loadout hopper, pugmill (if applicable) iv. emissions control system v. roadways under the control of the permittee Permittee shall promptly repair any holes in ducts, shrouds, conveyors or malfunctioning equipment which contributes to release of fugitive dust beyond the facility boundaries. C. SOURCE TESTING REQUIREMENTS 17. Permittee shall conduct source tests, within 180 days of initial startup or within 60 days of achieving maximum production, whiCh ever is sooner, in order to ascertain concentrations and mass emission rates of particulate matter on equipment listed in Exhibit A. Tests shall be conducted according to the methods described in Exhibit C. 18. If there are any changes or modifications to a source which would trigger any increase in emissions, permittee shall perform source tests of the source within 90 days of the change or modification using the applicable reference methods specified in Exhibit C. 19. Permittee shall conduct source tests at the maximum rating of the source, or at the maximum anticipated operating rate in accordance with the Reference Methods as specified in 40 CFR 60, Appendix A, unless otherwise specified by the Department. 20. Permittee shall submit a complete plan for conducting the source tests to the Southcentral Regional Office of the Department, within sixty (60) days of receiving a request and at least thirty (30) days prior to the scheduled date of the test. Permittee shall give the Southcentral Regional Office written notice with a schedule ten (10) days prior to each series of tests required under this permit. 22. Permittee shall collect and report those parameters pertinent to the control device employed as listed in Exhibit C of this permit. 23. Permittee shall submit the results of the test, in the format set out in "Source Test Report Outline" (STRO), Volume III, Section IV.3 of the State Air Quality Control Plan (18 AAC 50.620) to the Department within forty- five (45) days following completion of the set of tests. Particulate Emission results (Section D-1 of the STRO) must be reported to the Department within fifteen (15) days after the completion of the testing. 24. Permittee may be required to source test any equipment, at any time, if deterioration is suspected or deemed necessary by the Department to ascertain compliance with applicable standards or emission limits. D. CONTINUOUS MONITORING AND ROUTINE TESTING REQUIREMENTS 27. Permittee shall continuously monitor the pressure drop across the control device and record representative values for each day of operation, as stipulated in Exhibit C. E. REPORTING OF EXCESS EMISSIONS 28. Permittee shall notify the appropriate District Office by telephone or facsimile promptly, but not later than 24 hours, of any equipment or process failures which increase air contaminant emissions beyond normal levels, or of any change in operating conditions, or of any other circumstance which may result in emissions which exceed the limits or standards specified in this permit or applicable regulations. The permittee shall, as part of the notification, include the nature of occurrence, date of incident, expected duration, and a general description of the weather, and, if applicable, the steps taken to minimize emissions and avoid recurrence. 29. The permittee shall submit all oral and written reports and, notices required by this permit and/or any applicable regulation to the Department's appropriate District Office, unless the permit expressly indicates otherwise. Permittee shall allow access to the facility promptly, at any reasonable time, to the Department's representatives and any other person authorized or contracted by the Department, in order to conduct inspections or tests to determine compliance with this permit and State environmental laws and regulations. G. PERIODIC REPORTING AND RECORDS MANAGEMENT 33. Permittee shall submit two copies of the Facility Operating Report as described in Exhibit E of this permit to the Department's appropriate Regional Office for each calendar quarter by January 30th, April 30th, July 30th and October 30th each year. 34. Permittee shall maintain test results, monitoring instrument data or record charts, maintenance records and other applicable data in active files, available to an inspector, for not less than one year and have them accessible, on request, to the Department for not less than three years. 35. Permittee shall notify the Department, in writing, whenever it plans an expansion, modification, or other change in the facility's process or operation which might result in an increase in air emissions or discharges, from the facility. Question 31 pertains to the settling basins for our plant. We plan to use a PVC liner in both fiasins. The basins will have an overflow discharge for storm protection that Will flow into mother small unlined basin. The particulate from the scrubber will be retained primarily in the Ftrst basin with the balance being retained in the second basin. The total voIume of particulate generated in one year is less than 11 tons based on our anticipated usage on the application. This calculates back to a volume of approximately 3,100 gallons. The combined pond volume is 12,000 gallons, which would allow for a minimum of two seasons. We plan to clean the basins annually at the very minimum and more if necessary. The sediment will be recycled into our asphalt gravel materials and rep rocessed. Question 37 lizs to do with your requirements for testing and probably is best explained by your Department. We plan to comply with all test requirements with the source test currently planned For the month of August. Question Six ofthe Coastal Zone Questionnaire shows a 2(1,000 gallon per day usage. This is a maximum number on the day the basins are filled. The location of the pits in Bell's Flat isin a gravel area with a very good table. The main gavel extraction area in our pit has a current water volume in excess of 40 million gallons. This high volume shculd insure that any wells in the area are not affected. Contrary to the fetter, scrubbers are not "largely obsolete in the industry" as was stated. Asphalt Drum Mixers Inc. (ADM) is a supplier of modern asphalt plants in the U.S. as well as 24 other countries scattered over 6 continents. Last year we manufactured over 30 asphalt plants with over half of these plants utilizing the wet wash scrubber system for particulate emmissions control. it is easy to see that scrubber systems with modern technology advances are still very common in todays asphalt industry. Perhaps these concerns originated from the misunderstanding of how an ADM wet wash ayatem operates. The ADM wet wash scrubber system supplied with your new asphalt drum mix plant is quite capable of meeting your state requirements for particulate emmissions control. As we have discussed in the past, the water supplied to the scrubber system la- ;ontinually recirculated to maintain a closed system. Fresh water may need to be added in the event that some of the water will evaporate over a period of time. I am also enclosing a letter from A.D.M. addressing Mr. Brochan's concerns. We also would hle to express our position on his concerns. The first c °ncerr. is on the obsolete - inefficient scrubber Mr. Brechan questioned. This plant is brand mew and coming direct from one of the major asphalt plant manufacturers in the US It is supplied with the top -of- the -line control and safety systems available. The air quality test ports are built -in to the stack far testing as required. We have already been in contact with the source test people and have a preliminary time frame established for this test. I realize that the standards are always changing and that the regulations will probably be tightened down in future years. I expect AD.M. will be a leader in new technology when that time arrives. It is our belief that a new plant purchased in 1995 will be much easier to upgrade than some ofthe older plants currently being used. The second concern of Mr. Brechan's was the water containment for the scrubber system. We plan to use two PVC lined settling ponds to remove the particulate from the water. The material will be reclaimed and added to.future asphalt gravel material. It is true that our property is adjacent to a known salmon stream, but the plant's. The small amount of residue pulle-d out with the scrubber system will be composed of gravel materials finer than the 40 sieve. Our penult application shows a total particulate amount of approximately 225 lb./hour based on a 45 TPH production. We plan to use the plant somewhere less than 100 hours per year which would generate approximately 11 tons of fine gravel material per year. The scubber will pull out at least 98.84% or 10.87 tons. The plant is scheduled for shipping form the factory in Indiana the week of May 20th. It should arrive in Kodiak on or about June 10th. We plan to have A.D.M. pe vie here during the week of June 19th for final set-up and testing. We have a tentative paving schedule for early July and late August. The plan is to have A.D.M. people mok in August to aid and assist on the source test. The Kodiak Island Borough Assembly took action on August 3, •1979 • (Item F Page 6 of the Borough Minutes) "to affirm the policy as outlined in the last paragraph of the manager's memo and continue the lease until other arrangements are made". During my last office visit to the borough office, I found that $1,200 was deposited with the borough when Felton made application for 450,000 cubic yards of gravel on June 18, 1979. The $1,200 remains in the safe, not earned or returned. The last paragraph of Denslow's memo referred to in the Assembly action has some inaccuracies. These are: 1. The Felton Lease K 649 was not renewable. It contained a non-renewable clause. 2. Felton knew he had a one year lease and was applying for a new gravel sale under Title 18.60 of the Borough Code of Ordinances. Felton was applying for 450,000 cubic yards of material - not a lease. See application in K 717. .The Assembly action should be reconsidered as nothing was done to follow through in regard to issue an extension. Harry Milligan has indicated Felton Construction moved his equipment off Kodiak Island. I believe no appreciable amount of gravel was ever removed from the site. The 1978-79 $1,200 payment would have earned 5,000 cubic yards. . What to do? 1. Have the Assembly rescind their August 3, 1979 action. 2. I conclude that financial participation may be obtained by two means: (1) taxation of the leasehold and contract interests; or (2) as part of the lease or contract price, where that price currently has not been fixed by contract. It is my understanding that the service districts' expenses currently are defrayed by a tax upon the real property in the district. This tax could be extended to private contract or leasehold interests in Borough-owned property within the district. AS29.53.020 (a) provides in'relevant part: (a) The following property is exempt from general taxation: - (1) Municipal, State or federally owned property, except that private leaseholds, contracts or other interests in the porperty.shall be taxable to the extent of those interests. Hence leasehold and contract interests in Borough owned property are subject to ad valorem taxation at their fair market value. KIB Code 18.60.060, governing new material sale contracts, provides that materials shall be sold for no less than their appraised value, and that annually the Assembly shall set a minimum unit value for material to be sold. There is no reason why that minimum unit value could not include a charge for support to the road service district. Of course, in the case of existing leases and contracts under which the price of materials has been fixed, the Borough is bound by ■P' Law Offices of RICIIARD W. A. Poythress. Mr. Milligan made the staff presentation based upon a memorandum prepared by the Planning Department analyzing the requested variance. Chairman Anderson then opened the public hearing and asked Mr. Poythress to come forward and present his requested variance. Mr. Poythress stated that there are presently 31 units in the project and that there is 1 parking space for each of the 31 guest rooms plus 3 extra guest ,parking spaces. Of the 31 units, present]y the occupants of 14 of those units have no cars. He stated that it was their intent to build the new building to house a laundry room, an office,. a recreation room and quarters for the manager. The existing laundry room and office are located in the basement of one of the buildings. And this would allow the conversion of that space for storage purposes. He stated that new building would, enhance the site and would not interfere with any existing parking. Mr. Perez asked if Mr. Poythress was aware that he was over built on the site. Mr. Poythress answered "yes, it was over built but that he felt that the additional construction further enhance the appearance of the area. Mr. Perez asked Waal Mr. Poythress intended to to with existing space in the building if the variance was granted. Mr. Poythress responded that the one apartment that the manager uses now would remain an area for storage would be taken up by the existing laundry room and office as that space is presently located in the basement and was not feasible for additional apartments. Following a lengthy discussion between mr. Poythress and the Commission concerning the existing site and its future intentions, the public hearing was closed. It was moved by Mr. Pugh and seconded by Mr. Baker to grant the variance reques for construction of an additional building to house a manager's quarters, laundry room, office and recreation room at the Spruce Manor Apartments, request by Mr. Poythress. The variance was denied by a vote of 1 YES and 5 NO with Mr. Anderson, Mr. Ball, Mr. Erwin, Mr. Perez and Mr. Baker voting NO. Next Chairman Anderson introduce Case L-73-00I, a request for a borrow site leas submitted by Felton Construction Company for Tract B-1 Bells Flats Alaska Subdivision. Mr. Milligan made the staff presentation based on a memorandum prepared by the Planning Department analyzing the application. Following his presentation Mr. Joseph Spring of Felton Construction came forward and explained the reasons why Felton Construction Company was submitting this new borrow site lease application. Mr. Spring explained he had worked. closely with the Staff, Mr. Tubbs, Mr. Marmaduke in preparing all of the required data for the Planning Commissions review. He explained that the Felton Construction Company lease on Tract B-1 was due to expire on the 26th of July and that they were caught in the bind of a change in regulations between former Borough land disposal regulations and those presently contained in Title 1S. He also explained that while the Borough Assembly in adopting new regulations for the lease and disposal of the land had retained the former provisions of the code dealing with Borough site lease and there were some probicte; between the old and the new regulations and his company was caught right in the middle of this chenge. An extensive discussion followed between ,Mr. Spring and members of the Commissio concerning Felton Construction proposed use of the land and the length of time that they would be utilizing the land. Mt. Spring explained the intent of at this point of only applying for a 3 year lease . which he felt would adequately cover the time necessary for preparation of new regulations at which .point they would submit a subsequent new lease application under whatever new regulations the Borough has adopted. The applicant is seeking a new lease of Tract B - 1 Bells Flats Alaska Subdivision, which is located in an industrial reserve zoning use district to be used for the extraction of gravel. This site was first leased to the applicant for a period of five years on July 26, 1973. SITE The petitioned property, Tract B-1, Bells Flats Alaska Subdivision, though it has been under lease for the _past five years to the Felton Construction Company, has not been used for gravel extraction purposes and has not been developed with any physical structures or improvements. HISTORY On July 26, 1973, the Kodiak Island Borough leased Tract B-1 to Felton Construction Company for purposes of extracting gravel. The lease was for a total period of five years to be renewed annually. Thus the lease expires on the July 26, 1978. On June 5, 1978, consistent with the requirements of Title 18, Kodiak Island Borough Code of Ordinances, Mr. James J. Staff finds that the proposes lease site is located within an industrial zoning use district. Which district allows the extraction of gravel. as outlined in this application. We find that the use of the adjacent properties is similar to that which has been requested in this application and that the use is appropriate to the proposed site. We find that the proposes lease covers a period of only three years, which is within the limits set forth in the ordinance for consideration of such a lease.
