Planning and Zoning Commission review of a detailed site plan to permit the placement of a 8 foot by 40 foot storage container (accessory building) on a lot in the PL--Public Use Land Zoning District. Tract C, Block 38, East Addition (Main Elementary School) The Kodiak Island Borough Planning and Zoning Commission at their meeting on April 20, 1994, approved the review and approval request cited above. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the Borough Clerk within ten (10) days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal and the relief sought by the appellant. Therefore, the Commission's decision will not be final and effective until ten (10) days following the decision. Failure to utilize this approval within twelve (12) months after its effective date shall cause its cancellation. Please bring this letter with you if you need to come into our office to obtain zoning compliance for any construction on the property. If you have any questions about the action of the Commission, please contact the Community Development Department. IV. Tract C, Block 38, East Addition (Main Elementary School) COMMISSIONER BONNEY MOVED TO APPROVE a detailed site plan to permit the placement of an 8 foot by 40 foot storage container (accessory building) on a lot in the PL--Public Use Land Zoning District on a portion of Tract C, Block 38, East Addition. Request for a rezone, in accordance with Section 17.72.030 C (Manner of Initiation) of the Borough Code, of approximately 29.5 acres of land, comprising the Kodiak Baptist Mission, from RR1--Rural Residential One to UNC-- Urban Neighborhood Commercial; and the investigation of the rezone of Lots 23 and 24A-24E, U.S. Survey 3098; Lot 6, U.S. Survey 3511; Lot 1, Block 1, U.S. Survey 1822; Lot 2A, Block 4 and Lot 1, Block 6, 3066A/B, and Lots 1 & 2, Block 1 and the East portion of U.S. Survey 2739, from RR1--Rural Residential One to a more appropriate zoning district. (Postponed and expanded by the Planning & zoning Commission from the March 16, 1994 regular meeting). 1910, 1944-2290 and unnumbered lots on Rezanof Drive, East; 1897-1967 Mission Road; 2180 Mill Bay Road; and 117-122 Bancroft Drive. LINDA FREED indicated 78 public hearing notices were mailed for this case and 1 was returned, opposing this request. Staff recommended the Commission consider the rezone pattern suggested in the,staff memorandum dated March 25, 1994, that the case be advertised as such, and that another public hearing be held at the May 18, 1994 regular meeting, prior to a recommendation being forwarded to the Assembly. LOCATION: Tract C, Block 38, East Addition (Main Elementary School) ZONING: PL--Public Use Land BACKGROUND This request was initiated by the Kodiak Island Borough Engineering and Facilities Department. The purpose of the proposed storage container is to provide accessory storage for Main Elementary School, which is the primary use established on Tract C. Accessory buildings (and containers) are a permitted use in the PL--Public Use Land zoning district. Review by the Commission of a detailed site plan is required before zoning compliance can be issued for all perrnitted uses in the PL--Public Use Land zoning district. According to the site plan submitted, it appears that the proposed storage container will be located so that it does not encroach any setback or utility easement. The setback requirements of the PL--Public Use Land zoning district are 25 feet from the front, rear and side lot lines of Tract C. The storage container will not be located over, or interfere with, any platted utility easements. The storage container is needed to provide temporary storage for a period of about 3 - 5 years. As an accessory building, the storage container will not increase the off-street parking requirement. RECOMMENDATION Staff recommends that the Commission approve the detailed site plan and permit the location of an 8 X 40 foot storage container on Tract C, Block 38, East Addition. The public lands district is established as a land use district for publicly owned land containing recreational, educational and institu- tional uses. For the public lands district, in promoting the general purposes of this title, the specific intentions of this chapter are: A. To identify lands owned by governments that are used for public purposes; B. To prohibit residential, commercial and industrial land uses and any other use of the land which'would interfere with the development or continuation of public services in the district; and. C. The following land uses are permitted in the public lands district subject to the approval of a detailed site plan by the commission: A. Cemeteries; B. Community buildings and halls; C. Fire stations; D. Gymnasiums; E. Hospitals; F. Libraries; G. Museums; H. Nursing homes; I. Offices for local, state and federal governments; J. Open air theaters; K. Parks, playgrounds, playfields, and open space; L. Recreation centers; M. Sanitariums; N. Schools, public and private; 0. Swimming pools; and P. Utility installations. The following land uses may be allowed by obtaining a conditional use permit from the planning and zoning commission after proper notice, public hearing, and approval of a detailed site plan: A. The minimum yard required on each side of a principal building is ten percent of the lot's width but need not exceed twenty -five feet. It is recognized that there are land uses which are generally considered appropriate in certain zoning districts; provided, that controls and safeguards are applied to insure their compatibility with permitted principal uses. The conditional use permit procedure is intended to allow consideration of the impact of the proposed conditional use on surrounding property, and the application of controls and safeguards to assure that the conditional use will be compatible with the surrounding area. (Ord. 81 -31 -0 §2(part), 1981). 17.67.020 Application and fee. A. An application to the community development department for a conditional use or modification of an existing conditional use may be initiated by a property owner or his authorized agent. B. An application for a conditional use shall be filed with the department on a form provided. The application for a conditional use permit shall be accompanied by a filing fee, established by resolution, payable to the Kodiak Island Borough. (Ord. 92 -12 §10, 1992; Ord. 81 -31 -0 §2(part), 1981). 17.67.030 Site al A detailed site plan sljwing the proposed location of all buildings and s es on th- i(e, access points, drainage, vehicular and pedestrian circulation patterns, parking areas, and the specific location of the use or uses to be made of the development shall be submitted with the application, together with other information as may be required to comply with the standards for a conditional use listed in this chapter and in other pertinent sections of this chapter. (Ord. 81 -31 -0 §2(part), 1981). 17.67.040 Public hearing. The planning and zoning commission shall hold a.public hearing within thirty days after the filing of the application. The community development department shall give notice of hearing as required. (Ord. 81 -31 -0 §2(part), 1981). 17.67.050 Standards. In granting a conditional use permit, the planning and zoning commission must make the following findings: --- 17 -86 (KIB 1/93) Supp. #4 17.67.050--17.67.080 A. That the conditional use will preserve the value, spirit, character and integrity of the surrounding area; B. That the_coriditional use fulfills all other requirements of this chapter pertaining to the conditional use in question; C. That granting the conditional use permit will not be harmful to the public health, safety, convenience and comfort; D. That the sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section; E. If the permit is for a public use or structure, the commission must find that the proposed use or structure is located in a manner which will maximize public benefits. (Ord. 81-31-0 §2(part), 1981). 17.67.060 Stipulations. In recommending the granting of a conditional use, the planning and zoning commission shall stipulate, in writing, requirements which it finds necessary to carry out the intent of this chapter. These stipulations may increase the required lot or yard size, control the location and number of vehicular access points to the property, require screening and landscaping where necessary to reduce noise and glare, and maintain the property in a character in keeping with surrounding area; or may impose other conditions and safeguards designed to insure the compatibility of the conditional use with other uses in the district. (Ord. 81-31-0 §2(part), 1981). 17.67.070 Action by planning and zoning commission. The planning and zoning commission shall render a decision on the application for conditional use permits within thirty calendar days from the date of public hearing. The community development department shall incorporate any conditions and requirements stipulated by the commission in the conditional use permit. (Ord. 81-31-0 §2(part), 1981). 17.67.080 Appeals. The planning and zoning commission's action may be appealed to the borough assembly by any party. Right of appeal is forfeited unless the appeal is filed within twenty days of the commission's decision.
