In reply to your memo of March 8, 1983 pertaining to encroachments,
I would like to inform you of the following:
CASE #1 Island Sand & Gravel's (Dean beater) use of Selief Lane
for parking and storage of his heavy construction equipment has not
been approved by the-City of Kodiak.
CASE #2 The house located on the corner of Selief Lane and Mozart
Circle, with a walk-way constructed into the right-of-way, is owned
by Mr. Dale Soughers. No permit for the walk-way has been issued.
The walk-way was installed by Mr. Soughers as a convenience measure
while that area was so muddy and wet and still under heavy construction.
It was the only access to his house while Mozart Circle was so torn up.
This is no longer the case and it may be wise to have him remove the
portion of the walk-way that encroaches into the right-of-way, before
it gets grandfathered in. He did mention this to me at one time and I
advised him that no permanent installation could be placed in the road
right-of-way due to drainage ditch maintenance activities, etc.

During a recent field inspection conducted by Mr. Phil
Shealy and Mr. Will Walton in the Selief Lane area it
was noted that two cases of encroachments exist in
the Selief Lane Road Right-of-Way.
Case #1
Isl.*: and and Gravel (Dean Deater) is using the c 1-de-
area of Selief Lane for parking and storage of is
heavy construction equipment as his private lot acks
the area and zoning to do so.
Case #2
The house located on the corner of Selief Lane and Mozart
Circle has a walkway constructed into the right-of-way of
Selief Lane abutting the edge of the existing roadway.
Could you please inform me whether the City has granted
approval for these uses of public right-of-ways?
