NANCY MISSAL, resident of Marmot Drive, spoke in opposition to the
sale of land to Timberline, Inc., and urged the Commission to con-
sider the planning group's comprehensive planning effort.
DEBORAH BURGY, resident of Marmot Drive and representing Robert
Burgy, spoke in opposition to the sale of land to Timberline, Inc-.
Mrs, Burgy felt that Timberline, Inc. had acted in complete dis-
respect for the neighbors in the area by cutting down trees on
private property. Mrs. Burgy suggested that Timberline, Inc.
would escalate their investment by enlarging their industrial
use of the land.
OKEY CHANDLER, non-resident of the area, spoke favorably of
Timberline, Inc., reminding the Commission of the production of
lumber as a "need" to the community, the hardship in cost in moving
the sawmill, and recommended that the Borough renew the lease for
another five years (or until Timberline, Inc. "sawed-up all the
trees out there").
LEN GROTHE stated that the original application for lease was for
a 55-year lease located in the city dump, but the Borough felt a
sawmill and a dump were not compatible and outlined the present
sawmill site, granting Timberline, Inc. a 5-year lease.
Mr. Grothe also presented the financial hardship created if the
sawmill had to be moved, reminded the Commission that a lease
modification had been made to enable the sawmill site to be located
250' from the nearest residential lot, and spoke in favor of granting
the sale of land to Timberline, Inc.
COMMISSIONER MARLIN KNIGHT questioned Mr. Grothe as to why the
previous Assembly had not entered a "renewable lease" clause into
the lease, and Mr. Grothe answered that there had always been
considerable public opposition to the sawmill.
SCOTT ARNDT, an Assemblyman at the time of the renewal of the
lease, stated that previously a sawmill was considered an agri-
cultural use and was allowed in.a Conservation District under the
code. Mr. Arndt could not foresee proposed residential use of the
area, but was in favor of continued Industrial use.
ACTING CHAIRMAN RENNELL closed the Public Hearing and reconvened
the Regular Meeting.
COMMISSIONER HILL MOVED ON CASE 84-020, a request to purchase 15
acres of presently leased Borough real property in accordance •
Chapter 18.30, a portion of ADL 44355, and located on Monashka
Bay Drive, TO FIND THE PROPERTY IS SURPLUS to the Borough's needs
and, therefore, to recommend to the Borough Assembly that it be put
up for sale. The motion was seconded and FAILED by roll call vote,
with Commissioners Hill and Patterson voting "yes."
FINDINGS OF FACT AND REASONS FOR DENIAL:
1. the area is not considered surplus to the Borough's.needs;
2. sufficient time remains before the lease expires in 1986
to consider sale of this property;
3. by 1986 the perspective on development pressure will be
clearer and a master plan for the area will be completed;
4. other Industrial land will be available on the rural road
system; and
5. public testimony offered thus far has been in opposition
to the sale of land to Timberline, Inc.

VARIANCE from Section 17.18.050 (Yards) and Section 17.40.010
(Projections into Required Yards) to allow construction of
additions onto the front and side of the existing structure on
Lot 6A, Block 54, East Addition Subdivision with the following
condition:
1. the carport be erected in such a manner that it would not
prevent a fire vehicle from breaking through to reach the other
side of the building, if necessary.
The.motiou was seconded and the Chairman called for a roll call
vote. The motion CARRIED unanimously by roll call vote.
D) CASE 84-023. Request for a variance from Section 17.60.030 (Resi-
dential Districts) to permit an illuminated sign in a multi-family
residential district on Lot 19B, Block 5, Erskine Subdivision;
411 Rezanof Drive (Travel Center, Inc.).
MS. FREED reported receiving more public hearing notices in
opposition to the request. As there was no further discussion,
the Chairman closed the Regular Meeting and opened the Public
Hearing.
GAIL PHILLIPS and KNOX CHRISTIE spoke in favor of the Commission
granting the request because they felt the sign to be discrete.
HARRY BRIGHTON, EDITH WILEY, AND NANCY FROST (residents in the
area) were present and voiced objection to granting the request.
ACTING CHAIRMAN RENNELL closed the Public Hearing and reconvened
the Regular Meeting.
COMMISSIONER PATTERSON MOVED IN CASE 84-023 TO GRANT A REQUEST
FOR A VARIANCE from Section 17.60.030 (Residential Districts)
. to permit an illuminated sign in a Multi-family Residential
District on Lot 19B, Block 5, Erskine Subdivision; 411 Rezanof
Drive. The motion was seconded. The Chairman called for a
roll call vote. The motion FAILED by unanimous roll call vote.
ACTING CHAIRMAN RENNELL informed the applicant'of the right to
appeal to the .City Council within 10 days.
FINDINGS OF FACT AND REASONS FOR DENIAL:
1. that there was no compelling reason to have an illuminated
sign in a residential area;
2. that there was too much public opposition to the request;
3. that the business will have no harmful effects from not having
the sign illuminated; and
4. that an illuminated sign is not appropriate for a professional
office building in a residential area.
E) CASE 84-024. Request for a variance from Section 17.19.040 (Yards)
to allow the construction of an attached garage into the required
front yard setback on Lot 1, Block 7, Aleutian Homes Subdivision;

Forty-four public hearing notices were mailed on March 29, 1984.
1. Applicant: Michael C. Brechan, P.O. Box 1275, Kodiak, AK 99615.
2. Land Owner: Anita (Johnson) Brechan, P.O. Box 1275, Kodiak, AK 99615.
3. Request: A request for a variance from Sections 17.18.050 (Yards) and
17.40.010 (Projections into Required Yards) to allow construction of
additions onto the front and side of the existing structure.
4. Purpose: The purpose of this request is to allow an addition onto
the home and carport.
5. Existing Zoning: The existing zoning is Single-Family Residential (R1).
6. Zoning History: The 1968 Comprehensive Plan designates this lot as
Rural Residential (R1). Departmental files show no other action.
7. Location: Lot 6A, Block 54, East Addition Subdivision (1213 Rezanof Dr.).
8. Lot Size: 12,160 square feet.
9. Existing Land Use: Single-family residence.
10. Surrounding. Land Use and Zoning:
North: Lot 8, 9, 10, and 11, Block 54, East Addition is zoned R1 and
has an R1 use;
South: Rezanof Drive;
East: Lot 4, Block 54, East Addition is zoned R1 and has an R1 use;
West: Lot 2A, Block 52, East Addition is zoned R1 and is vacant.
11. Comprehensive Plan: The 1968 Comprehensive Plan designated this area
as medium-density residential.
12. Applicable Regulations: Chapter. 17.18 (Single-Family Residential),
Section 17.18.050 (Yards) states the minimum required front yard
shall be 25 feet. Chapter 17.40 (Projections into Required Yards)
states that required yards shall be unobstructed from ground and sky
except by unroofed and unenclosed structures (decks, stairs, ect.).
COMMENTS:
1. KITCHEN EXPANSION: The applicant wants to expand the kitchen in his
home out 12.5 feet into the required 25-foot front yard setback. A
bank drops off abruptly six feet from the edge of the proposed structure.
Because the right-of-way of Rezanof Drive includes part of the steep
bank, the road is actually located on the far side of the right-of
way. The house sits thirty feet above the road and about sixty feet
away from the road's edge.
One concern to address is that the expansion of the kitchen to within
six feet of the bluff reduces the working area where fire equipment
could assist in extinguishing a kitchen fire; therefore, consideration
of a smaller addition may be warranted.
2. CARPORT: Because a carport has a roof, it is excluded as a structure
that can "project into required yards." Interestingly, this structure
would probably be permitted if it was a deck for the upstairs. The
intent of this code requirement again is the ability for fire equip-
ment to move easily around the structure in case of a fire. Based on
the plans, there will still be ten feet from the carport to the side
lot line. The required side yard setback is 14.9 feet. The carport
will encroach 4.9 feet into the required side yard.
3. LOCATION: The house sits up far enough and high enough so as not
to be detrimental to other properties in the area, and the property
has enough level area to permit construction.
RECOMMENDATION:
Staff recommends approval of this request with the following condition:
1. The carport be erected in such a manner that it would not prevent a
fire vehicle from breaking through to reach the other side of the
building, if necessary.

Subject: Request for Construction Variance
Dear Sirs:
We would like to request a variance for'the construction of a
kitchen addition and car port on an existing house on the
above property. The structure of the house is such that there
is virtually no other way to expand the existing kitchen facility
on the house and' our feeling is that although we encroach on the
requirements for front. yard facing Rezanof Drive, it would be
impossible.for the state to construct anything or widen the road
on their right of way and therefore' we are of sufficient distance
from the centerline of* Rezanof Drive.
Concerning the dar port, this :,is basically a convenience item for
the new kitchen so that. we do not have to carry groceries and
other kitchen items 'through the house to reach the existing.kit-
chen during periods'of inclement weather. The construction still
leaves some 10 foot. for fire access and other functions required
for side lot clearances.
