The motion was seconded and CARRIED by unanimous roll call vote. There
was some discussion by the Commission as to what form of notification
the Commission should make in advising the Assembly of their not taking
action on the Nixon Ranch. Commissioner Crowe directed staff to notify
the Commission of the next packet review worksession of the Borough
Assembly in order for the Commission to relay the reasons for excluding
the Nixon Ranch from the motion.

Regular Meeting and opened the Public Hearing. There were no audience
comments and the Chairman closed the Public Hearing and reconvened the
Regular Meeting.
COMMISSIONER RENNELL MOVED TO GRANT A VARIANCE -from Section 17.18.050C
(Rear Yards) to permit the construction of a greenhouse ten (10) feet
into the required rear yard setback on Lot 9, Block 54, East Addition.
The motion was seconded and the question called. The motion CARRIED'•by
roll call vote with Commissioners James and Crowe voting "no." -- --
F) CASE 84 -060. Request for an Exception from Section 17.19.020
(Permitted Uses) to allow a fireworks stand in a Two - family
Residential District (R2) on a portion of Tract C -1, U.S. Survey
1682 (Les and Dan Seaton).
There was no additional staff report, CHAIRMAN GREGG recessed the
Regular Meeting and opened the Public Hearing. There being no audience
comments and the Chairman closed the Public Hearing and reconvened the
Regular Meeting.
COMMISSIONER RENNELL MOVED TO GRANT A REQUEST FOR AN EXCEPTION from
Section 17.19.020 (Permitted Uses) to allow a fireworks stand in a
Two - family Residential District (R2) on a portion of Tract C -1,
U.S. Survey 1682 with the conditions as stated in the staff memo of
June 12, 1984:
1. The structure shall be removed from the lot by Monday, July 9, 1984;
and
2. The conditions spelled out in the letter from the Borough dated
April 12, 1984 be adhered to.
The motion was seconded and CARRIED with Commissioner Rennell voting
"no."
G) CASE 84 -061. Request for a Variance from Section 17.19.040B
(Side Yards) to construct a single - family residence 6.5 feet into
the required side yard setback on Lot 13A, Block 8, Leite Addition;
1519 Vanovsky Street (Jon Dudding).
MR CASSIDY reported an additional public hearing notice had been
received in favor of the request.
CHAIRMAN GREGG recessed the Regular Meeting and opened the Public
Hearing.
MR. DON BRENTESON, 1514 Kouskov Street, spoke in favor of the request.
Mr. Brenteson felt the new residence would improve the appearance of the
surrounding area.
There being no further public testimony, the Chairman closed the Public
Hearing and reconvened the Regular Meeting.
COMMISSIONER RENNELL MOVED TO GRANT A VARIANCE from Section 17.19.040B
(Side Yards) to construct a single - family residence 6.5 feet into the
required side yard setback on Lot 13A, Block 8, Leite Addition,

Nineteen (19) public hearing notices were mailed on June 5, 1984..
1. Applicant: Mr. Thomas J. Healey, P.O. Box 1676, Kodiak, AK 99615.
2. Land Owner: Same as applicant.
3. Request: Request for a Variance from Section 17.18.050 (C).
4. Purpose: The purpose of this request is to permit the construction of
a greenhouse ten (10) feet into the required rear yard setback on
Lot 9, Block 54, East Addition.
5. Existing Zoning: The existing zoning is Single-family Residential (R1).
6. Zoning History: The 1968 Comprehensive Plan indicates this lot is zoned
R1. In 1965 a variance was approved allowing construction of the
single-family residence that encroaches five (5) feet into the required
ten (10) foot side yard setback (Case 114 A). Departmental files show
no additional activity.
7. Location: Lot 9, Block 54, East Addition;
1712 Simeonof Street.
8. Lot Size: The lot size is 8,000 square feet.
9. Existing Land Use: The existing land use is a single-family home.
10. Surrounding Land Use and Zoning:
North: Block 53, East Addition is zoned PL and is used as a park;
South: Lot 6A, Block 54, East Addition is zoned R1 and has an R1 use;
East: Lot 10, Block 54, East Addition is zoned R1 and has an R1 use;
West: Lot 8, Block 54, East Addition is zoned R1 and has an RI use.
11. Comprehensive Plan: The Comprehensive Plan indicates this area for
"medium-density residential."
12. Applicable Regulations: Chapter 17.18, Single-family Residential District
(R1), Section 17.18.050 (C) Rear Yards states:
The minimum rear yard required is twenty-five percent of the lot's depth,
not to exceed twenty-five feet.
COMMENTS:
The applicant proposes to build a 320 square-foot passive solar greenhouse that
encroaches ten (10) feet into the rear yard toward an alley. This alley is
well used for access, especially by those five homes on the south side that
front on Rezanof Drive.
RECOMMENDATION:
Staff recommends approval of this variance request for the following reasons:
1. the proposed building is adjacent, but ten (10) feet back from an alley
way;
2. it would not prejudice any of the neighboring property; and
3. the request meets the criteria established in Section 17.66.050 to
grant a variance.
APPROPRIATE MOTION:
Move to grant a Variance from Section 17.18.050 (C) Rear Yards to permit the
construction of a greenhouse that encroaches ten (10) feet into the required
rear yard setback on Lot 9, Block 54, East Addition.
