Dear Resident:
In response to an inquiry by the Post Office about addressing in your area, the Kodiak Island
Borough discovered that the address for the above referenced parcel does not conform to the
Borough's code for addressing (Code Section 15.32.050), and with the KIB Planning and Zoning
Commissions Resolution 2002-06A (naming the 20 foot wide alley right-of-way to Lechner
Way).
We found it necessary to correct and verify the addresses in that area, therefore attached you will
find all the addresses for the area within East Addition, Blocks 54 &. 56 and selected lots .within
Block 52. Other agenicies that have been advised of this change are: City of Kodiak Public
Works, KEA, GCI, ACS, Alaska State Troopers, City of Kodiak Building Officials, and the
Kodiak Police and Fire Departments.

This letter is provided to confirm the status of the dwelling located on Lot 10, Block 54,
East Addition. This lot is zoned R1--Single-Family Residential. Based on a review of
City of Kodiak sales tax records and Kodiak Island Borough property tax records, staff
has determined that the structure located on the lot referenced above is a legal
nonconforming structure containing a legal nonconforming use.
A nonconforming structure is a structure that was lawful at the time of construction (or
was grandfathered by Borough ordinance in 1980) which could not be built under the
existing zoning code by reason of restrictions on area, lot coverage, height, yards, or
other characteristics of the structure or its location on the lot. Such a structure may be
continued indefinitely, so long as it remains otherwise lawful subject to the following
provisions.
. No such structure may be enlarged or altered in a way which increases its
nonconformity.
2. Should such structure be destroyed by any means to an extent of more
than fifty percent (50%) of its replacement cost at the time of destruction, it
shall not be reconstructed except in conformity to the regulations for the
provisions of this title.
Should such structure be moved for any reason and for any distance
whatever, it shall thereafter conform to the regulations for the district in
which it is located after it is moved.

A nonconforming use of a structure is a use that was lawful at the time the structure
was constructed (or was grandfathered by Borough Ordinance in 1980), which would
not be allowed under the current zoning code. Such a use may be allowed under the
current zoning code. Such a use may be continued indefinitely, so long as it remains
otherwise lawful subject to a number of provisions (see the attachment), the most
important of which is that:
"When the nonconforming use of a structure, or structure and premises in
combination, is discontinued or abandoned for one year or more, the
structure, or structure and premises, shall not thereafter be used except in
conformance with the regulations of the district in which it is located."
(17.36.050E)
One copy each of (a) the R1--Single-Family Residential Zoning District regulations and
(b) the nonconforming code section are attached.
