(KIB Assembly) STAFF REPORT: Mr Milligan presented the staff report based on a memorandum prepared by the Planning Department Staff. The Borough Assembly asked in initiating this comp. plan amendment that you take another look at Mr. Zimmer's property and deter- mine whether or not the amendment' to the'comp plan from residential to:business should be_extended tojnclude his property. Mr. Pugh moved to put before Public Hearing at our next regular meeting an amendment to the Comprehensive Land :use Plan from Medium Density Residential Public and Open Space and Mobile Home Courts to business to include Lot 2A, USS 3218. P-8e Z Commission request to rezone all landswithin the city of Old Harbor. • • STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum from Mr. W.L. Painter, Jr. of Modern Construction Inc. requesting a parcel of land within a po.rtionof USS 474 in the church reserve be rezoned from R-1 to industrial. Mr. Perez and I had met with Mr. Haakanson last fall and the City of Old Harbor is:interested in proceeding with implementation of-the zoning sketch plan that was prepared in 1977 for the City of Old Harbor. Presently the new housing subdivision is zoned R-1, there would be no change in that area. Mr. Anderson moved to recommend passage ofResolution Z=79-020 to the Borough Assembly for them to hold the Public Hearing. Mr. Ball seconded. Motion carried by unanious roll call vote. Z-79-023. •, City of Kodiak request to amend the 1968 Land Use Classification to include the lands adjacent to the small boat harbor and rezone the site from Conservation to Industrial. STAFF REPORT: Mr. Milligan stated that he recently had discussion with Mr: Harmony with regard to what problem,there might be in terms of zoning with developing(the tract of land that has been conveyed to the City of 'Kodiak by the-State. In checking the zoning map and the Land Use Plan it justeshowed a finger break water and was not included in the•Industrial Zoning. It would be our recommendation that you ammehd the Comp Plan and recommend rezooing simutaneously on the piece of property so it can be developed and used. Walker REQUEST: Petitioners are requesting a variance to permit the construction of a small addition to their home which is intended to house a freezer and porch. The proposed addition is 56 square feet and would project 3.5 feet into a required side yard of 7.5 feet. SITE: The petitioned property is located on the East side of Simemoff Street, the site is level, cleared and developed with a conforming single family dwelling structure. ANALYSIS: The following information has been provided by the applicant for your review. The information presented is in direct response to requirement of the Kodiak Island Borough Code of Ordinances, sections A & B describe the existing situation and what grating this request will permit. No response was provided for section C. A. The Existing Situation Is: Poor drainage, lack of room for freezer granting this variance would be 3-6 into refered side yard. B. Granting Of This Petition Would Permit: Protection from elements for freezer and yard equipment. Would improve drainage to protect main building. C. Evidence Of The Ability And Intention Of The Applicant To Proceed In Accordance With The Plans Within Six (6) Months After The Effective Date Of The Variance: The applicant has submitted the following responses to the,four requirements for a variance set forth in section 17.66.090 B items 1 through 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan for the following reasons: we will still be 4 feet from property line and 20 feet remains to adjacent building and. would not impede normal use of righ -of -way. Staff finds the applicants response to item 2 is incomplete, as he has not fully answered the questions as required by the zoning ordinance. We also found the seperation between buildings will still be adaquate as the building adjacent to this site is located well back from the property line. RECOMENDATION: Staff finds the commission has several options available in deciding this request. 1. You can grant the request as submitted. 2. You can grant the request subject to any conditions you may find necessary. 3. You can deny the request. 4. You can postpone action if you find additional information is necessary.
