Vacation Request - Dennis Cessna, Block 51, Lots 16, 17, 18, read by the Borough Clerk .noting that this was being requested in order to sell a single family dwelling located on two of the lots. This vacation and replat will establish lots 16A & 18A. Mr. Holt moved for approval of the vacation and replat of Lots 16, 17, 18, Block 51, East Addition, seconded by Mr. Edris. The regular meeting recessed and the public hearing was opened. There being no comments from the audience, the public hearing was closed and the regular meeting reconvened. The question was called for and motion passed by unanimous roll call vote. C. Vacation Request and Replat of Lots-33 and 34, Airpark Subdivision, Block 1 - read by the Borough Clerk and preliminary map studied. Mr. Wheeler moved for approval of the vacation and replat request on Lots 33 and 34, Airpark Subdivision, seconded by Mr. Holt. The regular meeting recessed and public hearing opened. One individual in the audience was interested in the lot next to those being replatte and questioned if that lot was to be subdivided. It was noted that this was not the case. There being no other questions or comments, the public hearing was closed and the regular meeting reconvened. It was noted that the replat does meet the zoning requirements for lot area. The question was called for and the motion passed by unanimous roll call vote. D. Variance Set-Back Request, Block 55, Lot 4, William Russell, an additional letter submitted by Mr. Russell was read by the Borough Clerk setting forth various points. The points noted that the exceptional physical conditions make it necessary to request variance as the site is on a steep slope; the amount of fill necessary would make it very expensive and unsightly,; there would be no damage to the area with the granting of the request, however, if not granted it would mean the cutting of several trees which are desirable for the whole neighborhood. The Borough Clerk noted that one comment had been received from Mr. Eggemeyer, owner of the next lot, who voiced the opinion that the variance should not be granted. Mr. Holt 65V6MV ,approvezthe-Variance Setback; seconded-10Y-Mr.-Edris. The regular meeting was recessed and the public hearing opened.- Mrs: -Russell was in the audience and noted that for the information of the commission Mr. Russell had taken a can of spray paint and drawn out the location of the proposed garage. She further rated that they hoped to extend the deck from the house and attach to the garage and therefore the garage would not be out at too much of an apgle. The garage will have the same design as the house and will have the same siding and color so that it will be correlated. Roy Ecklund was in the audience and did state that the slope was about 2-1 ratio lv Any other fill would result in the loss of the trees on the slope. The garage will be 'folibilfedt:from the property line, the house now sits ten feet from the property line; there4isAlzkrty-three feet from the lot line to the end of the pavement. There is room for turning radius from pavement to the garage door. The public heating was closed and the regular meeting reconvened. The question was called for and roll call vote as fdllows: Mr. Wheeler -YES; Mr. Edris NO; Mr. Holt -YES; Mr. Welch - YES. Motion'passed. ZONING I A. Letter Rezoning Request- Lot 12, Block 54, East Addition. It was noted that this is in the same area that a proposed zoning change is being considered. The lett for rezoning was read, stating that there is no demand for a house of this size in Kodiak and that in order for an individual to purchase it would be necessary for a rental to be placed in the basement. The minutes of the Borough,Assembly'spublic hearing on the razongg of the blocks in east addition/wenevuggested that this be tabled until the Commission had had a chance to have a work session on the propose rezoning. Mrs. Lechner was in the audience and asked if representatives, of the area could attend the work session, the Commission indicated that this would be welcomed. It was further suggested that those individuals that desired such changes in the zoning should also attend in order that both sides could be heard. The work session was set for Wednesday, June 30th, at 7:30 P.M. It was requested that the number of R-2 lots with City Water available as compared with R-1 lots (both vacant) be obtained for the information of the Commission. Mrs. Lechner asked about the requirement for two family dwelling, lot size. The Clerk noted that it would required 7200 square feet to build a two family dwelling. Some of the lots in East Addition are smaller and would have grandfather rights for building of single family dwelling. The Commission members were in agreement that a letter should be directed to Shelley Graybill, representative of Mr. Moore, stating that the rezoning of the entire area was under consideration and results would be forwarded. The amount of fill necessary to conform to the provisions of this sub-chapter would make it very expensive and unsightly. 3. The granting of this variance would not result in any damage or deterioration of the area. On the contrary I feel it would enhance it as the spruce trees which are here are desirable for the whole neighborhood and will have to be removed if the variance is not granted. 4. I can see no way that the granting of the variance will ate& be contrary to the objectives of the Comprehensive Plan. The house is now ten feet from the right-of-way and if I had to conform to the regulations the garage would have to be farther from the road than the house. Respectfully yours,. Public hearing on Vacation Request of Fred Brechan and Louis Iani - vacation of portion of Erskine Avenue between Block 1 and 2, Erskine Subdivision (case. 241-A). The letter requesting the said vacation was read in full. Mr. Constanc, moved that the regular meeting he closed and a public hearing be opened on the' vacation request, seconded by Mr.' Edris, No objections were voiced the Chairman so ordered. Thee were two people in the audience that wished to . ask questions concerning this vacation. One individual lived on uppper Erskine and was questioning the type of structure that would be placed there and whether or not this would be a two-stoty building. It was noted that the plans for the building have not as yet been received; this is taken care of by the City, however the 'building will conform to the present building code and could not be more than 35 feet high. The other individual lived below Erskine Avenue and was concerned with the amount of fill that would be placed above their property and further questioned the problem of drainage. The problem of draina9 will be taken care of at the time of a final plat which will show all the utility easements and it was noted that the drainage cannot by law be allowed; to spill over onto another 's property. The Commission noted that the question before them at this time was for the vacation of the lower avenue and that the final plat will show all the necessary water and sewer easements as required by the City. The public hearing was closed and the regular meeting reconvened. Holt moved for approval of the vacation of that portion of lower Erskine Avenue, seconded by Mr. Constance. Motion passed. by unanimous roll call vote. VII ZONING ITEMS A. Vacation Request - Block 47 East Addn., Wright and Arndt. A resume was given on the background of this case, apparently several years . ago this had been approved but was never recotded. The block is carried on the Borough Zoning map with the proposed revision which gives each lot the required 7200 square feet as required for fl-1 zoning. The Borough. Attorney has not given an opinion as to whether or not this must be reviewed again at a public hearing. Mk. Holt moved for approval of the preliminary plat and for a public hearing if determine: necessary, seconded by Mt. Constance. Passed by unanimous roll call vote B. Vacation Request - Dennis Cessna, Block 51, Lots 16, 17, 18 to be Lots 16A and 18A - The letter was read requesting said vacation in order to sell a single family dwelling now occupying portions of two of the lots. The request has been seen . by the Borough Attorney, City Manager and Kodiak Electric Associations and no objections were voiced. The City recommended approllal of the request. Mt. Letter stating the request was read in full, The area is zoned business/commercial and the subdivision of the lots will still leave each lot, with an area of 20,000 square feet with the exception of one lot that will be about 19,000 square feet. Mr. Constance moved for a public hearing to be held at the next regular P&Z meeting, Seconded by Mr. Holt. Motion passed by unanimous roll call vote. Variance Set-Back Request - Block 55, Lot 4 - William Russell (Case 244-A) A letter was read from Ir. Russell stating that due to the physical features building. Ur. Russell asked that a variance be give to allow him to build of the lot it would require a large amount of money-to develop that area for n il closer to the road-right-of-way. The request had been submitted to the lawyer and he had several points in question, concerning the side yard and the next regular meeting, seconded by Mr. Constance.
