This letter is to respond to the zoning compliance issues with this property. As a threshold matter, I believe it is first important to note that the long standing use of this property has been a single- family residence. Multiple land use and building permits over the past 3 decades reflect this established use. The zoning of the property is R1 Single Family Residential, KIBC 17.15.020 requires that uses of land and buildings must be in conformity with the zoning district in which the building or land is located: 17.15.020 Conformity with regulations required. No building, part of a building, or any land shall be used, . occupied, erected, moved, or altered unless in conformity with the provisions of this title for the district in which the building or land is located. (Ord. 81- 54-0 §1, 1981; prior code Ch. 5 subch. 2 §1A. Formerly §17.03.020j. KIBC 17.15.060 requires that zoning compliance is required for conversion of any building or structure in any district and that an application for zoning compliance must be filed with the community development department: 17.15.060 Zoning compliance. Zoning compliance is required for site grading (excavation and fill), erection, construction, establishment, moving, alteration, enlargement, repair, or conversion of any building or structure in any district established by this title, subject to the following: A. An application for zoning compliance will be filed with the community development department on a form provided by the department. If the application meets the requirements of this title, as verified in the department, and other applicable regulations, a permit will be issued. An as -bulb of the property may be required to ensure that applicable requirements can be met, when existing structures are located on the property. Any zoning compliance permit issued is subject to the some expiration, suspension, and revocation provisions as a building permit issued for the same construction project (See Uniform Building Code Section 303(d) and (e), as currently adopted under K!BC 15.05.020). Accordingly, any change of use from a single - family residence to another use requires zoning compliance. When reviewing a zoning compliance submittal, the first step is to identify (define) the intended land use, using the definitions in Title 17- Zoning, common usage, or by technical words and phrases which have acquired a particular or appropriate meaning. Once the use is defined, we then look to the lists of permitted or conditional uses to determine if the proposed use is permitted, conditionally permitted, or prohibited. To date, the current owners of 1720 East Rezanof Drive have not submitted an application for zoning compliance for any change of land use. Until zoning compliance is obtained, any use of this property for other than a °single- family residence constitutes an unlawful use of land and structure. Your letter also states that the property is being used for "religious purposes" or "religious activities," and that such activities are a permitted use in the R -1 district. Permitted and conditional land uses in the R -1 zoning district are set forth at KIBC 17.75.020 through 17.75.030. "Religious uses" are not listed as a permitted or conditionally permitted land use in the R -1 zoning district: 17.75.020 Permitted uses. The following land uses and activities are permitted in the single-family residential district: A. Accessory buildings; B. Churches; C. Greenhouses; D. Home occupations; E. Parks and playgrounds; F. Single-family dwellings; and G. Hoop houses. (Ord. FY2012 -10 §9, 2012; Ord. 86 -27 -0 §6, 1986; Ord. 83 -17 -0 §2, 1983. Formerly §17.18.020). 17.75.030 Conditional uses. The following land uses may be allowed by obtaining a conditional use permit in accordance with the provisions of Chapter 17.200.K!BC: A. Hospitals; 8. Schools; C. Bed and breakfasts; and D. Vacation homes. (Ord. FY2007 -08 -0 §9, 2006; Ord. 86 -27 -0 §7, 1986; Ord. 83-17-0 §2, 1983. Formerly §17.18.030). KIBC 17.15.080 states that land uses not listed as a permitted use are prohibited: 17.15.080 Uses prohibited unless authorized. Land use not listed as a permitted use in a district are prohibited: (Ord. 81 -54 -0 §1, 1981. Formerly §17.03. 080). Since a "religious use" is not listed as a permitted or conditionally permitted land use in R -1 zoning, this use is prohibited. Options for Moving Forward For your information, Borough staff met with representatives from St. Innocents Academy on at least 3 separate occasions regarding the zoning issues noted above. During each meeting, staff explained the need for zoning compliance to change the use from a single- family residence to different land use. Part of each conversation focused on the scope of programs and activities for the new and intended use of the property. And during each conversation, we spoke about how the Intended use(s) would be defined under Title 17 for purposes of zoning compliance. Several options were discussed and the permitting requirements for each option were discussed at some length. The options discussed included a school, a church, an office, and a home occupation. We also discussed the process for a Similar Use Determination. Each option is discussed later in this letter. Once the proposed use is defined, the list of permitted and conditional uses In the R -1 district determines the type of land use permit required and the process for obtaining that permit. Definitions Definitions for Tile 17, Zoning, are found in Chapter 17.25 KIBC. The terms "church ", "school ", "office ", or "religious use" are not listed in :these definitions. "Home occupations" are defined at KIBC 17.25.090. When a land use is not deflned in borough code, the Community Development Department uses The New illustrated Handbook of Development Definitions for technical words and phrases. This reference includes the following definitions: Office —A room or group of rooms used for conducting the affairs of a business, profession, service, industry, or government and generally furnished with desks, tables, files, and communication equipment. Religious Use —A structure or place in w hich worship, ceremonies, rituals, and education pertaining to a particular system of beliefs are held. School —Any building or part thereof which is designed, constructed, or used for education or instruction in any branch of knowledge. School, Parochial — A school supported and controlled by a church or religious organization Which Definition Applies? School During the first meeting with the Borough Assessor, your clients stated the use of the property would be a school. Based on that meeting, subsequent discussions with St. Innocents' representatives, and the floor plan later submitted to Assessing, It appears to staff that the proposed use is best defined as a school. Schools are listed as conditional use in R -1 zoning. Establishing a school requires a Conditional Use Permit approved by the Planning and Zoning Commission (see Chapter 17.200 KIBC), zoning compliance following conditional use approval, and a building permit for the change of use and occupancy. Church Churches are listed as permitted use in R -1 zoning. The proposed use may also be defined as a church. Establishing a church requires zoning compliance to be approved by the Community Development Department and a building permit for the change of use and occupancy. Office Offices are not listed as a permitted use in R -1 zoning and are, therefore, prohibited. Home Occupation Home Occupations are listed as permitted use in R -1 zoning. KIBC 17.25.090H: 17.25.090 N definitions. "Home occupation" means a business, profession, occupation, or trade located entirely within o residential building, or an accessory structure which use is accessory, incidental and secondary to the use of the residential building far dwelling purposes and does not change the essential residential character or appearance of such building or neighborhood. A home occupation may be conducted in a dwelling unit provided that: A. OnIy one nonresident, at a time, and the residont(s) ofo dwelling unit may be engaged in the home accupnbonon the premises. 8ifononresident is engaged in the home occupation on the premises, an additional off-street parking space shall be provided. The home occupatlon shall occupy no more than 25 percent of the dwelling'sfloor floor area Including storage of wholesale or retail stock-in-trade (excluding the basement and garage from this cakulcrtion). 0. There shall be no change in the outside of the building orpremises nor shal! there be other visib!e evidence of the conduct of such home occupat!on on the property other than one sign not exceeding six square feet hn area and nonNbm/notesi E. Vehkles making deliveries shall not be parked on the site for a period exceeding two hours and only between the hours of 8 a.m. and 8 p.m. F. No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, or odors detectable to the normol senses off the lot. No equipment or proces shall be used which creates visual or audible Interference in any radio or television receivers off the premises or causes a fluctuotian in line voltage off the premises. No equipment, product shall be al!owed in such home occupation which presents a clear safety hazard (e.g., fire, health) to the structure or the neighborhood. Establishing a home occupation requires zoning compliance to be approved by the Community Development Department. Based on the discussions noted above, it did not appear that the intended use of the property qualified as a home occupation. Similar Use Determination KIBC 17.15.080 provides tha uses other than those specifically listed as permitted or conditional may be allowed if the use is similar in character and impact to a permitted use. A similar use determinatiori requires a public hearing before the Planning and Zoning Commission. If a similar use is approved, then zoning compliance and any necessary buliding permits follow. Next Steps At this point, the bali is clearly in your client's court to establish a legal land use. To obtain zoning compliance or a similar use determination for any of the permitted or conditional use options listed above, St. Innocents will need to submit an application to the Community Development Department. Specifically, the existing and continued use of this property is.for non-profit religious purposes, which is an allowable use under the existing R-1 zoning and a mandatory exemption from property tax under AS 29.45.030(a)(3). St. Innocent of Alaska Orthodox Mission is a reli ious organization with a limited mission. It is not a school, although some youth associated with St. Innocent's are home-schooled. St. Innocent purchased this property to further their retigious mission. These religious activities are the intended use for the property. KIB Code Section 17.75.020 provides that religious activities are a permitted use in the R-1 district.
