It has been brought to this Department's attention that the residence at 1716
Rezanof Dr. (Lot 9, Block 55, East Addition) has been advertised under new
listings (Kodiak Daily Mirror, October 4, 1991) as containing a mother -in -law
apartment.
Since this property is zoned R1- Single - family Residential, the use of an
apartment, however small, within the residence as a separate dwelling unit is
a violation of the Kodiak Island Borough Zoning Ordinance. Zoning
compliance and a building permit ( #4540) were issued in 1978 for a single -
family residence, and the certificate of occupancy was issued for this same
use. There is nothing in building, zoning, or assessing files to indicate a
permitted change in this use. Nor is there documentation which might
establish a legitimate nonconforming use.
You are advised of this as a courtesy to safeguard against the
misrepresentation to potential buyers of the property, and its value, based on
a non - permitted use.
