Borough Assembly within ten (10) days. The CHAIRMAN called a ten -
minute recess. The Regular Meeting was recessed and reconvened.
COMMISSIONER CROWE MOVED TO ADOPT AS FINDINGS AND FACT AND REASONS
FOR DENIAL:
1. that the intent of the Chapter on Agricultural Buildings was
to require a main dwelling be used as a residence prior to
construction of an agricultural building, due to the lack of
supervision and to protect the surrounding neighbors; and
2. that the primary use of a Rural Residential District is
residential.

The motion was seconded and CARRIED by unanimous voice vote.
H) CASE 84 -049. Request for a variance from Section 17.19.030B
Lot Width) to permit the creation of a lot that does not meet
the required minimum lot width on Lot 11C, Block 8, Leite Addi-
tion, U.S. Survey 1681; 1532 Kouskov (Robert Simpler).
MS. FREED reported one additional public hearing notice received.
As there was,no further staff report, the CHAIRMAN recessed the
Regular Meeting and opened the Public Hearing.
MR. ROBERT SIMPLER was present to answer questions from the
Commission regarding the intent of subdivision within two years.
As there were no further audience comments, the CHAIRMAN closed the
Public Hearing and reconvened the Regular Meeting.
COMMISSIONER HILL MOVED ON CASE 84 -049 TO GRANT THE REQUEST FOR A
VARIANCE from Section 17.19.030B to permit the creation of a lot that
does•not meet the required lot width on Lot 11C, Block 8, Leite Addition,
U.S. Survey 1681; 1532 Kouskov, with the following conditions:
1. that the newly created lots would be replatted into
one single lot within two years; and
2. that a note be placed on the plat stipulating that
no structure will be constructed on the newly- created
Lot 11C -1.
The question was called. The motion CARRIED by roll call vote
with Commissioner Rennell voting "no."

RE: CASE 84-050. Request for a variance from Section 17.18.050C (Rear
Yards) to permit a home addition that will encroach into the required
rear yard setback on Lot 10, Block 55, East Addition; 1714 Rezanof
(David J. King).
Eighteen (18) public hearing notices were mailed on May 7, 1984.
1. Applicant: David J. King, Box 594, Kodiak, AK 99615.
2. Land Owner: Same as applicant.
3. Request: Request for a variance from Section 17.18.050C (Rear Yards)
to permit a home addition that will encroach into the required rear
yard setback.
4. Purpose: Addition to a single-family residence.
5. Existing Zoning: Single-family Residential District (R1).
6. Zoning History: The 1968 Comprehensive Plan identifies the zoning
on the lots in this area as Rl. Departmental files show no additional
action.
7. Location: Lot 10, Block 55, East Addition; 1714 Rezanof Drive.
8. Lot Size: 6,240 square feet.
9. Existing Land Use: Single-Family Residential (R1).
10. Surrounding Land Use and Zoning:
North: Rezanof Drive;
South: Potatopatch Lake;
East: Lot 9, Block 55, East Addition is zoned R1 and has an R1 use;
West: Lot 11, Block 55, East Addition is zoned R1 and has an R1 use.
11. Comprehensive Plan: The Comprehensive Plan designates these lots
as medium-density residential.
12. Applicable Regulations: Chapter 17.18 (Single-Family Residential
District), Section 17.18.050C (Rear Yards) states the required rear
yard setback shall be twenty-five percent of the lot's depth.
COMMENTS:
The applicant proposes to add on to his existing nonconforming single-
family home. By granting this variance, the addition would encroach into
the required rear yard the same distance that the existing home presently
does--eight feet. A bay window would extend beyond the building an additional
three feet.
The home is adjacent to Potatopatch Lake on Rezanof Drive and the
addition would be built to overlook this municipal reservoir. No neighboring
lots will be impacted.
RECOMMENDATION:
The Community Development Department recommends approval of the variance
since it is believed that it meets the required conditions for granting a
variance, as stated in Section 17.66.050A of the Borough Code.
