A change of zoning from B--Business to LI--Light Industrial, is generally consistent with the Kodiak Island Borough Comprehensive Plan. The change would make the area more conforming to the plan but, based on public testimony, would do little to meet the needs of the land owners in the area. A shift of land use from business to industrial would likely result in businesses located next to incompatible industrial uses. Displacement of business and service uses at this location would deprive the harbor area of convenient supplies and services presently enjoyed by the fishing and boating industries. Date of site visit: No Site Visit Made BACKGROUND A conditional use permit was granted by the Planning and Zoning Commission on March 15, 1989, to permit the construction of a 42,000 gallon petroleum storage tank and three (3) 8,000 gallon petroleum storage tanks. The conditions of approval for this CUP are indicated on the attached action letter that was sent to the applicant. The original approval was very specific regarding the dimensions and volumes of the proposed tanks. Since the original approval was made after a public hearing, staff believes that it is appropriate that any change in the approval be made by the Commission after a public hearing. Case 89-013 Page 1 of 2 P & Z: February 17, 1993 Public Hearing Item VI-I The purpose of the request is to increase the size of the three (3) petroleum tanks (which have not yet been constructed) from 8,000 gallons to 10,000 gallons. Staff does not believe that this is a significant change as long as all applicable fire and building codes are met. RECOMMENDATION Staff recommends that the Commission approve an amendment to the original CUP in order to permit three (3) 10,000 gallon petroleum storage tanks rather than the original 8,000 gallon petroleum storage tanks. APPROPRIATE MOTION Should the Commission agree with the staff recommendation, the appropriate motion is: Move to amend Conditional Use Permit 89-013 granted March 15, 1989, to permit the construction of three (3) 10,000 gallon petroleum storage tanks rather than the originally permitted 8,000 gallon petroleum storage tanks. We wish to install 3 tanks with a total capacity of 30,000 gallons rather than the approved 24,000 gallons, an increase of 6,000 gallons. In 1989 we were granted 2 conditional use permits for installing tanks at our facility as follows: 1) Install a petroleum storage tank with a maximum capacity of 42,000 gallons. 2) Install 3 additional petroleum storage tanks with a maximum capacity of 8,000 gallons each. In 1989 we used the first conditional use permit to install a 34,000 gallon tank. We now want to use the second conditional use permit to install bulk lube oil tanks. We have discovered that because of shipping container sizes, and more efficient operation due to turn around times on shipping product, the slightly larger storage makes this project financially feasible. We would like to install three 10,000 gallon tanks. We will appreciate a favorable response to our request since the total capacity installed does not exceed the original total capacity approved. That is the 2 permits approved a total installed capacity of 66,000 gallons and our total installed capacity will only be 64,000 gallons. For Lot 1, Block 20, Kodiak Townsite; and B. For City Tidelands Tract 1. 1. That the conditional use will preserve the value, spirit, character, and integrity of the surrounding area. A. It appears that the proposed use will not detract from the value, spirit, character and integrity of the surrounding area. The surrounding area is devoted to industrial land uses, including a warehouse, a seafood processing plant and dormitory, an existing bulk petroleum plant, and fuel dock. The bulk fuel storage facility or "tank farm" is a long established land use at this location and departmental files do not indicate that the facility has been detrimental to the surrounding area. The addition of another tank will not result in a change of land use and is a relatively minor increase in land use intensity. Seven (7) storage tanks are currently located on the site. B. It appears that the proposed use will not detract from the value, spirit, character and integrity of the surrounding area. The surrounding area is devoted to industrial land uses, including a warehouse, a seafood processing plant, and a petroleum "tank farm ". The bulk petroleum plant, offices and fuel dock are long established land uses at this location. Departmental files do not indicate that the facility has been detrimental to the surrounding area. The location of three (3) 8,000 gallon tanks to store bulk lubricants will not result in a change of land use. In addition, the applicant has indicated that the intent of the bulk storage tanks is to replace up to 60% of the current storage need which is being met through the outdoor storage of lubricants in 55 gallon drums on the site. Therefore, this request should only result in a small increase in land use intensity. 2. That the conditional use fulfills the other requirements of this chapter pertaining to the conditional use in question. A. The proposed use will be required to fulfill all other requirements of the Industrial Zoning District, the Uniform Building Code and the Uniform Fire Code. The proposed location of the tanks meets or exceeds all required setbacks and height limits in the I-- Industrial Zoning District. It also appears that the proposed use will comply with the applicable performance standards for industrial land uses. Full compliance with the Uniform Kodiak-is and Borough Jim Ramaglia Kodiak Oil Sales, Inc. March 16, 1989 Page Three Building and Fire Code provisions will be assured through the building permit process but should be identified as a condition of approval for the conditional use permit. B. Same as A, above. 3. That wanting the conditional use permit will not be harmful to the public health, safety, convenience, and comfort. A. The proposed use should not be harmful to the public's health, safety, convenience or comfort. As previously discussed (please see the findings for condition number 2), the existing facility has not been shown to be detrimental or harmful to public health or safety. The land use will not be changed as a result of the request. Therefore the addition of another tank, when there are seven (7) on the property already, does not represent a significant increase (2.5%) in the intensity of land use or amount of products stored on the property. It could be argued that an additional tank will increase the potential for harm in the case of a catastrophic event. Staff feels that this is a low probability. Even if something happened, the additional tank will only make up a small portion of the total petroleum storage. It should also be noted that most of the existing tank farm predates the 1964 tsunami. B. The proposed use should not be harmful to the public's health, safety, convenience or comfort. As previously discussed (please see the findings for condition number 2), the existing facility has not been shown to be detrimental or harmful to public health or safety. The land use will not be changed by the location of three (3) 8,000 gallon petroleum storage tanks on the site when there are numerous 55 gallon drums of lubricants currently stored outdoors on the property. In addition, this request does not represent a significant increase in the intensity of land use or amount of products stored on the property. 4. That sufficient setbacks, lot area, buffers, or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. A. There is sufficient lot area for the proposed tank(s). The proposed location exceeds the setbacks of the I--Industrial Zoning District and adherence to fire code separation requirements will be assured prior to issuance of a building permit. Comprehensive Plan: 10. Applicable Regulations: The 1968 Comprehensive Plan identifies this area as Light Industrial. The following sections of Title 17 (Zoning) of the Borough Code and Kodiak Island Borough Coastal Management Program are applicable to this request: 17.24.020 Conditional uses. The following uses may be permitted by obtaining a conditional use permit from the planning and zoning commission after proper notice and public hearing: A. Acetylene gas manufacture or storage; B. Ammonia, bleaching power or chlorine manufacture; C. Cement, concrete, line and plaster manufacture; D. Chemical bulk storage and sales; E. Garbage disposal sites, dumps and sanitary landfills; and F. Petroleum or flammable liquid production, refining or storage. Case 89 -013 Page 2 of 7 P &Z: March 15, 1989 ITEM VI -B COASTAL MANAGEMENT APPLICABLE POLICIES ' Industrial Development 1. Optimum Location. In order to satisfy industrial requirements, meet safety standards, protect fish and wildlife resources, and maintain environmental quality, sites for industrial development shall be identified in conjunction with the Kodiak Island Borough. Consistent: Yes. These locations are zoned Industrial and identified for industrial land uses in the Kodiak Island Borough comprehensive plan. 2. Natural Features. Dredge and fill, excavation, shoreline alteration, and disturbance of anadromous streams, tideflats and wetlands shall be minimized when constructing and operating port, harbor, dock, industrial and energy facilities - if permitted under applicable regulations. Consistent: Not Applicable. These actions do not involve alteration of wetlands, tideflats, or anadromous waters. 3. Natural Setting, Views and Access. Development shall be conducted in a manner that mitigates adverse impacts upon the Kodiak Archipelago; developers shall provide opportunities for public access to the shoreline and scenic views, to the extent feasible and prudent. Consistent: Yes. These actions will take place in a long standing . industrial area. It is not prudent to provide public access through these industrial areas due to the nature of the use (bulk fuel storage). 4. Dredge and Excavation Material. Dredging and filling shall be consistent with ACMP Standards 6 AAC 80.040 (Coastal Development) and 6 AAC 80.110 (Mineral and Mining Processing). Dredge spoil may be utilized in shoreside landfills if permitted under applicable regulations for the purpose of creating usable waterfront land. Consistent: Not Applicable. Dredging and filling activities are not a part of these requests. 5. Facility Design. Developments in or over the water, such as piers, docks, and protective structures shall be located, designed and maintained in a manner that prevents adverse impacts upon water quality, fish, wildlife and vegetative resources, and minimizes interruption of water circulation patterns, coastal processes and navigation. Case 89 -013 Consistent: Not Applicable. These projects do not include development in or over the water. Page 3 of 7 P &Z: March 15, 1989 ITEM VI -B .. Buffer Zones. Buffer zones shall be established to the extent feasible and prudent, between industrial areas and major public transportation routes and between industrial development and adjacent, non - industrial properties in order to minimize conflicts between land uses. Consistent: Yes, to the extent prudent and feasible. The bulk fuel facility is long established at this location without the specific provision of a buffer along Rezanof Drive West. It is not prudent to require provision of a buffer zone at this time. There have been no reports of conflict between this land use and the Rezanof Drive transportation route. 7. Accessory Development. Accessory development that does not require a shoreline location in order to carry out its support functions shall be sited away from the shoreline whenever there is a feasible and prudent inland alternative. This category includes parking, warehousing, open air storage, waste storage, treatment or storm runoff control facilities and utilities. Consistent: Yes. These requests are primary to this industrial operation which is generally located along the waterfront in order to serve both the fishing fleet and inland users. The storage capacity proposed for City Tidelands Tract 1, will probably reduce the need for drum storage which in now located on the fuel dock. Wetlands.. Filling and drainage of water bodies, floodways, backshores or natural wetlands shall be consistent with ACMP Standards 6 AAC 80.070 (Energy Facilities) and . 6 AAC 80.130 (Habitats). Consistent: Not Applicable. These projects do not include dredging and filling activities. COMMENTS:, The purpose of the first. request is to permit the storage of an additional 42,000 gallons of petroleum or flammable liquids on the site. ,The product (most likely #1 diesel fuel) will be stored in one tank as shown on the attached site plan; The existing tank farm consists of seven (7) tanks with a. total capacity of 1,688,000 gallons. The second request is to permit the location of three (3) petroleum storage tanks, each with a maximum . capacity of 8,000 gallons, in an. I-- Industrial Zoning District on City Tidelands Tract 1. The applicant has indicated that these tanks, would be used for the storage of bulk lubricants (motor oils and hydraulic oil). While the flammability of such lubricants is not of great concern, storage of any petroleum product in the i-- Industrial Zoning District requires a conditional use permit. The balance of this staff report will separately address each request for a conditional use permit. A: Lot 1, Block 20, Kodiak Townsite; and B: City Tidelands Tract 1 Page 4 of 7 P &Z: March 15, 1 88 ITEM VI-El FINDINGS OF FACT In order to grant a conditional use permit, the Commission must make the following findings: 1. That the conditional use will preserve the value, spirit, character, and integrity of the surrounding area. A. It appears that the proposed use will not detract from the value, spirit, character and integrity of the surrounding area. The surrounding area is devoted to industrial land uses, including a warehouse, a seafood processing plant and dormitory, an existing bulk petroleum plant, and fuel dock. The bulk fuel storage facility or "tank farm" is a long established land use at this location and departmental files do not indicate that the facility has been detrimental to the surrounding area. The addition of another tank will not result in a change of land use and is a relatively minor increase in land use intensity. Seven (7) storage tanks are currently located on the site. B. It appears that the proposed use will not detract from the value, spirit, character and integrity of the surrounding area. The surrounding area is devoted to industrial land uses, including a warehouse, a seafood processing plant, and a petroleum "tank farm". The bulk petroleum plant, offices and fuel dock are long established land uses at this location. Departmental files do not indicate that the facility has been detrimental to the surrounding area. The location of three (3) 8,000 gallon tanks to store bulk lubricants will not result in a change of land use. In addition, the applicant has indicated that the intent of the bulk storage tanks is to replace up to 60% of the current storage need which is being met through the outdoor storage of lubricants in 55 gallon drums on the site. Therefore, this request should only result in a small increase in land use intensity. 2. That the conditional use fulfills the other requirements of this chapter pertaining to the conditional use in question. A. The proposed use will be required to fulfill all other requirements of the Industrial Zoning District, the Uniform Building Code and the Uniform Fire Code. The proposed location of the tanks meets or exceeds all required setbacks and height limits in the I--Industrial Zoning District. It also appears that the proposed use will comply with the applicable performance standards for industrial land uses. Full compliance with the Uniform Building and Fire Code provisions will be assured through the building permit process but should be identified as a condition of approval for the conditional use permit. B. Same as A, above. That grantina the conditional use permit will not be harmful to the public health, safety, convenience, and comfort. A. The proposed use should not be harmful to the public's health, safety, convenience or comfort. As previously discussed (please see the findings for condition number 2), the existing facility has not been shown to be detrimental or harmful to public health or safety. The land use will not be changed as a result of the request. Therefore the addition of another tank, when there are seven (7) on the property already, does not represent a significant increase (2.5%) in the intensity of land use or amount of products stored on the property. It could be argued that an additional tank will increase the potential for harm in the case of a catastrophic event. Staff feels that this is a low probability. Even if Case 89-013 Page 5 of 7 P&Z: March 15, 1989 something happened, the additional tank will only make up a small portion of the total petroleum storage. It should also be noted that most of the existing tank farm predates the 1964 tsunami. B. The proposed use should not be harmful to the public's health, safety, convenience or comfort. As previously discussed (please see the findings for condition number 2), the existing facility has not been shown to be detrimental or harmful to public health or safety. The land use will not be changed by the location of three (3) 8,000 gallon petroleum storage tanks on the site when there are numerous 55 gallon drums of lubricants currently stored outdoors on the property. In addition, this request does not represent a significant increase in the intensity of land use or amount of products stored on the property. 4. That sufficient setbacks, lot area, buffers, or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. A. There is sufficient lot area for the proposed tank(s). The proposed location exceeds the setbacks of the I-- Industrial Zoning District and adherence to fire code separation requirements will be assured prior to issuance of a building permit. Compliance with these requirements should ensure adequate separation from other structures in the area. In addition, the property is fenced for security purposes. B. Same as A, above. RECOMMENDATIONS: Staff finds that these requests do meet the standards for a conditional use permit and recommends that the Commission grant these requests. Lot 1, Block 20, Kodiak Townsite Move to grant a conditional use permit in accordance with Section 17.24.020F of the Borough Code to permit an additional petroleum storage tank with a maximum capacity of 42,000 gallons to locate in an I-- Industrial Zoning District on Lot 1, Block 20, Kodiak Townsite; subject to the two (2) conditions of approval outlined in the staff report dated March 2, 1989, and to adopt the findings "A" contained in the staff report dated March 2, 1989, as "Findings of Fact" for this case. Compliance with all provisions of the Uniform Building Code and Uniform Fire Code shall be demonstrated prior to issuance of zoning compliance or a building permit. B. City Tidelands Tract 1 Move to grant a conditional use permit in accordance with Section 17.24.020F (Conditional Uses) of the Borough Code to permit three (3) additional petroleum storage tanks each with a maximum capacity of 8,000 gallons to locate in an I -- Industrial Zoning District on City Tidelands Tract 1; subject to the two (2) conditions of approval outlined in the staff report dated March 2, 1989, and to adopt findings "B" contained in the staff report dated March 2, 1989 as "Findings of Fact" for this case.
