Box 417 Kodiak, AK 99615 710 MILL BAY ROAD KODIAK, ALASKA 99615 -6340 PHONE (907) 486 -5736 November 27, 1991 CGS 4144 ritynad R.I0 • Re: Lot 3B, Crestview Subdivision (3233 Viewcrest) Outdoor Storage of Construction Equipment and Materials Mr. Wheeler and Mr. Kiefer: The purpose of this letter is to notify you that the outdoor storage of construction equipment and building materials on the residential property referenced above and owned by you is a violation of the Kodiak Island Borough zoning ordinance sections 17.19.010 and .020 addressing the description and intent and permitted uses in the R2 Two - Family Residential zoning district. A complaint has been received that the property is beginning to take on the appearance of a construction yard. A site visit revealed two pieces of heavy equipment (a backhoe and a forklift) stored on the property, as well as lumber and building materials. In addition, the complainant claims that the mobile home on the property has been used as a construction "bunkhouse" housing, at times, in excess of fifteen persons. You should be aware that Borough Code Section 17.06.220 limits a dwelling unit to no more than five (5) unrelated individuals at any one time; a maximum of two of whom may be boarders. A deadline is established by administrative decision to bring your property into compliance and discontinue these non - permitted uses. This is done in the interest of following standard Kodiak Island Borough James Wheeler and Rodney Kiefer November 27, 1991 Page Two procedure, and to give you the opportunity to appeal the determination and/or the deadline should you wish. Therefore, failure to remove the outdoor storage of construction equipment and building materials from the property to an appropriate location within thirty (30) days (by December 27, 1991), and to ensure that the mobile home is occupied by no more than five unrelated persons, will require that the file be forwarded to the Borough Attorney for further enforcement action. This decision is final unless appealed to the Planning and Zoning Commission within ten (10) days of receipt of this letter. If you disagree with the determination, or wish to propose some other remedy or compliance schedule, it is essential that you appeal this decision within ten (10) days. An appeal is commenced by filing with this office a written notice of appeal, specifically stating the reasons for the appeal and the relief sought. An appeal under Section 17.68.020.B of the Borough Code may be brought by a person affected by the issuance of an order or administrative decision issued under Section 17.75.010 A of the Borough Code. Failure to comply with the terms of this decision or to appeal the decision subjects you to the penalties of Section 17.75.030 of the Borough Code, which states in part: "A person who violates any provision of this Title, or order issued under 17.75.010.A...is guilty of a misdemeanor and upon conviction is punishable by a fine of not more that three hundred dollars ($300). Each act or condition violating this title, and order issued under 17.75.010.A.. and each day during which the act or condition exists...shall be a separate and distinct violation."
