The map clearly shows the property in question to be that of the City of Kodiak. It is my belief that the use of this Public area should be returned to the people of Kodiak for use as intended, such as much needed parking for the area. Above all the City of Kodiak should reclaim the property according to the Zoning Compliance Regulations, charge the Kalcic's for their use and the City should be reimbursed for any and all income generated by the illegal use of the City of Kodiak Property. It appears that the space was to be used for additional parking spaces. Of more concern to this office is the size of the building and distance from the property lines. We have a Code analysis of the•existing buildings not including the barge as it was to be removed. You will need an Architectural Firm to do a new Code Analysis of the total property using the 2000 International Building Code. In addition an engineer will need to look at the metal barge and foundation for structural adequacy. I have included copies of some of the information we have. Specifically, current work includes the construction of a 1,175 s.f. canopy at the dock side of the building to cover existing fish conveyors, hoppers, and product storage tanks. The covering is necessary to satisfy DEC seafood processing requirements. In addition, a room is to be added to the south end of the recently constructed ammonia processing building. The space will accommodate electrical equipment to be relocated from the existing barge structure slated for demolition. UBC Code Analysis: The code analysis presented for the recent ammonia processing building presented it as a independent building, separated from the main facility by an imaginary property line. The maximum allowable area for this facility is 8,000 s.f. With the new 216 s.f. for the new electrical room, the actual area is still well within allowable limits, The canopy cover at the dock side is a more complicated issue. Such un- enclosed structures are typically classified lathe UBC's U -1 Occupancy Group. This group is largely unregulated in terms of property line setbacks, etc. The UBC does impose a maximum area of 1,000 s.f. for such structures, however. The proposed canopy area of 2,615 s.f. certainly exceeds the U -1 limitations — therefore the structure must be classified with the general F -2 use of the overall facility. As you can see from the following analysis, the extra area for the proposed canopy can also be added within the allowable area limits. You initially questioned whether construction of the new canopy would eliminate the second side yard identified for increase to the basic allowable area. In fact, the presence of the dock side public waterway maintains the necessary open space required to support the area increase. The attached excerpt from the current "Handbook to the Uniform Building Code" supports that interpretation. K u m i n Associates, Inc. Exterior Wall Protection: Exterior sides (walls) on three sides of the proposed structure all lie beyond the minimum setbacks required for unprotected walls and openings. The east side. however, is located within 5 -feet of the lease line, requiring a 1 -hour exterior wall to be constructed for that full length. The rated wall can be constructed of wood or metal studs, properly connected and braced to the the new steel -framed structure. Due to the expected levels of water in the area, we propose using exterior gypsum sheathing on both sides of the wall to accommodate the required rating. Since this product is typically available in 1/2" thickness only, two layers should be applied on each side. The exterior face can then be covered with typical corrugated metal siding, and the interior face should be covered with full height FRP panels. Parking: I have provided parking space calculations for the new canopy & electrical room on the attached sketch. The calculations support the need for two additional spaces. Per my recent conversation with Linda. Freed, I understand the previous parking layout resulted in one parking space beyond the minimum requirements imposed by the new ammonia building construction. If the assessment district were formed, any adjustments to individual assessments could be made when the project was completed. Under New Business, item c, the City Council would consider Resolution Number 25 -95 which would create a Special Assessment District for the construction of street improvements on Marine Way (Phase II) and Tagura Road. This public hearing allowed affected property owners and other interested parties to comment on whether the proposed improvement were necessary and would benefit the properties to be included within the assessment district. Two proposed districts were included for Council consideration. Option 1 stopped at the entrance to the boat yard. Option 2 extended the project approximately 300 feet to the proposed parking lot at Pearson Cove Park. The decision on the extent of the project would determine which properties would be assessed appropriately for the actual cost. Notice of the public hearing was mailed to all property owners of record for Option 2, the largest of the two proposed districts, on August 21, and advertised in the Kodiak Daily Mirror on September 1 and September 8. Mayor Floyd closed the regular meeting and opened the public hearing. Geneva Macinko spoke in opposition to the project on behalf of her mother, Anita Hartman, Block 34, Lot 14, East Addition, who had lived on Tagura Road for nearly forty years. She said Ms. Hartman had no income and could not afford an assessment of any amount. Tony Chatto, Block 34, Lot 13, East Addition, spoke in opposition to the extension of the project. He said paving would increase the speed of vehicles on the street and would not improve property values. The neighborhood already experienced problems with people parking at the end of the street, drinking, playing loud music, and generally creating a nuisance. Costs were a consideration, but the effect of sandwiching the neighborhood between two busy streets was a greater concern. Pat Holmes, not a property owner in the area, felt the cost of creating a parking lot for Pearson Cove Park should not be included in the assessment district. He preferred to see the road left as it was; however, if paving was necessary for health and safety, he felt it should end at the entrance to the boat yard. • Lacey Berns, Block 34, Lot 17, East Addition, spoke in opposition to the extension of the project. She felt a parking lot was not necessary for public use of the park, and the primary usage of the end portion of Marine Way was pedestrian. She felt paving beyond the boat yard driveway would provide no benefit to local residents, whose homes front on a portion of Tagura Road that is not included in the planned paving. She was concerned that the project extension would double her assessment, would benefit the community at large if anyone, and should not be paid by local residents. She also felt the largest part of any assessement in the area should be borne by the industrial/commercial enterprises, which generated the majority of traffic on the street. Chris Berns, Block 34, Lot 17, East Addition, spoke in opposition to the project. He felt that while businesses could pass on increased costs such as improvement assessments, residents would have no choice but to absorb them. He did not feel paving would be an improvement, referring to the prevalence of black ice on the paved portion of Marine Way. He said he had heard no one asking for paving. Theft from his property had recently become a problem, and he did not want the increased traffic paving would bring, which he felt would exacerbate the problem. Dolores Peterson, Block 33, Lots 3A-1, 3A-2, and 4, East Addition, opposed the project, stating she.had lived on Marine Way for many years. Terry Gunter, Block 34, Lot 15, East Addition, spoke in opposition to the exten sion of the project. He said the extension would cause exorbitant increases in the assessments to homeowners in the area without producing a proportionate benefit. Joseph Jensen, •Block 2, Lot 13, and Block 1, Lot 6, Kodiak Townsite, spoke •in opposition to the project. He felt the paving was unnecessary as the canneries along the road were doing very little business. He was concerned that vehicular speed would increase on the street. Anne Kalcic, Block 33, Lots 5, 6, 7, and 8, East Addition, spoke in opposition to the extension, and felt the remainder of the road could be built narrower. She thought her neighbor, who had lived there for 39 years, would lose her entire front yard. The assessment for the extension would be a serious financial hardship for her and her business. Johnathon Spool, representing International Seafoods of Alaska, Inc., Tract 16A, spoke in opposition to the project. He said widening the roadway would cripple many area businesses by eliminating parking areas for employees and shipping vans. He felt if the road must be paved, the current width of twenty to twenty-two feet would be ample. Marty Shuravloff, spoke on behalf of his mother, Martha Shurafloff, Block 1, Lots 2 and 3, Kodiak Townsite, in opposition to the project, saying traffic had decreased street in recent years, Shurafloff saw no reason to pave it this time. Bill Feda, manager of Fuller's Boat Yard, Tracts N25, N37, and N38, spoke in opposition to the project, citing security problems already existing with theft, drinking, and trespass. As the street was a dead end and had no regular police patrol, paving the street was expected to worsen the problem. Jeff Knauf, speaking as an individual member of the Planning and Zoning Com mission, spoke in opposition to the extension of the project, feeling the funds could better be spent to acquire access at the other end of the Pearson Cove Park. He emphasized that most users of the park walk to it. Vito Kalcic, Block 33, Lots 5, 6, 7, and 8, East Addition, spoke in opposition to the extension of the project. He felt if access to the park were improved to encourage use by children and senior citizens, they would be exposed to potential risk if there were an ammonia leak from any of the nearby canneries and the road were closed, eliminating the only access route to the park. Councilmember Davidson said his concern was for mothers pushing baby carriages, senior citizens, and handicapped persons visiting the park. He felt a compromise solution providing an extended walkway and no parking lot might address the needs of residents and park users. Councilmember Crowe said residents concerns about the road width might stem from a misunderstanding. The actual width of the constructed road would be only thirty-three feet, including the gutters. Councilmember Walters said the gutters recently built on Cope Street had alleviated much of the drainage problem that had been experienced on that street prior to paving, as it might do also for the Marine Way/Tagura Road area. He reiterated that he had not heard anyone asking that the road be paved. The City Manager explained that the water was coming down the hillside and across Mission Road which had no storm drainage. The problem could only be alleviated by constructing a storm drain along Mission Road, which would be an expensive project. Councilmember Walters felt the scope of the project should be reduced. Councilmember Crowe pointed out the City had established standards for street improvement projects several years earlier, and this project had already been designed below those standards. Staff's original determination requiring 14 parking spaces was based on parking eliminated in the refrigeration building footprint area (8 spaces), plus 4 parking spaces apparently eliminated by freezer van storage in front of cannery building on the easterly property line, plus 2 parking spaces for new construction of the refrigeration building (calculated at 1 space per 1,000 square feet). The applicant has indicated that the 4 parking spaces in front of the easterly cannery building will not be eliminated. Staff agrees that if these 4 spaces remain available, they need not be replaced. However, the 40 ft. by 40 ft. mezzanine (CZ 99-049) should also require 2 parking spaces as new construction (1 space per 1,000 square feet). The total number of parking spaces then required is twelve (12). Unless the Commission is willing to adjust downward from eight (8) the number of parking spaces eliminated by the refrigeration building, since none of the historic photos provided actually shows that many vehicles in the building footprint area at one time, staff believes that the on-site parking requirement should remain at twelve (12). Absent a redetermination of the number of parking spaces eliminated, less that twelve (12) on-site parking spaces should be permitted only by variance. An application for a variance of four (4) feet from the two-way aisle width requirement of twenty-four (24) feet has also been submitted for the April agenda. The two aisle ways accessing the majority of parking spaces are proposed to be twenty (20) feet wide, as indicated on the parking plan. Compliance with the parking requirement remains April 1, 2000 unless the Commission finds that is appropriate to extend the deadline pending outcome of the variance request or otherwise acknowledging the good faith efforts of the applicant to satisfy parking requirements under difficult circumstances. Our lot is triangular-shaped and wedged between Tilg Uld and Marine Way. Our parking arca on Tagura is small, congested, with 5 residences located in the cul-de-sac. We frequently use our property which borders Marine Way to park in front of our house. Also, it is the only access to our shop and fishing gee! located in the bottom portion of our home and on our property. We store skiffs and other gear on the Marine Way portion of the lot and need to be able to navigate a truck in the area to move them. We have been fortiinate in the fact, that prior to late 1999, the traffic and boatyard activities have been limited to only a few months a year, particularly in the spring and prior to salmon season and after. Vessel owners typically lift and repair their vessels prior to the season and their activities revolve around those working days in the boatyard, Activity is intermittent. For FT105i part, we have enjoyed living in the area, because we are located near a cul-de-sac turnaround at the end of Marine Way. We are isolated from much of the traffic you might expect in an industrial area. And, in the mid-bO's $0f110 of the cannery activities slowed down due to closures of their plants and thus, created a pretty quiet neighborhood. However, the atmosphere in our area has changed with the expanding activities of Global Seafoods, which is located only a couple hundred yards away. Our lot in particular has been impacted with at least 8 to 12 vehicles parking alongside the entire distance of our lot Line, blocking access to our property. Since December, we have been dealing with increased noise, foot traffic., the starting up of engines, at ALL hours of the day and night, not to mention frequent police cruise-bys and tow trucks. At this juncture, I would comment that the character of our residential neighborhood has boon seriously compromised by the expanded processing-related activity and the lack of adequate parking on the business premises. Licensee agrees to defend, indemnify and hold KEA harmless from and against any and all liability for property damage, bodily injury and/or attorney's fees and costs arising out of the construction, alteration, maintenance, and/or existence of the encroachment. Disclaimer of Warranties by KEA: The grant of the license hereunder is without any warranties, express or implied, pertaining to the nature and extent of KEA's easement rights by themselves or in relation to any rights of others, and is in no way intended to modify KEA's rights except as expressly provided herein. Any and all such express and implied warranties are excluded and/or disclaimed by KEA. KEA, in granting the license provided herein, in no way makes any warranty or representation whatsoever, express or implied, as to tlie propriety, lawfulness, safety, desirability, and/or permissibility of the construction, alteration, maintenance, and/or existence of the encroachment and undertakes no express or implied duties with respect to said encroachment. 4. Revocation and Duration: The license created by this Agreement shall continue in existence until revoked by KEA and KEA shall have the right of revocation only after the happening of one or more of the following events: a. The structure of which the encroachment is a part is damaged by any means to an extent more than fifty percent (50 %) of its replacement cost at the time of destruction. b. The structure of which the encroachment is a part is moved for any reason for any distance whatever. c. The encroachment into KEA's easement, either horizontally, diagonally, or vertically, is increased in any way. d. The structure of which the encroachment is a part is no longer subject to a deed of trust or other security agreement for the purchase of the subject structure of 3 5 years, whichever occurs later. The right of revocation previously described shall not be limited in any way by any expense or reliance which the Licensee has or will make in connection with the construction, alteration, maintenance, and/or existence of the encroachment. Revocation by KEA of this license shall be upon thirty (30) days' written notice, mailed or delivered, to the Licensee at his address described above or posted at a reasonably conspicuous location at or near the encroachment. The Licensee shall, immediately upon revocation of the license, remove the encroachment and restore the land in which KEA has easement rights to an easement conforming condition, all at the sole expense and obligation of Licensee. Nothing herein is intended to waive or restrict KEA's exercises of its powers of eminent domain, Assignment: The license created by this Agreement shall be personal to the Licensee, but shall be freely assignable upon written notification to KEA referencing this Agreement by date, parties, nature of encroachment, and property description and stating the assignee's name and mailing address. The license created by this Agreement shall not in any respect constitute an interest in the above described real property for any purpose. KEA, in its sole option and discretion, may waive any failure of the Licensee to give proper notification of an assignment hereunder. Assignment shall in no way modify or alter the rights of the parties as provided herein, including, but not limited to, the right of KEA to revoke the license at any time. Recordation of this written instrument by either party, if permitted by any recording district in Alaska, shall not in any way be construed to create an interest in the above described property but shall constitute constructive notice of this Agreement's terms and conditions. FULLER.and FERN B. FULLER, his wife, • of Kodiak, Alaska, hereinafter called :lessor," and WHITNEY- ' FIDALGO SEAFOODS, INC., a Maine corporation, -qualified to do business in the State of Alaska, herein called "Lessee." WITNESSET H: WHEREAS, the parties entered into a Lease for 100 feet of Lessor's prOperty,'including'i dock,.on August 10, 1966, which had a term of five (5) years and granted Lessee three, five-year renewal options; and ' WHEREAS, the parties entered into a Lease Modification Agreement, dated February 16, 1971, for the above-described . . . . premises, plus an additional 50.feet of property upon which Lessor was required to build a dock. The term of the Lease Modification Agreement was the same ter th as the origihal Lease, commencing on the date of completion of work by Lessor as re- quired by the Lease Modification Agreement. Any extension of•the Lease term by reason of these options shall be on the same terms and conditions existing during the original term of the Lease. (e) It is understood by the parties hereto that the terms of the Lease Agreement shall not include the 100 feet adjacent to the 83 foot parcel current owned by Fuller and totally referred to as 183' N•unless Fuller ultimately acquires rights to the 100 feet of property which is presently in escrow at the National Bank of Alaska in Kodiak and which has not been released by the City of Kodiak. 5. Maintenance and Repair, It shall be Lessors' obligation to keep and maintain the dock, the grid upon which the cannery is moored and the fill area in good repair and suitable for the uses intended by the Lessee; provided, however, that Lessee agrees, at its sole cost and expense, to maintain . the fender piling on the entire dock area. 6. Insurance. Lessee shall maintain its own insurance for its boilers and cannery, including fire and extended coverage, and Lessee agrees to obtain public liability and property damage liability insurance and to name Lessor as co- insured in amounts mutually agreed upon. Lessee shall not be responsible for damage which may arise or be.caused on the property by reason of Lessor's activities. 7. Damages or Destruction. In the event of major damage to or destruction of the leased property, or Lessee's, cannery, so as to make the further operation of the cannery impractical, even though the loss be covered by insurance, then Lessee shall have the option to immediately cancel the Lease and shall pay the accrued rental to date. In the event Lessee cancels the lease under this paragraph, Lessee agrees to remove - all damaged or destroyed buildings, structures or improvements located on the premises. 8. Taxes. a. Lessor shall pay all property taxes on the leased property. b. Lessee shall pay all property taxes on its boilers, cannery and other equipment used in the operation of its cannery. 9. Default. In the event of failure of Lessee to pay the rent when due, or in the event of the failure of the Lessee to cure any breach of covenant within sixty (60) days after' receipt of written notice from Lessor, setting forth the breach of the covenant, the Lessor shall have the right to immediately terminate the Lease. Said termination shall not relieve Lessee of the obligation to pay rent, as provided. 10. Condemnation. In the case of condemnation or appropriation of the whole or any substantial part of said premises by any public or private corporation under the laws of eminent domain, then this Lease may be terminated at the option of either party hereto on thirty (30) days' written notice to the other, and any payment or Court award shall be prorated between Lessor and Lessee as their respective interests in the property exists at that time. 11. Successors and Assigns. This Agreement shall inure to the benefit of and be binding upon the heirs, executors, successors, assigns and personal representatives of the parties. 12. Notice. Whitney agrees that Fuller can continue this practice until - Fuller builds anew dock on their 183 fact of property adjacent to the property leased by Fuller to Whitney, hereinafter referred - to as "183' N," and described in Exhibit A attached hereto, or until Whitney notifies Fuller that Whitney has need for the dock. Fuller agrees to terminate their use of the dock if notified to do so by Whitney. 4. Fuller hereby grants first preference for vessel haul outs, or ins, to••Whitney's fishermen,. as designated by the cannery superintendent, and Fuller agrees to store such vessels on either Whitney's property, if available, or Fuller's 183' N. Fuller is not obligated to store or haul any vessel which Whitney has not, advised him of in' writing by September 15 of any year. Fuller agrees to pay Whitney $10.00 per lift out and -$10.00 per drop in for all vessesl over Whitney's dock, and Fuller further agrees to pay Whitney twenty percent (207.),of any increased fee charged to the fishermen above Fuller's currently established rates only for as long as Fuller uaes,the facility owned by Whitney. 6. Fuller will maintain an area for storage of Whitney's vessels and Whitney's:fishermen's vessels on their 183' N property. 7. Fuller agrees to provide adequate insurance for their business operation of haul outs, and will name Whitney as loss payee on all such insurance policies only for as long as Fuller uses the facility owned by Whitney. . 8.
