Dear Mr.-Dvorak:
Martin Lydick suggested that I write to you requesting review of a determination
about the use of our property at 714 Marine Way East (ATS 49 Tract P-16B). Our
request relates to the Zoning Compliance Permit (CZ2013-045) requirement for
inclusion of nineteen (19) parking spaces to be placed behind the planned
container storage area.
ISA is currently installing fifteen (15) staging bays or positions along the front of
the property, to be used for ongoing temporary location of 40-ft. refrigerated
container vans. The ability to stage shipping vans at this location will allow us to
supplement limited cold storage space at our facility. It will also allow us to place
customer product directly into shipping vans as it is finished at our processing
facility, rather than having to move the product multiple times into or out of cold
storage, until such time as a full van load of product is ready to ship. These
container vans need to be supplied with electricity to hold contents at -10°F. For
this reason we need to install 480 volt three phase power outlets for each
container staging position.
Our concern is that the land use, according to Mr. Lydick, cannot be defined as
Open Storage because of the presence of the electrical power.
The fact is that these container vans will only ever be temporarily stored or
staged at this location, not permanently installed. To reinforce this point we
offer the following additional information:
• If we need to place additional product in one of the vans staged at this
location, APL or Horizon will be called to move that container van back to
our processing facility at 517 Shelikof St for loading.
• When we are ready to ship one of the vans staged at this location, APL or
Horizon will be called to take it to the shipping yard.
• At no time will there be loading or unloading operations into or out of vans
while they are staged on this lot. Once vans are staged on the lot, there
simply is not any space between the fence and the back of the vans to
operate a forklift.
• No ISA employees will be working with these vans on a regular basis. The
vans are simply being stored or staged in the yard until they are filled
and /or shipped.
Accordingly, we request your kind assistance in granting us Open Storage use for
our property at 714 Marine Way East so that it is not necessary to provide so
many unneeded parking spaces.

Industrial.
If your use of the existing structure on the property is different from the previous
occupant, you are required to obtain zoning compliance for your new use of the
structure from the Kodiak Island Borough Community Development Department.
In order to issue zoning compliance, the Kodiak Island Borough Community
Development Department must review your new use to ensure that it meets the
Borough's zoning regulations, especially the parking requirements. Please contact this
office within fifteen (15) days of the date of this letter to discuss this situation and
apply for zoning compliance for your business, if it is needed. If we do not hear
from you, we will assume that your business is not a new use for the property.
If you have any questions regarding why your business must comply with the Borough
Zoning Ordinance, please do not hesitate to contact the Community Development
