Dear Mr. Ursin,
As a result of recent complaints and advertisements in the local newspaper, this
department conducted a site review on August 8th, 2001, of the property described above. The
principal motive for the site review was to establish whether or not a new business was operating
at the location, and the nature of the business.
We were able to establish that a new business enterprise (Alaska Custom Fiberglass &
Auto body Repair) was indeed operating at the location, and that the required zoning compliance
for such change in use was not on file with our department.
The requirement for a current zoning compliance permit is found in Kodiak Island
Borough Codes Title 17.
17.03.060 Zoning compliance. Zoning compliance is required for site grading
(excavation and fill), erection, construction, establishment, moving, alteration, enlargement,
repair, or conversion of any building or structure in any district established by this title, subject
to the following:
A. An application for zoning compliance will be filed with the community
development department on a form provided by the department. If the application meets the
requirements of this title, as verified in the department, and other applicable regulations, a permit
will be issued. An as-built of the property may be required to ensure that applicable
requirements can be met, when existing structures are located on the property. Any zoning
compliance permit issued is subject to the same expiration, suspension, and revocation
provisions as a building permit issued for the same construction project.
Of particular concern is the nature of the business operating at this location, and the
potential for tragic and disastrous consequences resulting from the lack of proper storage and
handling of hazardous /flammable materials and the lack of proper ventilation.

In conjunction with the zoning compliance permit, a current parking plan is required to
be submitted for review and acceptance. The requirement of a parking plan is found in KIBC
Title 17.
17.57.100 Parking Plan Review.
A. All applications for zoning compliance shall include a plan for any parking area to be
constructed in conjunction with the work that is the subject of the application. The plan shall be
in a form and drawn to a scale approved by the community development department.
The plan shall include:
1. the exterior boundaries of the subject lot, their dimensions, and the area of the lot;
2. the location and dimensions of all buildings (proposed or existing), parking spaces,
loading area, aisles, turning and maneuvering areas, driveways, sidewalks, screening as required,
and points of ingress and egress to the lot; and
3. the location and dimensions of all streets and sidewalks adjacent to the lot, and the
direction of traffic on such streets.
B. The community development department shall review all parking area plans for
conformity with this title.
The specific number of off - street parking spaces required by the type of business
operating at the location is detailed in KIBC Title 17.
17.57.040 Off - street parking -- Number of spaces required.
A. The required number of off - street parking spaces to be provided will be determined as
follows:
Auto, boat, and recreational service garages,
gas stations, repair shops, and accessory installation shops
4 spaces per stall /service bay.

In addition to the violation(s) referenced above, at least one other violation of note was
observed during our site visit. A small travel trailer, a fifth -wheel travel trailer, a motor home,
and a school bus were located on the property and apparently being utilized for sleeping
purposes. The establishment of residential accommodations on industrially zoned property is not
a permitted use. KIBC Title 17 lists the permitted uses in the industrial zone.
17.24.010 Permitted uses. The following uses of the land are permitted in the industrial
district:.

Therefore, according to standard policy, a thirty (30) day deadline is now established by
administrative decision for you to abate this violation. In the event that you disagree with
this determination, you have certain rights of appeal.
17.90.020 Commencement of appeal — Stay.
A. A decision of the community development department director is final unless
appealed to the Planning and Zoning Commission within ten (10) working days of
receipt of notification of the decision.
B. An appeal is commenced by filing with the community development department a
written notice of appeal, specifically stating the reason for the appeal, the relief
sought, and payment of the appropriate fee ($150.00). Upon commencement of an
appeal, the decision appealed from is stayed until the decision on appeal becomes
final.
Failure to comply with the requirements of the Kodiak Island Borough Code may subject
the property owner to certain civil penalties. Failure to comply with the mandates of this
determination within thirty (30) days, (by September 14th, 2001), will require that this file be
forwarded to the Borough Attorney for further legal action.

17.03.060 Zoning compliance. Zoning compliance is required for site grading
(excavation and fill), erection, construction, establishment, moving, alteration,
enlargement, repair, or conversion of any building or structure in any district established
by this title, subject to the following:
A. An application for zoning compliance will be filed with the community
development department on a form provided by the department. If the application meets
the requirements of this title, as verified in the department, and other applicable
regulations, a permit will be issued. An as -built of the property may be required to
ensure that applicable requirements can be met, when existing structures are located on
the property. Any zoning compliance permit issued is subject to the same expiration,
suspension, and revocation provisions as a building permit issued for the same
construction project (See Uniform Building Code 303(d) and (e), as currently adopted
under section 15.02.020 of this code).
17.03.080 Uses prohibited unless authorized. Land uses not listed as a permitted use in

17.24.005 Description and intent. The I- Industrial Zoning District is established as a
district in which the principal use of the land is for business, manufacturing, processing,
fabricating, repair, assembly, storage, wholesaling, and distributing operations, which

may create some nuisance, but which are not properly associated nor compatible with
residential land uses. For the industrial zone, in promoting the general purpose of this
title, the specific intentions of this chapter are:
17.24.010 Permitted uses. The following uses of the land are permitted in the industrial
district:
A. All uses permitted in B-Business District, except residential;
B. Aircraft, automobile and truck assembly or remodeling;
G. Boat building, repair and storage;
S. Metal working or welding shops;
V. Paint shops;
17.24.030 Lot requirements.
A. Lot area. The minimum lot area required is twenty thousand (20,000) square feet.
B. Lot width. The minimum lot width required is seventy-five (75) feet. (Ord. 81-
40-0 32 (part), 1981).
17.24.040 Yards.
A. Front yards.
1. there shall be a front yard of not less than thirty (30) feet.
2. the front yard, when facing a state highway, shall be not less than fifty (50)
feet.
B. Side yards.
1. there shall be a side yard on each side of a principal building of not less than
twenty (20) feet, except that approved firewall installations between adjoining structures
provides for construction on the lot line.
C. Rear yards.
1. there shall be a rear yard of not less than twenty (20) feet, except that
approved firewall installations between adjoining structures provides for construction on
the lot line.
D. Exemptions. Waterfront industries are exempt from the requirements of this
section. (Ord. 81-40-0 32 @art), 1981).
17.24.060 Performance standards. All permitted and conditional uses shall comply
with the performance standards listed, where applicable, in this section.
A. Noise. The noise emanating from a premises used for industrial activities shall be
muffled so as to not become objectionable due to intermittent beat, frequency, or shrill-
ness; and where a use adjoins a residential district, the noise loudness measured at the
boundary line shall not exceed ninety (90) decibels.
B. Lighting. Any lighting shall not be used in a manner which produces glare on
public highways and neighboring property. Arc welding, acetylene torch cutting and
similar processes shall be performed so as not to be seen outside the property.
C. Fire and safety hazards. The storage and handling of inflammable liquids,
liquefied petroleum, gases and explosives shall comply with the fire prevention code and
all other applicable laws and regulations. Enameling and paint spraying operations shall
be permitted when incidental to the principal use and when such operations are contained

within a building of two-hour fire-resistive construction. Bulk storage of inflammable
liquids below ground shall be permitted if the tank is located no closer to the property
line than the greater dimension (diameter, length or height) of the tank.
D. Odor. Uses causing the emission of obnoxious odors of any kind and the
emission of any toxic or corrosive fumes or gases are prohibited.
E. Dust and smoke. Dust and smoke created by industrial operations shall not be
exhausted into the air in such a manner as to create a nuisance.
F. Open storage. Any storage shall not be located closer than twenty-five (25) feet
to any street right-of-way. Any storage shall be enclosed with a fence acceptable to the
commission. Whenever lumber, coal or other combustible material is stored, a roadway
shall be provided, graded and maintained from the street to the rear of the property to
permit free access for fire trucks at any time.
G. Screening. Where an industrial use is adjacent to and within one hundred (100)
feet of a residential use or zone, that industry shall provide screening as approved by the
commission. (Ord. 81-40-0 32 (part), 1981).
17.57.100 Parking plan review.
A. All applications for zoning compliance shall include a plan for any parking area to
be constructed in conjunction with the work that is the subject of the application. The
plan shall be in a form and drawn to a scale approved by the community development
department.
The plan shall include:
1. the exterior boundaries of the subject lot, their dimensions, and the area of the
lot;
2. the location and dimensions of all buildings (proposed or existing), parking
spaces, loading area, aisles, turning and maneuvering areas, driveways, sidewalks,
screening as required, and points of ingress and egress to the lot; and
3. the location and dimensions of all streets and sidewalks adjacent to the lot,
and the direction of traffic on such streets.
B. The community development department shall review all parking area plans for
conformity with this title. (Ord. 90-45-0 32(part), 1991).
17.57.040 Off-street parking--Number of spaces required.
A. The required number of off-street parking spaces to be provided will be
determined as follows:

gas stations, repair shops, and accessory installation
shops
4 spaces per stall/service bay.

NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future transferee. The term
"this office" refers to the appropriate district or division office of the Corps of Engineers having jurisdiction over the permitted
activity or the appropriate official of that office acting under the authority of the commanding officer.
You are authorized to perform work in accordance with the terms and conditions specified below.
Project Description: Construct a 266'x16' pile supported dock with a 60'x40' section
extending from the west side of the dock, to provide fishing vessel moorage and fish
transfer and 'handling facilities.
All work will he performed in accordance with the attached plan, 1 sheet dated
January 26, 1987.
Project Location: St. Paul Harbor, section 31, T. 27 S., R. 19 W., S.M., Kodiak, Alaska.
Permit Conditions:
General Conditions:
1. The time limit for completing the work authorized ends on April 30, 1990 If you find that you need
more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least
one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi-
tions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make
a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain
the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of
this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by
this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordina-
tion required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register
of Historic Places.

4. If you sell the property associated with this permit, you must obtain the signature of the new owner in the space provided
and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified
in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it con-
tains such conditions.
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure
that it is being or has been accomplished in accordance with the terms and conditions of your permit.

1. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to:
(X) Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403).
( ) Section 404 of the Clean Water Act (33 U.S.C. 1344).
( ) Section 103 of the Marine Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413).
2. Limits of this authorization.
a. This permit does not obviate the need to obtain other Federal, state, or local authorizations required by law.
b. This permit does not grant any property rights or exclusive privileges.
c. This permit does not authorize any injury to the property or rights of others.
d. This permit does not authorize interference with any existing or proposed Federal project.
3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following:
a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural
causes.
b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf
of the United States in the public interest.
c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity
authorized by this permit.
d. Design or construction deficiencies associated with the permitted work.

e. Damage claims associated with any future modification, suspension, or revocation of this permit.
4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public
interest was made in reliance on the information you provided.
5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances
warrant. Circumstances that could require a reevaluation include, but are not limited to, the following:
a. You fail to comply with the terms and conditions of this permit.
b. The information provided by you in support of your permit application proves to have been false, incomplete, or
inaccurate (See 4 above).
c. Significant new information surfaces which this office did not consider in reaching the original public interest decision.
Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation
procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The
referenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms
and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any
corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations
(such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the
cost.
6. Extensions. General condition 1 establishes a time limit for the completion of the activity authorized by this permit. Unless
there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest
decision, the Corps will normally give favorable consideration to a request for an extension of this time limit.

The Division of Governmental Coordination (DGC) has completed the
consistency review of your project in which you propose to
construct a 266-foot by 16-foot pile supported dock in St. Paul
Harbor, section 31, T. 27 S., R. 19 W., S.M., Kodiak, Alaska. A
60-foot by 40-foot section would be constructed on the west side
of the dock. The purpose of the dock is to provide fishing
vessel moorage and fish product transfer and handling.
This conclusive consistency determination applies to the
following State and federal authorizations as per 6 AAC 50:

Based on Our review, the Division concurs that the proposal is
consistent with the Alaska Coastal Management Program provided
the following stipulation is adopted.
The stipulation listed below will be placed on the Certificate of
Reasonable Assurance issued by the DEC:
1. If the wooden portions of the dock are to be treated
with a wood preservative containing creosote or penta-
chlorophenols, the preservative must be injected into,
not painted onto, the wood through a pressure
treatment. This type of treatment allows for less
leaching or weeping of these toxic chemicals into the
water.

This stipulation is necessary to protect water quality by
preventing introduction of toxins and pollutants per 6 AAC 80.140
Air, Land, and Water Quality. The text of this standard is
provided as an enclosure to this letter.
If changes to the approved project are proposed prior to or
during its siting, construction, or operation, you are required
to contact this office immediately to determine.if further review
and approval of the revised project is necessary.
The state reserves the right to enforce compliance with this
conclusive consistency determination if the project is changed in
any significant way, or if the actual use differs from the
approved use contained in the project description. If
appropriate, the state may amend the state approvals listed in
this conclusive consistency determination.
By a copy of this letter we are informing the U. S. Army Corps of
Engineers of our finding.
Thank you for your cooperation with the Alaska Coastal Management
Program.

In accordance with Section 401 of the Clean Water Act of 1977 and provi-
sions of the Alaska Water Quality Standards, the Department of Environ-
mental Conservation is issuing the enclosed Certificate of Reasonable
Assurance for the proposed construction of a dock at Kodiak, Alaska.
This department action represents only one element of the overall project
level coastal management consistency determination issued by the Office
of Management and Budget under AS 44.19 and 6 AAC 50.070.
Department of Environmental Conservation regulations provide that any
person who disagrees with any portion of this decision, may request an
adjudicatory hearing in accordance with 18 AAC 15.200-310. The request
should be mailed to the Commissioner of the Alaska Department of Environ-
mental Conservation, P.O. Box 0, Juneau, Alaska 99811-1800 or delivered
to his office at 3220 Hospital Drive, Juneau. Failure to submit a hear-
ing request within thirty days of receipt of this letter shall constitute
a waiver of that person's right to judicial review of this decision.
By copy of this letter we are advising the Corps of Engineers and the Di-
vision of Governmental Coordination of our actions and enclosing a copy
of the certification for their use.

CERTIFICATE OF REASONABLE ASSURANCE
A Certificate of Reasonable Assurance, as required by Section 401 of the
Clean Water Act, has been requested by Julius and Barbara Majdic, P.O.
Box 345, Kodiak, Alaska 99615, for the construction of a 266' x 16' pile
supported dock, with a 60' x 40' side extension.
The proposed activity is located within Section 31, T27S, R19W, Seward
Meridian, Shelikof Avenue, Kodiak, Alaska.
Public notice of the application for this certification has been made in
accordance with 18 AAC 15.180.
Water Quality Certification is required for the proposed activity because
the activity will be authorized by a Corps of Engineers permit identified
as Kodiak Harbor 38, NPACO No. 071- OYD -0- 720165, and a discharge may re-
sult from the proposed activity.
Having reviewed the application and comments received in response to the
public notice, the Alaska Department of Environmental Conservation certi-
fies that there is reasonable assurance that the proposed activity, as
well as any discharge which may result, is in compliance with the require-
ments of Section 401 of the Clean Water Act which includes the Alaska
Water Quality Standards, 18 AAC 70, and the Standards of the Alaska
Coastal Management Program, 6 AAC 80., provided that:

PERMIT CODIFICATION
Department of the Army permit No. 1- 720165, Kodiak Harbor 38, was
issued to Pan Alaska Fisheries, Incorporated on January 10, 1974. The
permit was transferred to Julius and Barbara U. M ajdic on September 3,
1986. The permit was subsequently modified on September 11, 1986, for
replacement and relocation of an existing dolphin (M- 720165), and again on
October 9, 1986, for placement of two steel piles (N- 720165). A permit
(0- 720165) was issued to the Majdics on May 27, 1987, for construction of
a 266'x16' dock with a 60'x40' attached section.
The permit is hereby modified to change the measurements of the pier
of permit number 0- 720175, from 266'x16' to 266'x20', an additional 4' in
width.
If the activity authorized herein is not completed witnin 3 years of
the date of this letter, the authorization of this modification, if not
previously revoked or specifically extended, shall automatically expire.
All other terms and conditions of the original permit and subsequent
modifications remain in full force- and effect.
This authorization and the enclosed modified 1 sheet, undated should be
attached to anc become a part of the original permit.
