Dear Ms Fuller:
I would like to apologize for the tone 'of my last letter
regarding the provision of parking and screening on Lots 5 and 6,
Block 33, East Addition. While it is true that some
modifications to your parking and screening plan are required, no
deadline for compliance was set by the Planning and Zoning
Commission when it reviewed the case on January 18, 1989. In
cases where there may be a code violation, but there has been no
Commission or administrative deadline set, the normal procedure
is to work directly with the property owner to try and resolve
the situation before initiating legal action. Therefore, it was
an error on my part to have sent you the certified letter you
received on October 23, 1989.
Your representative, Vito Kalcic, has contacted this office and
explairred the plans for further development of parking on the
lot. He also explained that it would take several months for
this plan to be completed. Considering the weather at this time
of year, we feel this may not be an adequate period of time.

Therefore, we will establish a deadline of May 1, 1989. This
should permit ample flexibility for the project to go forward
without becoming a hardship due to uncooperative weather
conditions. If you do not feel this time frame is adequate to

2. The proposed structure will not have a negative impact on
the adjacent properties due to noise.
3. The combination business/residence to be developed is not
oriented towards any residential property and as a result
will not adversely impact surrounding uses.
A site inspection on October 3, 1989, as a follow-up to the
above referenced Commission action, revealed that no progress has
been made' toward bringing your property into compliance with
Section 17.57.040C (Parking Area Development Standards) of the
Borough Code. Section 17.57.040C states:
parking area serving a commercial,
;industrial, or institutional use that adjoins
the side of a residentially zoned lot shall
be separated from the side of the residential
:zoned lot by a fence or hedge not less than
four nor more than six feet in height. The
fence or hedge shall extend along the entire
boundary of the parking area adjoining the
side of the residentially zoned lots, except
that it shall not extend along any part of
that boundary adjoining the front yard of the
residentially zoned lot.
The attached zoning compliance/conditional use permit shows that
Section 17.57.040C was specifically indicated on your conditional
use permit which allowed the conversion of the second floor of
the business structure on Lots 5 and 6, Block 33, East Addition,
to a residential use. You are specifically required to construct

a four to six (4 to 6) foot fence along the rear property line
between Lots 5 and 12 as shown on the attached site plan.
In addition, the parking plan showing the placement and number of
parking spaces on the site was based upon the expected removal of
a portion of the existing structure located at the rear of the
lot. This also has not been accomplished. If you plan to
continue using this additional building area, you need to contact
this office to see if modification of the parking plan is
necessary to comply with Chapter 17.57 (Off-Street Parking) of
the Borough Code.
You are now in violation of Borough Code. Failure to comply with
Section 17.57.040C (Parking Area Development Standards) subjects
you to the penalties of Section 17.75.030 of the Kodiak Island
Borough Code, which states in part: "A person who violates any
of the provisions of this Title ... is guilty of a misdemeanor
and upon conviction is punishable by a fine of not more than
three hundred ($300) dollars. ... Each act or condition violating
this title ... and each day during which the act or condition
exists, continues, or is repeated shall be a separate and
distinct violation."
You have had since February 14, 1989 to bring your property into
compliance with the screening requirements. Adequate time has
been allowed for you to do so. However, because there may be
extenuating circumstances, staff is willing to suspend further
enforcement action for ten (10) days from the receipt of this
letter. The purpose of this delay is to permit you the option of
initiating the installation of the fence or submitting a letter
requesting an extension of time and listing any extenuating

circumstances that you feel have contributed to your lack of
compliance. If you choose to submit a letter, it must also
include a! detailed time line showing your schedule of planned
improvements. If the letter is received within the ten (10) day
time limit, enforcement action will be delayed until the November
15, 1989 'pegular meeting of the Planning and Zoning Commission.
The Commission can then review the information received from you
and make a decision as to whether an extension of the time for
compliance is warranted.
If construction of the fence is not initiated, or if the
information requested above is not received within the ten (10)
day period, this file will be forwarded to the Borough Attorney
for further enforcement action.

Dear Mr. Kalcic:
February 9, 1989
I have addressed this letter to you as the agent for Ms. Fern Fuller, the property owner of Lots 5 and 6,
Block 33 East Addition. I would like to take this opportunity to re-emphasize that a new zoning
compliance permit must be obtained before work may begin on the upstairs residential portion of the
project which was recently approved by Conditional Use Permit in Case 89-003.
You must also obtain a new zoning compliance for the lower floor business development so that we can
document the requirement for screening of business related off-street parking, as required by Borough
Code. You may recall, this requirement will only affect that portion of the parking area which is adjacent
to residentially zoned, or residentially used property.
It would be helpful if you could provide a site plan' of the proposed parking plan and building location to
assist us in processing the above mentioned zoning compliance permits. A copy of this letter has been
sent to Ms. Fuller and the Building Official to insure that all interested parties are informed. Thank you for
your assistance in this matter.

An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of
appeal with the City Clerk within ten days of the date of the Commission's decision. The notice of appeal
must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and
effective until ten days following the decision.

of whether Section 17'.2105O(C) (Performance Standards.) of
the Borough Code should be required where Section
17.57.040(C) (Parking Area Development Standards), are
already applicable.
Section 17.'1 .050 ( C) requires that businesses shall
provide and maintain screening as approved by the Planning
and Zoning Commission.
Section 17.57.050 (C) requires that parking areas serving
commercial, industrial, or institutional uses that adjoin
the side of a residentially zoned lot of shal 1 be separated
from the side of a residentially zoned lot by a fence or
hedge not less than four nor more than six feet in heights
and that the fence or hedge shall extend along the entire
boundary of the parking area adjoining the side of
residentially zoned lots, except that it shall not extend
along any part of that boundary adjoining the front yard
of the residentially zoned lot.

This appearance request is before the Commission as a. result of
staff's issuance of zoning compliance for a business use on Lots 5
and 6, Block :33, East Addition. Staff has determined that the
Planning and honing Commission should review this development in
order to determine what type of screening, if any, would be
appropriate above and beyond that which is require for• parking
areas.

Lots 5 and 6, are located along Tagura Road, across the street from
an Industrial area located along the Near Island Channel. Lots 11
and 12 -are located directly behind Lots 5 and 6, fronting on Mission
Road. The areas where screening could be required would be along
the rear lot 1 i ne of Lots 5 and 6, and the lot 1 i ne between Lots 6
and 7. The reason screening could be required between Lots 6 and 7
is because there is a residential use on Lot 7, even though the lot
is actually zoned business.

Stuff believes that it should not be necessary to require screening
between Lots 6 and 7, as the proposed improvements to Lots 5 and 6
should improve the appearances of the property to a great extent.
The owner of Lots 5 and 6 is contemplating the development of a
combination business and residence. (Conditional Use Permit request
is pending, Case 89 -003) Plans cal 1 for al 1 outdoor storage on the
site to be removed and additional parking to be developed.
As a resul t of reviewing the request for a conditional use permit
for Lots 5 and 6, Block 33, staff believes that the topographer of
the area would not be conducive to effective screening between Lots
5 and 6 and Lots 11 and 12. Due to the elevations differential
between the two properties, and the fact that the existing residence
on Lots 11 and 12 is located on the upper half of the lot, screening
along the lot line would be of limited value.
Since developing a parking plan, the applicant has indicated that it
is planned to do some cut and f i l l in order to provide more parking
area. A retaining wall would most likely be installed along the

rear lot 1 i ne where it was near the parking area This would put
the parking area adjacent to the neighboring residential area, hi i ch
had not been the case prior to the development. A fence (as required
by Kodiak Island Borough Code 17.57.040) therefore could be
effective in this area as a safety measure to insure that
individuals on the upland side of the lot line would not accidently
fall off the retaining wal l . I t could also be effective to stop
objects from inadvertently rol 1 i nq onto a person or parked vehicle
from the lot above.

Staff feels that while screening for the parking areas is required,
screening requirements greater than this would not be appropriate
in this case. Given the characteristics of the local area it would
be redundant to require screening under the authority of Section
17.21.040(C).

If the Commission agrees with the staff recommendation, the
appropriate motion is:
Move to approve that no screening must be provided and
maintained between Lots 6 and 7 and between Lots 5 and 6, and
Lots 11 and 12, Block 33, East Addition, except for that
screen i ny which is required by Section 17.57.040(C) of the
Borough Code, and to adopt the findings of fact 'contained in
the staff report dated January 11, 19'89.

Section 307(c) (3) (A) of the Coastal Zone Management Act of
1972 as amended by 16 USC 1456(c)(3) requires that appli-
cants for federal permits to conduct activities affecting
land or water uses in Alaska's coastal area must provide
certification that the activities will comply with the
standards of the Alask:: Coastal Management Program.
The proposed activity described in your federal permit
application may require certification. By filling out the
attached coastal project questionnaire you, together with
the State's resource agencies, will not only determine the
necessity for this certification, but you will also find
out if other State approvals are needed before your
proposed activity can proceed. This will also assist you
in filling out your federal permit application. Upon
receipt of the signed, dated certification, a public
notice can be issued and review of your project can begin.
For additional information on the Alaska Coastal Manage-
ment Program and project review procedures, contact one of
the offices indicated on this letterhead.

The State has a system for reviewing and processing resource-related permits, leases, and
approvals for proposed projects in coastal areas of Alaska. As a participant in this process,
you are required to complete this questionnaire. The questionnaire will help you identify

Departments of Fish and Game, Natural Resources and Environmental Conservation.

Interested parties are hereby notified that an application has been received
for a Department of the Army permit for certain work in waters of the United
States, as described below and shown on the attached plan.
APPLICANT: Mr. T. T. Fuller, Post Office Box 1486, Kodiak, Alaska 99615.
LOCATION: In Kodiak Harbor, Kodiak, Alaska at sec. 32, T. 27 S., R. 19 W.,
S.M.
WORK: The applicant proposes to modify his existing authorized uncompleted
dock facility by dredging approximately 1,200 cubic yards (cy) from a
30'x50' slip opening on the west side of his facility. The dredged area
would be bulkheaded and used for a boat lift opening. On the east side of
the facility the permittee proposes to extend his bulkhead an additional 70
feet and construct a • 60'x30' pile supported dock. A total of 2,000 cy of
fill material will*be placed behind the completed bulkhead.
PURPOSE: The completed facility will be used for ship repair purposes.
ADDITIONAL INFORMATION: The original facility was authorized September 24,
1984. Further questions should be directed to the permittee.
WATER QUALITY CERTIFICATION: A permit for the described work will not be
issued until a certification or waiver of certification as required under
Section 401 of the Clean Water Act (Public Law 95-217), has been received
from the Alaska Department of Environmental Conservation.
COASTAL ZONE MANAGEMENT ACT CERTIFICATION: Section 307(c)(3) of the Coastal
Zone Management Act of 1972, as amended by 16 U.S.C. 1456(c)(3), requires
the applicant to certify that the described activity affecting land or water
uses in the Coastal Zone complies with the Alaska Coastal Management
Program. A permit will not be issued until the Office of Management and
Budget, Division of Governmental Coordination has concurred with the
applicant's certification.
PUBLIC HEARING: Any person may request, in writing, within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearings shall state, with
particularity, the reasons for holding a public hearing.
CULTURAL RESOURCES: The latest version of the National Register of Historic
Places has been consulted and no properties listed on or known to be
eligible for inclusion on the Register are located in the permit area.
ENDANGERED SPECIES: Preliminarily, this described activity will not affect
endangered species, or their critical habitat designated as endangered or
threatened, under the Endangered Species Act of 1973 (87 Stat. 844). Formal
consultation under Section 7 of the Act is not required for the described
activity.
FLOOD PLAIN MANAGEMENT: Evaluation of the described activity will include
conformance with appropriate State or local flood plain standards;
consideration of alternative sites and methods of accomplishment; and
weighing of the positive, concentrated and dispersed, and short and
long-term impacts on the flood plain.
EVALUATION: The decision whether to issue a permit will be based on an
evaluation of the probable impact including cumulative impacts of the
proposed activity on the public interest. That decision will reflect the
national concern for both protection and utilization of important
resources. The benefit which reasonably may be expected to accrue from the
proposals must be balanced against its reasonably foreseeable detriments.
All factors which may be relevant to the proposal will be considered
including the cumulative effects thereof; among these are conservation,
economics, aesthetics, general environmental concerns, wetlands, cultural
values, fish and wildlife values, flood hazards, flood plain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply
and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, and, in general, the needs and welfare of the
people.
AUTHORITY: This permit will be issued or denied under the following
authorities:
(X) Perform work in or affecting navigable waters of the United States -
Section 10, River and Harbor Act 1899 (33 U.S.C. 403).
(X) Discharge dredged or fill material into waters of the United States -
Section 404, Clean Water Act (33 U.S.C. 1344). Therefore, our public
interest review will consider the guidelines set forth under Section 404(b)
of the Clean Water Act (40 CFR 230).
Comments on the described work, with the reference number, should reach this
office no later than the expiration date of this Public Notice to become
part of the record and be considered in the decision. If further

Any applicant for a Federal license or permit to conduct any activity
which may result in any discharge into the navigable waters must first
apply for and *obtain certification from the Alaska Department of
Environmental Conservation that any such discharge will comply with the
Clean Water Act of 1977 CPL 95-217), the Alaska Water Quality Standards
and other applicable State laws. By Agreement between the U.S. Army
Corps of Engineers and the Alaska Department of Environmental Conservation
application for a Department of the Army Permit may also serve as applica-
tion for State Water Quality Certification when such certification is
necessary.
Notice is hereby given that the application for a Department of the
Army Permit described in the Corps of Engineers Public Notice No.
071-0YD-M-780210 also serves as application for State Water Quality
Certification from the Alaska Department of Environmental Conservation,

Although the Kodiak Island Borough does not have an approved district coastal
• management plan, we would like to take this opportunity to comment on the
• project referenced above.
The Kodiak Island Borough does have a few draft coastal management policies
which could apply to this project:
"Natural Features"
Excavation, shoreline alteration and disturbance of anadromous
streams, tideflats, and wetlands shall be minimized when con-
structing and operating port, harbor, dock and industrial
facilities.
"Facility Design"
Developments, in or over the water, such as piers, docks,
and protective structures shall be'located, designed and
maintained in a manner that prevents adverse impacts upon
water quality, fish, wildlife and vegetative resources,
and minimizes interruption of water circulation patterns
and coastal processes.
• "Views •and Natural Setting"
Ports and industry shall be encouraged to minimize impacts
that detract from the natural setting of the Kodiak Archi-
pelago, and to enhance and maintain positive visual aspects
of their development and to provide opportunities for public
viewing of such positive aspects whenever practical and safe.
As reviewed, this project will be consistent with the recognized uses of
the coastal zone in the area of the project site, if there is compliance
with the stated policies. With this project, there is a specific concern
that the project "minimize impacts.that detract from the natural setting
of the Kodiak Archipelago and enhance and maintain positive visual
aspects of (their) development..."

pollutants into waters of the United States or ocean waters, be at all times consistent with applicable water quality standards,
effluent limitations and standards of performance, prohibitions, pretreatment standards and management practices establish-
ed pursuant to the Clean Water Act (33 U.S.C. 1344), the Marine Protection, Research and Sanctuaries Act of 1972 (P.L. 92 -632,
86Stat. 1052), or pursuant to applicable State and local law. -
c. That when the activity authorized herein involves a discharge during its construction or operation, or any pollutant
(including dredged or fill material), into waters of the United States, the authorized activity shall, if applicable water quality stan-
dards are revised or modified during the term of this permit, be modified, if necessary, to conform with such revised or modified
water quality standards within 6 months of the effective date of any revision or modification of water quality standards, or as
directed by an implementation plan contained in such revised or modified standards, or within such longer period of time as the
District Engineer, in consultation with the Regional Administrator of the Environmental Protection Agency, may determine to
be reasonable under the circumstances.
d. That the discharge will not destroy a threatened or endangered species as identified under the Endangered Species Act,
or endanger the critical habitat of such species.
e. That the permittee agrees to make every reasonable effort to prosecute the construction or operation of the work
authorized herein in a manner so as to minimize any adverse impact on fish, wildlife, and natural environmental values.
f. That the permittee agrees that he will prosecute the construction or work authorized herein in a manner so as to minimize
any degradation of water quality.
g. That the permittee shall allow the District Engineer or his authorized representative(s) or designee(s) to make periodic in-
spections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in
accordance with the terms and conditions prescribed herein.
h. That -the permitted shall maintain the structure or work authorized herein in good condition and in reasonable ac-
cordance with the plans and drawings attached hereto.
i. That this permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and
that it does not authorize any injury to property or invasion of rights or any infringement of Federal, State, or local laws or
regulations.
j. That this permit does not obviate the requirement to obtain state or local assent required by law for the a

' k. That this permit may be either modified, suspended or revoked in whole or in part pursuant to the policies and pro-
cedures of 33 CFR 325.7.
L That in issuing this permit, the Government has relied on the information and data which the permittee has provided in
connection with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be
materially false, materially incomplete or inaccurate, this permit may be modified, suspended or revoked, in whole or in part,
and /or the Government may, in addition, institute appropriate legal proceedings.
m. That any modification, suspension, or revocation of this permit shall not be the basis for any claim for damages against

the United States. `
n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced, as
far in advance of the time of commencement as the District Engineer may specify, and of any suspension of work, if for a period
of more than one week, resumption of work and its completion.
o. That if the activity authorized herein is not completed on or before day of ,19 , (three years
from the date of issuance of this permit unless otherwise specified) this permit, if not previously revoked or specifically extended,
shall automaticallyexpire.
p. That this permit does not authorize or approve the construction of particular structures, the authorization or approval of
which may require authorization by the Congress or other agencies of the Federal Government.
q. That if and when the permittee desires to abandon the activity authorized herein, unless such abandonment is part of a
transfer procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition t
hereof, he must restore the area to a condition satisfactory to the District Engineer.
r. That if the recording of this permit is possible under applicable State or local law, the permittee shall take such action as
may be necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility
for maintaining records of title to and interests in real property.
s. That there shall be no unre :.able interference with navigation by the ezia ^___ or use of the activity authorized
herein.
t. That this permit may not be transferred to a third party without prior written notice to the District Engineer, either by
the transferee's written agreement to comply with all terms and conditions of this permit or by the transferree subscribing to
this permit in the space provided' below and thereby agreeing to comply with all terms and conditions of this permit. In addi-
tion, if the permittee transfers the interests authorized herein by conveyance of realty, the deed shall reference this permit and
the terms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or
other appropriate official.
u. That if the permittee during prosecution of the work authorized herein, encounters a previously unidentified ar-
cheological or other cultural resource within the area subject to Department of the Army jurisdiction that might be eligible for
listing in the National Register of Historic Places, he shall immediately notify the district engineer.

STRUCTURES IN OR AFFECTING NAVIGABLE WATERS OF THE UNITED STATES:
a. That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee
shall not be entitled to compensation for damage or injury to the structures or work authorized herein which may be caused by
or result from existing or future operations undertaken by the United States in the public interest. -
b. That no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the activity: authorized by this permit.
c. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law,
such lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the
expense of the permittee.
d. That the permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the
authorized structure or work, shall, without expense to the United States and in such time and manner as the Secretary of the
Army or his authorized representative may direct, restore the waterway to its former conditions. If the permittee fails to com-
ply with the direction of the Secretary of the Army or his authorized representative, the Secretary or his designee may restore
the waterway to ita former condition, by contract or otherwise, and recover the cost thereof from the permittee.
e. Structures for Small Boats: That permittee hereby recognizes the possibility that the structure permitted herein may be
subject to damage by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all
proper steps to insure the integrity of the structure permitted herein and the safety of boats moored thereto from damage by

DISCHARGES OF DREDGED OR FILL MATERIAL INTO WATERS OF THE UNITED STATES:
a. That the discharge will be carried out in conformity with the goals and objectives of the EPA Guidelines established pur-
suant to Section 404(b) of the Clean Water Act and published in 40 CFR 230;
b. That the discharge will consist of suitable material free from toxic pollutants in toxic amounts.
c. That the fill created by the discharge will be properly maintained to prevent erosion and other non -point sources of pollu-
tion.
DISPOSAL OF DREDGED MATERIAL INTO OCEAN WATERS:
a. That the disposal will be carried out in conformity with the goals, objectives, and requirements of the EPA criteria
established pursuant to Section 102 of the Marine Protection, Research and Sanctuaries Act of 1972, published in 40 CFR 220-
228.
b. That the permittee shall place a copy of this permit in a conspicuous place in the vessel to be used for the transportation
. and/or disposal of the dredged material as authorized herein.
This permit shall become effective on the date of the District Engineer's signature.

The Division of Governmental Coordination (DGC) has completed the
consistency review of your project in which you propose to modify
your existing authorized uncompleted dock facility by dredging
1,200 cubic yards from a 30 feet X 50 feet slip opening on the
west side of your facility. The dredged area would be bulkheaded
and used for a boat lift opening. On the east side of the
facility you propose to extend the bulkhead an additional 70 feet
and construct a 60 feet X 30 feet pile supported dock. A total
of 2,000 cubic yards of fill material will be pieced behind the
completed bulkhead. The completed facility will be used for ship
repair purposes. The proposed project is located in Section 32,
_ -"- Earbor, KQdiak, Alaska.
Based on our review, the Division concurs with your consistency
certification that the project is consistent with the Alaska
Coastal Management Program.
This conclusive consistency determination applies to the follow-
ing State and federal authorizations as per 6 AAC 50:
1. U. S. Army Corps of Engineers Section 404 Permit and
Section 10 Permit.
2. Alaska Department of Environmental Conservation
Certificate of Reasonable Assurance.
If changes to the original proposal are made during its implemen-
tation, you are required to contact this office to determine if a
review of the revision is necessary.

An application has been received in this office from Mr. T. T. Fuller, Box
1486, Kodiak, Alaska 99615, for a Department of the Army permit under
Section 10 of the River and Harbor Act of 1899 (30 Stat. 1151; 33 U.S.C.
403) and Section 404 of the Clean Water Act (Public Law 95 -217) to retain
unauthorized piling and complete a sheet pile bulkhead and fill and
construct a dock extension in Kodiak Harbor at Section 32, T27S, R19W,
S.M., at Kodiak, Alaska, as shown on the plans attached to this. notice.
The applicant has placed piling at the site to extend an existing dock.
The applicant now proposes to complete the unauthorized work by
construction of a 167 - foot -long sheet pile bulkhead containing 2,000 cubic
yards of upland obtained fill material. Forward of the bulkhead and
attached to an existing dock would be a 37'x60' L- shaped dock. The dock
would be constructed on treated wood piles and topped with wood decking.
A 17'x40' opening would be left for a boat lifting operation.
The unauthorized work was investigated and an after-the-fact application
was accepted for processing. This notice is being issued to solicit
comments on both the retention of the existing- piling and construction of
the remainder of the proposed work.
A Certificate of Reasonable Assurance or waiver of certification is
required for this activity under Section 401 of the Clean Water Act
(Public Law 95 -217) . This certification, or waiver thereof, is issued by
the Alaska Department of Environmental Conservation, Juneau, Alaska.
The Division of Policy Development and Planning, State of Alaska, is
reviewing this work for consistency with the approved Alaska Coastal
Management Program.
Preliminary determinations indicate the issuance of this permit is a major
Federal action not significantly affecting the human environment, and an
environmental impact statement is not required.
The evaluation of the impact of the activity on the public interest will
include application of the guidelines promulgated by the Administrator,
EPA, under authority of Section 404(b) of the Clean Water Act (Public Law,
95 -217).

The National Register of Historic Places and the latest published version
of the Federal Register have been consulted in regard to the proposed
activity. Consultation of the National Register constitutes the extent of
cultural resource investigations by the District Engineer, and he is
otherwise unaware of the presence of such resources.
Preliminary determinations indicate that the proposed activity will not
affect an endangered species or their critical habitat designated as
endangered or threatened pursuant to the Endangered Species Act of 1973
(87 Stat. 884). Formal consultation pursuant to Section 7 of the Act with
the Department of Interior or Commerce is not required for this proposed
activity.
The decision whether to issue a permit will be based on an evaluation of
the probable impact of the proposed activity on the public interest. That
decision will reflect the National concern for 6oth protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposal must be balanced, against its
reasonable foreseeable detriments. All factors which may be relevant to
the proposal will be considered; among those are conservation, economics,
aesthetics, general- environmental concerns, historic values, fish and
• wildlife values, flood damage prevention, land use, navigation,
recreation, water supply, water quality, energy needs, safety, food
production, and, in general, the needs and welfare of the people.
Any person may request, in writing, within the comment period specified in
this notice, that a public hearing be held to •consider this application.
Requests for public hearings shall state, with particularity, the reasons
for holding a public hearing.
Written statements received in this office on or before 20July 1981 will
become a part of the record and will be considered in the determination.

a. That all activities identified and authorized herein shall be consistent with the terms and conditions of this permit; and that any
activities not specifically identified and authorized herein shall constitute a violation of the terms and conditions of this permit which
may result in the modification, suspension or revocation of this permit, in whole or in part, as set forth more specifically in General
Conditions j or k hereto, and in the institution of such legal proceedings as the United States Government may consider appropriate,
whether or not this permit has been previously modified, suspended or revoked in whole or in part.

b. That all activities authorized herein shalt, if they involve, during their construction or operation, any discharge of pollutants into
waters of .the United States or ocean waters, be at all times consistent with applicable water quality standards, effluent limitations and
standards of performance, prohibitions, pretreatment standards and management practices established pursuant to the Federal Water
Pollution Control Act of 1972 (P.L. 92 -500; 86 Stat. 816), the Marine Protection, Research and Sanctuaries Act of 1972 (P.L. 92 -532,
86 Stat. 1052), or pursuant to applicable State and local law.
c. That when the activity authorized herein involves a discharge during its construction or operation, of any pollutant (including
dredged or fill material), into waters of the United States, the authorized activity shall, if applicable water quality standards are revised
or modified during the term of this permit, be modified, if necessary, to conform with such revised or modified water quality standards
within 6 months of the effective date of any revision or modification of water quality standards, or as directed by an implementaton
plan contained in such revised or modified standards, or within such longer period of time as the District Engineer, in consultation with
the Regional Administrator of the Environmental Protection Agency, may determine to be reasonable under the circumstances.
d. That the discharge will not destroy a threatened or endangered species as identified under the Endangered Species Act, or
endanger the critical habitat of such species.
e. That the permittee agrees to make every reasonable effort to prosecute the construction or operation of the work authorized
herein in a manner so as to minimize any adverse impact on fish, wildlife, and natural environmental values.
f. That the permittee agrees that he will prosecute the construction or work authorized herein in a manner so as to minimize any
degradation of water quality.
g. That the permittee shall permit the District Engineer or his authorized representative(s) or designee(s) to make periodic
inspections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in
accordance with the terms and conditions prescribed herein.
h. That the permittee shall maintain the structure or work authorized herein in good condition and in accordance with the plans and
drawings attached hereto.
i. That this permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and that it does

obviate the requirement to obtain State or local assent required by taw for the activity authorized herein.
j. That this permit may be summarily suspended, in whole or in part, upon a finding by the District Engineer that immediate
suspension of the activity authorized herein would be in the general public interest. Such suspension shall be effective upon receipt by
the permittee of a. written notice thereof which shall indicate (1) the extent of the suspension, (2) the reasons for this action, and
(3) any corrective or preventative measures to be taken by the permittee which are deemed necessary by the District Engineer to abate
imminent hazards to the general public interest. The permittee shall take immediate action to comply with the provisions of this notice.
Within ten days following receipt of this notice of suspension, the permittee may request a hearing in order to present information
relevant to a decision as to whether his permit should be reinstated, modified or revoked. If a hearing is requested, it shall be conducted
pursuant to procedures prescribed by the Chief of Engineers. After completion of the hearing, or within a reasonable time after issuance
of the suspension notice to the permittee if no hearing is requested, the permit will either be reinstated, modified or revoked.
k. That this permit may be either modified, suspended or revoked in whole or in part if the Secretary of the Army or his authorized
representative determines that there has been a violation of any of the terms or conditions of this permit or that such action would
otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective 30 days after receipt by the
permittee of written notice of such action which shall specify the facts or conduct warranting same unless (1) within the 30-day period
the permittee is able to satisfactorily demonstrate that (a) the alleged violation of the terms and the conditions of this permit did not, in
fact, occur or (b) the alleged violation was accidental, and the permittee has been operating in compliance with the terms and conditions
of the permit and is able to provide satisfactory assurances that future operations shall be in full compliance with the terms and
condiii"-s of this permit;. r (2) within the aforesaid 30 -day, eriod, the permittee requests that a ,JUblic hearing be- .`.'eld to present oral
and written evidence concerning the proposed modification, suspension or revocation. The conduct of this hearing and the procedures
for making a final decision either to modify, suspend or revoke this permit in whole or in part shall be pursuant to procedures prescribed
by the Chief of Engineers.
I. That in issuing this permit, the Government has relied on the information and data which the permittee has provided in connection
with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be false, incomplete.or
inaccurate, this permit may be modified, suspended or revoked, in whole or in part, and /or the Government may, in addition, institute
appropriate legal proceedings.
m. That any modification, suspension, or revocation of this permit shall not be the basis for any claim for damages against the
United States.
n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced, as far in
advance of the-time of commencement as the District Engineer may specify, and of any suspension of work, if for a period of more than
one week, resumption of work and its completion.

procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition t hereof, he must
restore the area to a condition satisfactory to the District Engineor.
r. That if the recording of this permit is possible under applicable State or local law, the permittee shall take such action as may be
necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility for maintaining
records of title to and interests in real property.
s. That there shall be no unreasonable interference with navigation by the existence or use of the activity authorized herein.
� That this permit may not be transferred to a third party without prior written notice to the District Engineer, eithe by the
transferee's written agreement to comply vvith all terms and conditions of this permit or by the transferee subscribing to this permit in
the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addition, if the permittee
transfers the interests authorized herein by conveyance of ea/,v. the deed shall reference this permit and the terms and conditions
specified herein and.this permit shall be recorded along with the deed with the Register of Deeds or other appropriate official.

STRUCTURES IN OR AFFECTING NAVIGABLE WATERS OF THE UNITED STATES:
a. That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee shall not
be entitled to compensation for damage or injury to the structures or work authorized herein which may be caused by or result from
existing or future operations undertaken by the United States in the public interest.
b. That no attempt shall be made by the permittee to prevent-the full and free use by the public of all navigable waters at or adjacent
to the activity authorized by this permit.
c. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law, such
lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the
permittee.
d. That the permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the
authorized structure or work, shall, without expense to the United States and in such time and mariner as the Secretary of the Army or
his authorized representative may direct, restore the waterway to its former conditions. If the permittee fails to comply with the
direction of the Secretary of the Army or his authorized representative, the Secretary or his designee may restore the waterway to its
former condition. by contract or otherwise, and recover the cost thereof from the permittee.
e. Structures for Small Boats: That permittee hereby recognizes the possibility that the structure permitted herein may be subject to
damage by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to
insure the integrity of the structure permitted herein and the safety of boats moored thereto from damage by wave wash and the
permittee shall not hold the United States liable for any such damage.
MAINTENANCE DREDGING:
a. That when the work authorized herein includes periodic maintenance dredging, it may be performed under this permit for
years from the date of issuance of this permit (ten years unless otherwise indicated);
b. That the permittee will advise the District Engineer in writing at least two weeks before he intends to undertake any maintenance
dredging. •
Dil.:CHARGEE.• OF DREDGED„OR FILL MATERIAL IN70 9\IPTERS OF HE UNITED STATES:
a. That the discharge will be carried out in conformity with the goals and objectives of the EPA Guidelines established pursuant to
Section 404(b) of the FWPCA and published in 40 CFR 230;
b. That the discharge will consist of suitable material free from toxic pollutants in other than trace quantities;
c. That the fill created by the discharge will be properly maintained to prevent erosion and other non-point sources of pollution; and
d. That the discharge will not occur in a component-of the National Wild and Scenic River System or in a component of a State wild
and scenic river system.
• DUMPING OF DREDGED MATERIAL INTO OCEAN WATERS:
• a. That the dumping will be carried out in conformity with the goals, objectives, and requirements of the EPA criteria established
pursuant to Section 102 of the Marine Protection, Research and Sanctuaries Act of 1972, published in 40 CFR 220-228.
b. That the permittee shall place a copy of this permit in a conspicuous place in the vessel to be used for the transportation and/or
dumping of the dredged material as authorized herein.
This permit shall become effective on the date of the District Engineer's signature.

otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective 30 days after receipt by the
permittee of written notice of such action which shall specify the facts or conduct warranting same unless (1) within the 30-day period
' the permittee is able-to satisfactorily demonstrate that (a) the alleged violation of the terms and the conditions of this permit did not, in
fact, occur or (b) the alleged violation was accidental, and the permittee has been operating in compliance with the terms and conditions
. of the perrnit and is able to provide satisfactory assurances that future operations shall be in full compliance with the terms and
conditions of this permit; or (2) within the aforesaid 30-day period, the permittee requests that a public hearing be held to present oral
and written evidence concerning the proposed modification, suspension or revocation. The conduct of this hearing and the procedures
for making a final decision either to modify, suspend or revoke this perrnit in whole or in part shall be pursuant to procedures prescribed
by the Chief of Engineers.
I. That in issuing this permit, the Government has relied on the information and data which the permittee has provided in connection
with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be false, incomplete or
inaccurate, this permit may be modified, suspended or revoked, in whole or in part, and /or the Government may, in addition, institute
appropriate legal proceedings.

may require authorization by the Congress or other agencies of the Federal Government.
s. That if and when the permittee desires to abandon the activity authorized herein, unless such abandonment is part of a transfer
procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition v hereof, he must
restore the area to a condition satisfactory to the District Engineer.
t. That if the recording of this permit is possible under applicable State or local law, the permittee shall take such action as may be
necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility for maintaining

u. That there shall be no unreasonable interference with navigation by the existence or use of the activity authorized herein.
v. That this permit may not be transferred to a third party without prior written notice to the District Engineer, either by the
transferee's written agreement to comply with all terms and condition -of this permit or by the transferee subscribing to this permit in
the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addition, if the permittee
transfers the interests authorized herein by conveyance of realty, the deed shall reference this permit and the terms and conditions
specified herein and this permit shall be recorded along with the deed with the Register of Deeds or other appropriate official.
The following Special Conditions will be applicable when appropriate:
STRUCTURES FOR SMALL BOATS: That permittee hereby recognizes the possibility that the structurepermitted herein may be
subject to damage by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper
steps to insure the integrity of the structure permitted herein and the safety of boats moored thereto from damage by wave wash and the
permittee shall not hold the United States liable for any such damage. ,

movement of vessels in the area.
c. That proper daymarks and lights shall be displayed at all
times.
d. That the contractor shall provide a seven day notice prior to
commencement of operations to the US Coast Guard, Captain of the Port,
Western Alaska Area, so that a local notice to mariners may be issued to
alert vessels in the area to the possible hazards.

GENERAL CONDITIONS:
a. That all activities identified and authorized herein shall be
consistent with the terms and conditions of this permit and that any
activities not specifically identified and authorized herein shall con-
stitute a violation of the terms and conditions of this permit which
may result in the modification, suspension or revocation of this permit,
in whole or in part, as set forth more specifically in General Conditions
h. or i. hereto, and that in the institution of such legal proceedings as
the United States Government may consider appropriate, whether or not this
permit has been previously modified, suspended or revoked in whole or
in part.
b. That the permittee agrees to make every reasonable effort to
prosecute the work authorized herein in a manner so as to minimize any
adverse impact of the work on fish, wildlife and natural environmental
values.
c. That the permittee agrees to prosecute the work authorized
herein- in a manner lo as to minimize any degradation of water quality.
d. That the permittee shall permit the District Engineer or his
authorized representative(s) or designee(s) to make periodic inspections
at any time deemed necessary in order to assure that the activity being
performed under authority of this permit is in accordance with the terms
and conditions prescribed herein.
e. That the permittee shall maintain the structure or work author-
ized herein in good condition and in accordance with the plans and
drawings attached hereto.
f. That this permit does not convey any property rights, either
in real estate or material, or any exclusive privileges; and that it
does not authorize any injury to property or invasion of rights or any
infringement of Federel,; State or local lawg-or regulations, nor,does
it obviate the requirement to obtain State or local assent required by
law for the activity authorized herein.
g. That this permit does not authorize the interference with any
existing or proposed Federal project and that the permittee shall not
be entitled to compensation for damage or injury to the structures or
work authorized herein which may be caused by or result from existing
'or future operations undertaken by the United States in the public
interest.
h. That this permit may be summarily suspended, in whole or in part,
upon a finding by the District Engineer that immediate suspension of the
activity authorized herein would be in the general public interest.

Such suspension shall be effective upon receipt by the permittee of a
written notice thereof which shall indicate (1) the extent of the suspen-
sion, (2) the reasons for this action and (3) any corrective or preventa-
tive measures to be taken by the permittee which are deemed necessary by
the District Engineer to abate imminent hazards to the general public
interest. The permittee shall take immediate action to comply with the
provisions of this notice. Within ten days following receipt of this
notice of suspension, the permittee may request a hearing in order to
present information relevant to a decision as to whether his permit should
be reinstated, modified or revoked. If a hearing is requested, it shall
be conducted pursuant to procedures prescribed by the Chief of Engineers.
After completion of the hearing,' or within .a - reasonable time after issuance
of the suspension notice to the permittee if no hearing is requested, the
permit will either be reinstated, modified or revoked.
i. That this permit may be either modified, suspended or revoked in
whole or in part if the Secretary of the Army or his authorized repre-
sentative determines that there has been a violation of any of the terms
or conditions of this permit or that such action would otherwise be in
the public interest. Any such modification, suspensiol. or revoc?ti:in

the Water Programs Office of the Environmental Protection Agency and /or the State water pollution
control agency having. jurisdiction to abate or prevent water pollution, including thermal or
radiation pollution. Such regulations, conditions, or instructions in effect or hereafter
prescribed by the Water Programs Office of the Environmental Protection Agency and /or the State
water pollution control agency are hereby made a condition of this permit.
(e) .That the permittee will maintain the work authorized herein in good condition !al
accordance with the approved plans.
(f) That this permit may, prior to the completion of the structure or work authorized
'herein,. by suspended by authority of the Secretary of the Army if it is determined that
suspension is in the public interest,*
(g) That this permit may at any time be modified by authority of the Secretary of the
Army if it is determined that, under existing circumstances, modification is in the
public interest.* The permittee, upon receipt.of a notice of modification, shall comply
therewith as directed by the Secretary of the Army or his authorized representative.
(h) That this permit may be revoked by authority of the Secretary of the Army if the
permittee fails to comply with any of its provisions or if the Secretary determines that,
under the existing circumstances, such action is required in the public interest.*
(i) That any modification, suspension or revocation of this permit shall not be the

(n) That if the structure or work herein authorized is not completed on or before the
31st day of December, 1976 , this permit, if not previously revoked or specifically ex-
tended,-shall cease and be null and void.

(p) That this permit does not authorize or approve the construction of particular
structures, the authorization or approval of which may require action by the Congress or
other agencies of the Federal government.
(q) That all the provisions of this permit shall be binding on any assignee or successor
in interest of the permittee.
(r) That if the recording of this permit is possible under applicable State or local law,
the permittee shall take such action as may be necessary to record this permit with the
Registrar of. Deeds or other appropriate official charged with the responsibility.for main-
taining records of title to and interests in real property.
(s) That,the permittee agrees to make every reasonable effort to prosecute the construction
or work authorized herein in a manner so as to_ minimize any adverse impact of the construction
or work on fish, wildlife and natural environmental values.
(t) That the permittee agrees that it will prosecute the construction of work authorized
herein in a manner so as to. minimize any degradation of water quality.
That the permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the authorized structure or work, shall, without expense to
the United States, at the direction of the Secretary of the Army and in such time and manner
as the Secretary or his authorized representative may direct, restore the waterway to its

structures, the authorization or approval of which may require action by.the Congress or
other agencies of the Federal government.
(q) That al]. the provisions of this permit shall be binding on any assignee or successor
in interest of the permittee.
(r) That if the recording of this permit is possible under applicable State or local law,
the permittee shall take such action as may be necessary to record this permit with the
Registrar of Deeds or other appropriate official charged with the responsibility.for main-
taining records of title to and interests in real property.
(s) That the permittee agrees to make every reasonable effort to prosecute the construction
or work authorized herein in a manner so as to minimize any adverse impact of the construction
or work-on fish, wildlife and natural environmental values.
(t) That the permittee agrees that it will prosecute the construction of work authorized
herein in a manner so as to minimize any degradation of water quality.
(u) That the permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the authorized structure or work, shall, without expense to
the United States., at the direction of the Secretary of the Army and in such time and manner
as the Secretary or his authorized representative may direct, restore the waterway to its
former condition. If the permittee fails to comply with the direction of the Secretary of
the A:my or'his authorized representative, the Secretary or his designee may restore the
waterway to ito former ccndition, by :ont..4.act or otheIwlue, and recover the cost thereof from
the permittae.

(a) 4I'hat the work shall be subject to the supervision and approval of the D s ric gineer, Engineer Department
at Large, in charge of the locality, who may temporarily suspend the work at any time, if in his judgment, the interests
of navigation so require.
(b) That any material dredged in the prosecution of the work herein authorized shall be removed evenly, and no
large refuse piles, ridges across the bed of the waterway, or deep holes that may have a tendency to cause injury to navi-
gable channels or to the banks of the waterway shall be left. If any pipe, wire, or cable hereby authorized is laid in a
trench, the formation of permanent ridges across the bed of the waterway shall be avoided and the back filling shall be
so done as not to increase the cost of future dredging for navigation. Any material to be deposited or dumped under
this authorization, either in the waterway or on shore above high - water mark, shall be deposited or dumped at the local-
ity shown on the drawing hereto attached, and, if so prescribed thereon, within or behind a good and substantial bulk-
head or bulkheads, such as will prevent escape of the material into the waterway. If the material is to be deposited in
the harbor of New York, or in its adjacent or tributary waters, or in Long Island Sound, a permit therefor must be pre-
viously obtained from the Supervisor of New York Harbor, Army Building, New York City.
(c). That there shall be no unreasonable interference with navigation by the work herein authorized.
(d) That if inspections or any other operations by the United States are necessary in the interests of navigation, all
expenses connected therewith shall be borne by the permittee.
(e) That no attempt shall be made by the permittee or the owner to forbid the full and free use by the public of all
navigable waters at or adjacent to the work or structure.
(f) That if future operations by the United States require an alteration in the position of the structure or work
herein authorized, or if, in the opinion of the Secretary of War, it shall cause unreasonable obstruction to the free navi-
gation of said water, the owner will be required, upon due notice from the Secretary of War, to remove or alter the
structural work or obstructions caused thereby without expense to the United States, so as to render navigation reason-
ably free, easy, and unobstructed; and if, upon the expiration or revocation of this permit, the structure, fill, excavation,
or other modification of the watercourse hereby authorized shall not be completed, the owners shall, without expense
to the United States, and to such extent and in such time and manner as the Secretary of War may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable capacity of the
wetercou -se. NG Olt im shall be m ^de against the United States on account of any such removal or alteration.
(g) That the United States shall in no case be liable for any aamage or injury to the structure or work herein
authorized which may be caused by or result from future operations undertaken by the Government for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
(h) That if the display of lights and signals on any work hereby authorized is not otherwise provided for by law,
such lights and signals as may be prescribed by the U. S. Coast Guard, shall be installed and maintained by and at the
expense of the owner. .
(t) That the permittee shall notify the said district engineer at what time the work will be commenced, and as far
in advance of the time of commencement as the said district engineer may specify, and shall also notify him promptly, in
writing, of the commencement of work, suspension of work, if for a period of more than one week, resumption of work,
and its completion.
(j) That if the structure or work herein authorized is not completed on or before day
of T?2Gi<.�_ ___.,19�? _, this permit, if not previously revoked or specifically extended, shall cease and be null
and void.
