the exact location of which shall be designated by the City.
2. Term. This Agreement shall be effective for a term of twelve
months commencing on the 1st day of May, 1993, and shall continue in full force and
effect until midnight the 31st day of March, 1994, unless sooner terminated as herein
provided.
3. Rent. The annual rental for the Premises subject to this lease is
Nineteen Hundred Dollars ($1,900), payable in advance in installments of $158.33 on
the first of each calendar month.
4. Use of Premises. The Premises subject to this lease shall be
utilized by the Lessee for float plane ticket sales, dispatch, waiting room and parking
in accordance with the Conditional Use Permit granted by the Kodiak Island Borough
Planning and Zoning Commission on July 20, 1988, (Case 88-039), and for no other
purpose. Furthermore, at all times during the lease period, the Lessee shall conduct
operations in accordance with all applicable federal, state, and local laws and ordi-
nances.
5. Location and Site Survey. Within the first thirty (30) days of
this Agreement Lessee shall physically locate the leased premises and provide a
survey thereof to the City. The City's approval of said location and survey shall be
presumed unless it notifies Lessee to the contrary within thirty (30) days after receipt
of the same. Lessee shall also provide a site plan and signage designating
short-term parking sufficient to comply with the conditions found in the July 21,
1988, notice from the Kodiak Island Planning and Zoning Commission granting a
Conditional Use Permit in Case 88-039.
6. Zoning and Building Code Compliance. Lessee shall be
responsible for compliance with all zoning laws, conditional use permit conditions,
building, and fire and other codes regulating the proposed use of the Premises. The
execution of this lease by the City does not constitute a representation that Lessee's
proposed use of the Premises is authorized by the applicable laws and regulations.
7. Insurance. (a) Lessee shall obtain and maintain in full force and
effect during the term of this Agreement, and any renewals or extensions thereof,
policies of insurance covering the following risks:
