Request for an exception from Section 17.13.020 (Permitted Uses) and a variance from Section 17.13.050 (Yards) to permit the construction of a community store as a second building on a lot that does not meet setback requirements; located in the C-Conservation district. (Karluk Village). Two (2) public hearing notices were mailed on November 5, 1984. 1. Applicant: Karluk Village People, Karluk, Alaska 99608. 2. Land Owner: Kana Housing Authority, Box 197, Kodiak, Alaska 99615. 3. Request: An exception from Section 17.13.020 (Permitted Uses) and a variance from Section 17.13.050 (Yards) to permit the construction of a community store as a second building on a lot that does not meet set- back requirements; located in the C-Conservation district. 4. Purpose: Construction of a community store. 5. Existing Zoning: C-Conservation. 6. Zoning History: The 1968 Comprehensive Plan does not indicate the zoning for this area. In 1977, Ordinance 77-15-0 zoned all lands within the Borough not previously classified as Conservation. 7. Location: Corner of King Avenue and Alex Brown Street. Lot 4, Block 1, Karluk Subdivision. 8. Lot Size: 10,319 square feet. 9. Existing Land Use: Community clinic and tribal council offices. 10. Surrounding Land Use and Zoning: North: Lot 3, Block 1, Karluk Subdivision. Zoning-C, Use-R1. South: King Avenue. East: Alex Brown Street. West: Lot 5, Block 1, Karluk Subdivision. Zoning-C, Use-R1. 11. Comprehensive Plan: The 1968 Comprehensive Plan does not address this area, although the draft Karluk Comprehensive Plan identifies the lot for public use. 12. Applicable (Permitted Section 17. shall be: Regulations: Chapter 17.13 (C-Conservation) Section 17.13.020 Uses) does not list stores as a permitted use. 13.050 (Yards) states that setbacks in the Conservation zone A. Front Yards. The minimum required front yard is seventy-five feet. B. Side Yards. The minimum required side yard on each side of the principle building is fifty feet. C. Rear Yard. The minimum required rear yard is seventy-five feet. There are no specific code sections that prevents multiple buildings on a small lot. A general interpretation by staff has been that the code prohibits more than one building on a lot unless specifically allowed in the. code. COMMENTS: Although this area is zoned Conservation (requiring a minimum of five acre lots) a plat creating the Karluk Subdivision with 10,000 square foot lots was approved by the Commission in 1981. Investigation of the request showed that this business will occur on a lot that has been identified in the draft Karluk Comprehensive Plan for 'Public Lands'. This lot is also the site of the community Post Office, clinic and tribal coun- cil offices. Although commercial stores are not a permitted use in the Conservation or Public Lands districts, this store will be owned and operated by the Tribal Council on behalf of the village. It seems strange that now a Comprehensive Plan has been prepared for Karluk, there is a desire to construct a building that may be contrary to the plan. There is vacant land identified for business use near this lot. Numerous phone calls to Karluk have been unsuccessful in reaching someone to discuss this request.. Before the request is acted upon, a conversation with the Tribal Council on how this case fits in with the "draft" Karluk Comprehensive Plan is needed. RECOMMENDATION:, Staff recommends that this case be tabled until conversations can be held with the Tribal Council and the confusion between this request and the draft Com- prehensive Plan is resolved. Rezoning the subdivision to reflect the approved plat and the Karluk Comprehen- sive Plan is appropriate once the plan has been officially adopted.
