Request for a variance from Section 17.13.050 (Yards) of the Borough Code to permit a public facility (Karluk Public Safety Building) to encroach 50 feet into the required 75 foot front yard setback and encroach 25 feet into the required 50 foot side yard setback in a Conservation Zoning District. Tract C, Karluk Subdivision. (Kodiak Island Borough /Koniag, Inc.) Dear Bud: The Kodiak Island Borough Planning and Zoning Commission at their meeting on December 17, 1986, granted your request for the variance cited above and adopted the following findings of fact in support of their decision: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. The unique physical condition applicable to the property and intended use of development is the topography of the lot. The intended use of development is to develop pedestrian access to the facility from Karluk Avenue and vehicular access of Nunaliak Street. Utilizing a 25 foot rather than 75 foot front yard setback of Karluk Avenue will result in a shorter pedestrian ramp with a minimum change in grade (2 feet). Utilizing a 25 foot rather than a 50 foot side yard setback will minimize the length of driveway construction. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of -the zoning ordinance would not allow the structure to be sited as desired. This would result in unnecessary hardships of the need for additional fill and increased construction costs that will jeopardize building the public safety facility within the available budget. Compliance with setbacks also presents the practical difficulties of a longer driveway and a longer and steeper pedestrian ramp. Kodiak-Is and Borough Bud Cassidy December 18, 1986 Page Two . The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety and welfare. Granting of this variance will not result in material damage or prejudice to other properties in the area. Allowing the structure to encroach into the front and side yard setbacks will not interfere with safe traffic flow or set a precedent for other properties in the area as others already generally have greater setback encroachments than proposed for the subject property. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. Granting of the variance will not be contrary to the objectives of the Karluk Comprehensive Plan because the plan does not address minor aspects of developments such as building setbacks. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. Actions of the applicant have not caused the conditions from which relief is being sought by a variance. The variance will be decided prior to construction of, the building. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Public facilities are permitted in the C-- Conservation Zoning District. THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. You must first obtain zoning compliance and /or a building permit. Please contact this office for further details. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the Borough Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Kodiak Island Borough Bud Cassidy December 18, 1986 Page Three Commission's decision will not be final and effective until ten days following the decision. Failure to utilize this variance within 12 months after its effective date shall cause its cancellation. Karluk Tribal Council B. Granting of the variance will not be contrary to the objectives of the Comprehensive Plan because signs are customarily used to identify business establishments and comprehensive plans do not generally address minor developments such as signs. 5. In this instance, actions of the applicant have not caused the conditions from which relief is being sought by a variance. The variance request will be decided prior to erection of the sign. B. The minimum required front yard is seventy-five feet. B. Side Yards. The minimum required side yard on each side of the principal building is fifty feet. COMMENTS: The purpose of this request is to allow the Karluk Public Safety Building to encroach 50 feet into the required 75 foot front yard setback and 25 feet into the required 50 foot side yard setback. These encroachments would locate the structure 25 feet from the Karluk Avenue and Nunaliak Street rights-of-way. In order for the Commission to grant a variance, all of the following conditions must be satisfied: 1. Utilizing a 25 foot rather than 75 foot front yard setback of Karluk Avenue will CASE 86-088 2 DECEMBER 17, 1986 P&Z ITEM VI-H result in a shorter pedestrian ramp with a minimum change in grade (2 feet). Utilizing a 25 foot rather than a 50 foot side yard setback will minimize the length of driveway construction. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the zoning ordinance would not allow the structure to be sited as desired. This would result in unnecessary hardships of the need for additional fill and increased construction costs that will jeopardize building the public safety facility within the available budget. That the granting of the variance will not permit a prohibited land use in the district involved. Public facilities are permitted in the C--Conservation Zoning District. RECOMMENDATION: Staff finds that this request does meet all the conditions necessary for a variance to be granted under Chapter 17.66 (Variance) of the Borough Code. CASE 86-088 3 DECEMBER 17, 1986 P&Z ITEM VI -H APPROPRIATE MOTION: Should the Commission agree with the staff recommendation, the appropriate motion is: Move to grant a request for a variance in accordance with Section 17.13.050 of the Borough Code to permit the Karluk Public Safety Building to encroach 50 feet into the required 75 foot front yard setback and 25 feet into the required 50 foot side yard setback in a C--Conservation Zoning District on Tract C, Karluk Subdivision and to adopt the findings contained in the staff report dated December 4, 1986 as "Findings of Fact" for this case.
