VII PUBLIC HEARINGS F. Ord. No.. 80 -13 -0 Amending the Comprehensive Land Use Plan•Effect.ing Certain Lands Within the Borough (2nd Reading'). <s Mr. Ogg moved to adopt Ord. No. 80 -13 -0. Seconded by Mr. Peotter. Regular Session closed: Public Hearing opened: Roberta Lockman, Girl Scouts, spoke against the ordinance. Originally applied for seventy -one acres in 1971 near the Beaver Lake Area for a Girl Scout campsite. Applied9to- :P.• &:Z7 and -,the Borough : i n .1974 forethi s .l and t and!.theyragreed :i;o give the Girl Scouts a lease to fifteen acres of the land with a park & recreation area surrounding it. The borough agreed to obtain the lease to the land and in turn follow through with the Girl Scout lease. In 1980, P & Z gave some of this land to the Mental Health Center and started proceed- ings to zone portions of the area, including portions of the fifteen acres, industrial. The zoning of service recreationr.i. and the promised lease were ignored. Meg Miller, neighborhood chairman for the Kodiak Girl Scouts, received a letter in March from BLM stating that the property; USS 3467, according tb • their -crecordslididt.notvhaveu a,::usei• permit issued. BLM stated that the State of Alaska applied for the land involved under Serial #A056380 and has received tentative approval for the area. After the State receives tentative approval for the area, BLM has no authority to authorize the issuance of a permit on these lands. The State of Alaska, Dept. of Natural Resources, said that the land in question was selected by the municipality as part of the entitlement= r • for the statehood act. I'don't wish to see the borough take action on it until it is determined who does have control over the property. And if the borough does have control over it, seems they should honor the original intent to enter lease agreement with the Girl Scouts. If they do honor the lease, zoning the surrounding area should be compatible for that use. As just a citizen, I feel that we should maintain a certain amount of area within the municipal area that is recreational. Wallin A quorum was established. III ACCEPTANCE OF AGENDA Mayor Wallin suggested that Item A under OLD BUSINESS be deleted. from the agenda.. Mr. Ogg so moved. Seconded by Mr. Peotter. Unanimous roll call vote. Mr. Ogg moved to add Executive Session for discussion of personnel as the first item at the beginning of the meeting. Seconded by Mr. Herrnsteen. Motion failed 3 -3 with Mr. Anderson, Mr. Cannon and Mr. Jack casting the NO votes. IV MINUTES OF PREVIOUS MEETINGS A. Assembly - Regular - March 11, 1980 Mr. Ogg moved for acceptance of Item A. Seconded by Mr. Peotter. Mayor Wallin noted a correction on page 1, under Item II the words however, Mayor Wallin so ordered that he be excused should be deleted. Mr. Peotter noted on page 4, Item IX (2), the last word on the fourth sentence should read portion. The minutes as presented with the corrections were accepted by unanimous roll call vote. Letter from Ginny Chitwood re: Status & Potential of Local Transportation Ginny Chitwood, Executive Director of Alaska Municipal League, Pete Eakland, Transit Consultant and Lloyd Robinson, Dept. of Transportation appeared before the assembly to find out what the thoughts are on public transit for Kodiak and possibly to explore some of the options if interested. Mrs. Crowe moved to grant a variance to Permit the construction of a shoo building on a temporary foundation which will project approximately four (4) feet into the second street side yard on a corner lot on lot 26, block • 3, Erskine subdivision in an R -3 zoning use district with the provisions that the applicant put on his application be meet with the exception of the siding in that it should be similar to the house and that the four conditions of the variance have been met. Seconded by Fir. Perez. Motion PASSED with a 6 -1 vote, Mr. Baker voted NO and Mr. Ball, Mrs. Crowe, Mr. Hill, Mr. Erwin, Mr. Perez and Mr. Pugh voted YES. (Mr. Baker stated why he voted No, as he • felt that there was enough room to build the structure without a variance) 3. Z -80 -006. A petition for a variance from the requirements of Title 17, - sections 17.18.040 B -1 and 17.18.040 C to permit the construction of a - shop addition to an existing dwelling structure. The proposed addition will project approximately three (3) feet into a six (6) foot required yard. The existing house and proposed addition will also project approximately fifteen (15) feet into the required rear yard on lot 5, block 3, Island Lake Subdivision in an unclassified zoning use district. (Ross Kendall) STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum prepared by the planning department. Mr. Pugh closed the regular meeting and opened the public hearing. Mr. Kendall - spoke in favor of the request. Mr. Kendall pointed out an error in typing. Explains that you enter the house from the side so there is about four (4) feet to spare. Stated that this fall after fishing he and his brother built the shop and did not think anything about,getting a building permit until a neighbor asked him if he had a permit. Had to get a variance as I am closer than six feet to the side yard. Realized he would have to move a wall as he is closer than he thought to the side yard. Asked for a variance to move the wall in three feet rather than the full six feet. Mr. Hill questioned Mr. Kendall Did you know you were building on the propertyline? Mr. Kendall no, but I knew I was close. Mrs. Arndt - against the request as building was built without a permit. Questions easements, side yard requirements etc.. She feels that every- one should obey the rules that the Borough has or you should not grant any of the variances if they are built without permits. Mr. Gordon - explained how he found out about the shop of Mr. Kendall's. Noticed the shed so he went and talked to Mr. Kendall about a building permit. Was in a hurry after fishing to work on his gear and is just now appling for a variance. Discussion between Mr. Kendall and the Commission about relocating the front entrance. Mr. Pugh closed the public hearing and reopened the regular meeting. Discussion between Mr. Milligan and the Commission on alternative locations for the shop. Mr. Baker - Given the position that I took a few minutes ago on Mr. Waller's variance I obviously have problems with this variance. For the fact that we have a side yard violation and the fact that we are appling for a variance after the fact. It would appear to me obviously that other approaches probably would have been more expensive but at this point I think we are talking about another approach possibly and if We are going to have to infact remove a portion of this building I would suggest that be done and that we approach this from another standpoint. Mrs. Crowe moved to recommend to the Borough Assembly that they adopt an Ordinance changing the name of the zoning district that is now called "Unclassified" to "Rural Residential" but that the Assembly do not change any of the provisions within that land use classification pending our recommendations with the new zoning Ordinance. Seconded by Mr. Hill. Motion PASSED with a 6 -1 vote with Mr. Erwin voting NO and Mr. Baker, Mr. Ball, Mrs. Crowe, Mr. Hill, Mr. Pugh and Mr. Perez voting YES. Mrs. Crowe moved that the Commission recommend to the Borough Assembly for the adoption of the amendments that are included in the Kodiak Island Borough Zoning Ordinance on off - street parking requirements as discussed tonight with the corrections on ;I9 being for every three guest rooms as opposed to six, #14 was to have read but not less than five parking spaces with a minimum of seven and #15 mini - warehouses would be reouired to have one parking place per storage unit. Z -80 -006 A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COM- MISSION DENYING A VARIANCE ON LOT 5, BLOCK 3, ISLAND LAKE SUBDIVISION. (Ross Kendall) WHEREAS, a petition was received requesting a variance to permit the :construction of an addition to an existing non - conforming structure which would project three feet into a required six foot side yard. And; WHEREAS, notice was published, notices were mailed and a public hear .ing was held. And; WHEREAS, the Commission found the applicant had constructed the addition without benefit of a building permit and said addition virtually abates the required six (6) foot side yard. And; WHEREAS, the Commission found the applicant proposed to reduce the side yard encroachment from approximately six (6) feet to three (3) feet if the variance was granted. And; WHEREAS, the Commission found the applicant could construct an accessory building on the property in a conforming location. And; WHEREAS, the Commission found Alaska State Statutes Title 29 section 29.33.110 (c) prohibits the granting of a variance based on special conditions resulting from the action of the applicant or for reasons of pecuniary hardship or inconvenience. And; WHEREAS, the Commission found granting of the variance would not be 'consistant with the objectives and intent of the Comprehensive Plan.
