Box 2 Tennants Harbor, ME 04860 RE: Open -to -Entry ADL 61320 Dear Ms. Park, • PROPERTY ASSESSMENT AND MANAGEMENT DEPARTMENT In answer to your letter of October 16, 1978 regarding the taxing procedures on Open -to -Entry lands, I will begin by explaining that you are being taxed on the possessory in- terest you hold. The reason for the date differential is that your possessory interest was taxed on the supplemental tax roll as opposed to the original tax roll. This merely indicates that the Assessor did not have your tax assessment prepared for the dead -line date on the original roll and therefore included the assess- ment on the supplemental roll. Since this is a supplemental roll the due dates are later. I do not know who gave you to understand that there would be no taxes as that is not the case. You are being taxed on the possessory interest which indicates that you in fact hold the property as though you were the owner, using that property (or not using that property) as you see fit. However, since you do not hold clear title to the property until a survey is approved the assessment does not in any way reflect the true market value of the property itself. Only the value put on your possession of the land is being assessed. The due date for the 1st installment was October 15, 1978,be- coming delinquent November 15, 1978. If the first installment is not made before the delinquent date the entire tax becomes delinquent. Second installment is due November 15, 1978. I have included a copy of the page of the Kodiak Island Borough Municipal Code pertaining to taxing of possessory interest as cited in KIB Municipal Code Capter 3.20.030B. The KIB Municipal Code cites Alaska State Statutes 29.33.030,29.48.170 and Chapter 29.53. If you should have any further questions please do not hesitate to contact this office.
