KODIAK ISLAND BOROUGH Assembly Regular Meeting February 19, 2015 A regular meeting of the Kodiak Island Borough Assembly was held on February 19, 2015, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. The invocation was given by Major Michael Bates of the Salvation Army, Mayor Friend led the Pledge of Allegiance. Present were Mayor Jerrol Friend, Assembly members Carol Austerman, Aaron Griffin, Lany LeDoux, Chris Lynch, Frank Peterson, Dan Rohrer, and Rebecca Skinner. Also present were Borough Manager Bud Cassidy, Borough Assessor Bill Roberts, Community Development Director Bob Pederson, Engineering and Facilities Director Bob Tucker, Finance Director Karl Short, Borough Clerk Nova Javier, and Deputy Clerk Jessica Kilborn. APPROVAL OF AGENDA AND CONSENT AGENDA LEDOUX moved to approve the agenda and consent agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES Regular Meeting Minutes of January 8 and January 22, 2015 and Special Meeting Minutes of January 29, 2015,were approved under the consent agenda. AWARDS AND PRESENTATIONS Manager Cassidy presented the Employee of the Year Award for 2014 to Dave Conrad, Construction Inspection/Engineer in the EngineeringlFacilities Department, Mayor Friend proclaimed the month of February 2015 as National Teen Dating Violence Awareness and Prevention Month. Kodiak Seafood and Marine Science Center Seafood Marketing Specialist Quentin Fong provided a presentation to the Assembly on the purpose, services, and contributions of the facility to the Kodiak Community. Finance Director Short provided a Finance Department update to the Assembly. Finance Director Short presented the Comprehensive Annual Financial Report (CAFR) to the Assembly for review. CITIZENS'COMMENTS Neil Cower spoke on the code revision project and spoke to the need for public trust of elected officials. Kyle Crow spoke on the budget report presented and spoke on concerns regarding economic effects to the community. He also spoke in opposition of Resolution No. FY2015-17. Judi Kidder expressed concerns with the budget report. Lenny Roberson thanked the Assembly members for listening to the concerns of the community and urged the Assembly to continue to represent the community. Betty MacTavish spoke in support of Senate Bill No. 1 and Resolution No. FY2015-17, both regarding smoke-free workplaces. COMMITTEE REPORTS None. PUBLIC HEARING None. BOROUGH MANAGER'S REPORT Manager Cassidy reported on the following items: • Staff was busy compiling the packets for the meetings with the Legislature and Lobbyist in Juneau, February 24-26. The issue of the replacement vessel for the Tustumena would be included. • Staff was compiling the departmental budgets for fiscal year 2016. MESSAGES FROM THE BOROUGH MAYOR Mayor Friend congratulated Dave Conrad for receiving the Employee of the Year award. He briefly addressed rumors regarding the code revision project. Resolution No. FY2015-17 Supporting a Law in Alaska to Make All Workplaces 100% Smoke Free to Protect the Health and Safety of All Workers and Visitors From the Dangers of Secondhand Smoke. GRIFFIN moved to adopt Resolution No, FY2015-17. Betty MacTavish requested the resolution. Assembly member Griffin was the sponsor of the resolution which supported a law in Alaska to make all workplaces 100% smoke free in order to protect the health and safety of all workers and visitors from the dangers of secondhand smoke. Backup information was provided in the packet regarding Senate Bill No. 1 "An Act Prohibiting Smoking in Certain places; Relating to Education on the Smoking Prohibition; and Providing for an Effective date." The requestors urged the Assembly to adopt the resolution to support the lobbying efforts supporting Senate Bill No. 1. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Austerman, Griffin, LeDoux, Lynch, Peterson, Rohrer, and Skinner. 2. Resolution No. FY2015-18 Adopting an Alternative Allocation Method for the FY15 Shared Fisheries Business Tax Program and Certifying That This Allocation Method Fairly Represents the Distribution of Significant Effects of Fisheries Business Activity in FMA 13: Kodiak Island, LEDOUX moved to adopt Resolution No. FY2015-18. The resolution would allow the Borough to submit its application for the FY15 Shared Fisheries Business Tax Program using an alternative method. The resolution, indicating approval of the application,was a required portion of the application. This year, the different cities in the Borough had been working to develop a simpler method to allocate the FY2015 Shared Fisheries Business Tax Program. In FY2014, $141,182 was divided up among the various cities and the Borough. In FY2015,the total allocation would be$94,680. To prepare the standard"long"form would take considerable staff time of all of the cities and the Borough. For FY2015, staff proposed that the FY2015 Shared Fisheries allocation be based on the population of each of the cities and the Borough's would be the total population of the Borough, less the population of each of the cities. Resolution No. FY2015-19 Adopting a Federal Capital Improvement Program and Identifying Federal Program Priorities for Federal Fiscal Year 2016. LYNCH moved to adopt Resolution No. FY2015-19. The resolution designated the Borough's federal legislative funding priorities for federal fiscal year 2016. The Borough would forward the list to its congressional delegation in hopes of having the federal government provide part or all of the funding needed to complete the projects and support the programs that were identified as priorities in the community. Confirmation of the Mayoral Appointment to the Parks and Recreation Committee (Mamie Leist).This item was approved under the consent agenda. There were four at-large vacant seats on the Parks and Recreation Committee; one seat would expire December 31, 2016 and three seats would expire December 31, 2017. On January 26, the Clerk's Office received an application from Ms. Mamie Leist indicating her desire to be appointed to one of the vacant seats on the board. The Assembly confirmed the Mayoral appointment of Ms. Leist to the Parks and Recreation Committee for a term to expire December 31, 2017. CITIZENS' COMMENTS Neil Cooper urged the Assembly to make a public declaration regarding the direction of the code revision project. Judi Kidder spoke to the Safe Route to Schools Program and urged the Assembly to consider possible funding for the program. Betty MacTavish thanked the Assembly for its support on Resolution No. FY2015-17. Kyle Crow spoke to the concerns on the code revision project and the position of the Assembly on the project. He offered his services to assist with the needs of the code revision project. EXECUTIVE SESSION 1. Attorney Client Privilege Communications to Discuss Litigation, and Trial Strategy and Tactics: Wren's Appeal from Board of Adjustment, Markham's Appeals from Board of Equalization, Red Hook Settlement, and Stephens vs. Brooking/Selby Litigation. ROHRER moved to convene into executive session to discuss litigation, and trial strategy and tactics regarding Wren's Appeal from Board of Adjustment, Markham's Appeals from Board of Equalization, Red Hook Settlement (Contract Dispute), and Stephens vs. Brooking/Selby Litigation (APOC Complaint). ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Lynch, Peterson, Rohrer, Skinner, Austerman,Griffin,and LeDoux. ROHRER moved to invite the Borough Assembly, Borough Manager, Borough Attorney via teleconference, and Clerk's Office Staff into executive session.Assessor Roberts was invited to Kodiak Island Borough Assembly Regular Meeting Minutes February 19,2015 Page 4 'Regular Meeting Minutes of February 19 and March 5, 2015. After the vote, Mayor Friend recessed the regular meeting at 9:21 p.m. and convened the executive session. Upon returning from the executive session, Mayor Friend reconvened the regular meeting at 11:15 p.m. and announced no action was to be taken as a result of the executive session; however, direction was given to the Borough Attorney regarding the Stephens vs. Brooking/Selby litigation (APOC complaint). ASSEMBLY MEMBERS'COMMENTS Assembly members Austerman, Lynch, and Peterson congratulated Employee of the Year award recipient Dave Conrad. Assembly members Austerman, Lynch, Peterson, Rohrer, and Skinner thanked Mr. Quentin Fong for the presentation on the Kodiak Seafood and Marine Science Center. Assembly members LeDoux and Skinner thanked Finance Director Short for his presentations, Assembly members Peterson, Rohrer, and Skinner invited the public to attend the joint work session with the Planning and Zoning Commission scheduled on Thursday, March 12 at 7:30 p.m., to alleviate rumors regarding the Code Revision Project. Assembly member Peterson expressed the intention was to work with the current code to benefit the Kodiak community. Assembly member Skinner, as the Kodiak Island Borough School District Budget Review Committee representative, reported on the School District's budget review session on February 14 and noted the next step was to produce a draft budget for the Assembly's review. Announcements The Mayor, Members of the Assembly, and Borough staff would be traveling Wednesday, February 24 through Friday, February 27,for lobbying purposes in Juneau. The next Assembly work session would be held on Thursday, February 26 at 7:34 p.m. in the Borough Conference Room. The next regular meeting was scheduled on Thursday, March 5 at 7:30 p.m. in the Borough Assembly Chambers. The Mayor and Members of the Assembly would be traveling Tuesday, March 4 through Friday, March 6,to attend the Southwest Alaska Municipal Conference Annual Meetings in Anchorage. The meeting was called to order at 7:30 p.m. The invocation was given by Major Michael Bates of the Salvation Army. Assembly member Lynch led the Pledge of Allegiance. Present were Assembly members Aaron Griffin, Chris Lynch, Frank Peterson, and Rebecca Skinner. Also present were Borough Administrative Official Bill Roberts, Borough Clerk Nava Javier, and Assistant Clerk Angela MacKenzie. GRIFFIN moved to excuse Assembly members Carol Austerman and Dan Rohrer who were absent due to personal leave and Larry Leroux and Mayor Friend who were absent due to their attendance to the Southwest Alaska Municipal Conference (SWAMC) in Anchorage. AWARDS AND PRESENTATIONS Assembly member Lynch proclaimed that Kodiak was a municipality that did "Choose Respect" and asked that all residents join in standing up against these crimes, and create a movement across the country that would restore a culture of respect and action for future generations. Assembly member Lynch proclaimed the month of March 2015 as National Women's History Month and urged residents to increase their knowledge and appreciation of the valuable role women play in our lives. Assembly member Lynch presented the Student of the Month Award for February 2015 to Polly Ashouwak, a senior at Old Harbor School. PUBLIC HEARING None, BOROUGH MANAGER'S REPORT Administrative Official Roberts reported on the following: • SWAMC was dealing with state budget issues involving the Alaska Marine Highway. + Kodiak State Recorder's Office was being considered for closure by the Alaska Department of Natural Resources. Resolution No. FY2015-21 Adopting the Kodiak Island Borough Strategic Plan for the Years 2015-2020. PETERSON moved to adopt Resolution No. FY2015-21. A strategic plan consisting of priorities of the Borough was needed to guide the budget process and ensure that the Assembly clearly communicated its priorities to Borough staff and the public. A strategic planning meeting was held on Saturday, January 17, 2015 to determine the priorities for the Borough. The Assembly identified four strategic directions and seven 2015 priorities for its strategic plan and desires to adopt these by resolution. The resolution was proposed to adapt the Strategic Plan for the years 2015-2010 and it also directed Borough staff to develop action plans on the seven 2015 priorities and in a period of six months and/or a year and submit performance measure reports on how these priorities were addressed. Resolution No. FY2015-20 Approving the Village of Karluk and its Native Village Council to Participate in the FY2016 Community Revenue Sharing Program. Page 11 of 519 AGENDA ITEM #5.A, The resolution identified Karluk as an unincorporated community that met the Community Revenue Sharing Program eligibility criteria established under AS 29.60.565, AS 29.60.879 and 3 AAC 180.110. Ordinances for Introduction None. Other Items 1. Approval of Additional Expenditures Associated with Purchase Order No. 2015-00000002 for Survey Work in Service Area No. 1. GRIFFIN moved to authorize the Manager to approve additional expenditures that exceeded the Manager's authority associated with Purchase Order No. 2015-00000002 with St. Benny Surveying, Inc. for surveying work in Service Area No. 1 in the amount of$1,224, and to allow the Service Area No. 1 Board Chairperson to continue to work with St, Denny Surveying Inc. to complete the survey work for Service Area No. 1 for the current fiscal year in the additional amount of$12,000,for a total purchase order amount not to exceed$32,224. Service Area No. 1 Chairperson Scott Arndt was working with other entities to solve some culvert and flooding issues within the Service Area. In doing so, he requested the elevations of the culverts be surveyed in addition to the other surveying he had already requested. Purchase order#2015-2 was originally issued for$23,000 with St. Denny Surveying. Due to the reasons stated in the memo attached to the packet, the limit had been exceeded by $1,224. Chairperson Arndt was also asking for an additional $12,000 to complete the surveying work through June 30, 2015. The request would go beyond the Manager's authority of $25,000 per KIBC3.30.020. The work would be performed under professional services and would not need to go out to bid. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Lynch, Peterson, Skinner, and Griffin. 2. Approval of Additional Expenditures Associated with Purchase Order No. 2015-00000023 Survey Work for the Landfill Subdivision Tract. SKINNER moved to authorize the Manager to approve additional expenditures that exceeded the Manager's authority associated with Purchase Order No. 2015-00000023 with Kodiak Land Surveying for survey work for the landfill subdivision tract in the amount of $8,845, for a total purchase order amount not to exceed$25,965. The Borough Resource Manager worked with Kodiak Land Surveying performing survey work at the landfill. The work performed would do the following: 1. Survey the landfill tract and subdivide into two parcels. 2. The parcel boundary would follow zoning boundaries agreed upon by the Borough staff and residents of Monashka Subdivision. 1 One lot would contain the improvements associated with the landfill and waste water treatment plant and would be zoned I-Industrial. Page 12 of 519 AGENDA ITEM #5.A. 4, The second parcel would be zoned NU-Natural Use and would have a restricted use consistent with the uses found in the code. 5. The subdivision also vacated State of Alaska section line easements that provided public access in the landfill.The vacation would restrict general public access into the landfill. 6. The new survey also addressed some technical issues that were discovered in the previous survey. The original Purchase Order amount of $19,050 was exceeded due to additional work associated in resolving technical issues associated with errors from previous survey work. The original survey work was performed for$17,120. Work on correcting the technical issues raised the total project cost to $25,965, which was beyond the $25,000 authority of the Borough Manager under K1BC 3.30.020 Limitation on the manager's authority. GRIFFIN moved to confirm the Mayoral appointment of Mr. Greg Spalinger to the Planning and Zoning Commission for a Borough term to expire December 31, 2017. There was currently one vacant Borough seat on the Planning and Zoning Commission for a term to expire December 31,2017. The Clerk's Office received applications from the following: Kyle Crow February 5,2015 Steven Neff February 5, 2015 Greg Spalinger February 11, 2015 Jasha Zbitnoff February 20, 2015 Mayor Friend requested that the Assembly confirm his appointment of Mr. Greg Spalinger for the Borough seat with a term ending December 31,2017. ROLL CALL VOTE ON MOTION FAILED TWO TO TWO: Skinner and Peterson (Ayes); Griffin and Lynch (Noes). 4. Confirmation of the Mayoral Appointment to the Architectural/Engineering Review Board (Steven Neff). GRIFFIN moved to confirm the Mayoral appointment of Mr. Steven Neff to the ArchitecturalfEngineering Review Board for a term to expire December 31, 2017. There was currently one vacant seat on the Architectural/Engineering Review Board for a term to expire December 31, 2017. On February 5, 2015, the Clerk's Office received an application from Mr. Steven Neff for the Planning and Zoning Commission. Confirmation of the Mayoral Appointment to the Parks and Recreation Committee (Dale Stratton). PETERSON moved to confirm the Mayoral appointment of Mr. Dale Stratton to the Parks and Recreation Committee for a term to expire December 31,2017. There were currently three seats on the Parks and Recreation Committee; one for a term to expire December 31, 2016 and two for terms to expire December 31, 2017. The Clerk's Office received one application from Mr. Dale Stratton on February 10,2015, Mayor Friend requested that the Assembly confirm his appointment of Mr. Dale Stratton. Authorization for a Letter of Support for the Alaska Department of Fish and Game's Grant Proposal to the Office of Subsistence Management(OSM). GRIFFIN moved to authorize.the Mayor to sign the letter of support for the Alaska Department of Fish and Game's grant proposal to the Office of Subsistence Management. The letter of support was requested for an ADF&G grant proposal which would be submitted to the Office of Subsistence Management(OSM). FUNDS AVAILABLE: Yes Account Number. 460-533 452.150 Amount Budgeted: $0 10021.513.17 SUMMARY STATEMENT: Kodiak Island Borough code 3,30.100 Change Orders--Manager Authority requires Assembly approval for a change order exceeding$200,000. The scope of the Kodiak High Addition and Renovation project includes demolition of half of the existing Learning Center building to allow for parking and traffic through the new main entrance.This building was constructed in 1968 and is known to have asbestos containing materials such as fireproofing and floor mastic.The abatement of this existing material was shown on the design documents and included in the contract for Watterson Construction. However, during this abatement work it was discovered that the concrete block exterior walls contain vermiculite insulation, which is an asbestos contaminated material.This was not shown on any existing drawings or documentation, and there was no way to know it was there prior to starting demolition activities. Upon discovery of the vermiculite KIB project management staff worked with Jensen Yorba Lott architects, 1=HS-Alaska Environmental Consulting,Watterson and their subcontractors to come up with a plan for abatement. Because of the qualities of the material and it's location in the cells of the concrete block, removal and containment requires a lot of hand work and is very time consuming. Watterson has submitted a change order request in the amount of$210,169. Staff is recommending approving this change order an a time and materials basis, not to exceed $210,169. In addition, the equipment on site for demolition of the building is currently sitting idle, and Watterson has stated that once this change order is resolved and they are notified to proceed with abatement of the vermiculite, an additional change order request will be submitted for$2,053 per day that the demolition has been delayed. It is imperative that this change order is resolved to keep down the delay costs. The construction contingency for the project is currently$2,136,686. There are adequate contingency funds to pay for the work required by this unforeseen condition. Line Striping of Paved Roads Chair Arndt reported that Line Striping had not begun because the road wort; on Spruce Caps: was contributing to tracking mud onto roads to be striped. Thick pollen and the anticipation of rain were also factors in postponing the striping. The plan was to start on Saturday, May 31, 2014. B. Update on continued clearing of Road Right A Ways Chair Arndt reported that clearing of the road right a ways was about two thirds done. The survey work was to ascertain that the clearing was only in the right a ways and not primate property. C. Purchase of Road Salt Chair Arndt stated that John with Round Bette was contacted regarding a quote for Road Salt, and he assured Borough staff the quote would be the same price quoted the City of Kodiak.Chair Arndt discussed with the Board the ordering of 90,000 tbs. of Road Salt.
