Re: Case 15 -011. Request for conditional use permit for non - recreational mineral extraction
activities (gravel extraction) on a C- Conservation zoned parcel (KIBC
17.200.010 and 17.50.040.F).
Dear Ms. Micolichek:
The Kodiak Island Borough Planning and Zoning Commission at their meeting on January 21,
2015 granted the conditional use permit request cited above, subject to the following conditions:
1. With the exception of the driveway section, a twenty -five (25) foot wide path of natural
vegetation extending inward from the outer boundaries of the parcel shall be retained to
provide for sufficient setbacks, buffers, and other safeguards between the extraction site
and the surrounding area.
2. Once material from the extraction site has been exhausted, the area shall be re- vegetated to
blend in with the surrounding area to the maximum extent possible.
3. Permanent signs shall be posted to warn drivers of the potential for trucks entering and
exiting the roadway along the affected section of West Rezanof Drive. Such signs must be
approved by the Alaska Department of Transportation and Public Facilities.
4. Material extraction from this site shall not be limited to any specific quantity per year.
THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. Zoning compliance
and /or a building permit must first be obtained. An approved conditional use permit must be
permitted within a two -year period to be valid. Please contact this office for further details.
According to KIBC 17.200.080:
The commission's action may be appealed to the assembly by any party by filing a written
notice of appeal with the Borough Clerk within twenty (20) calendar days of the Commission's
decision. The notice of appeal must state the specific grounds for the appeal and the relief
sought by the appellant, and is accompanied by the $350 appeal fee. Therefore, the
Commission's decision will not be final and effective until twenty (20) days following the
decision.
This letter shall constitute the conditional use permit. Please bring it when you come to our
office to obtain zoning compliance for any construction on the property.
The Commission adopted the following findings in support of their decision:
FINDINGS OF FACT
1. The conditions of approval should ensure the gravel extraction site operates with no
negative impacts to the value, spirit, character, and integrity of the surrounding area or harm
to the public health, safety, convenience, or comfort.
2. The conditional use satisfies all requirements of the C- Conservation zoning district.
3. The conditions of approval should provide for sufficient setbacks, buffers, and other
safeguards between the extraction site and the surrounding area.
4. This conditional use permit is not for a public use or structure.

A copy of this Approval to Construct (ATC) must be on site during construction of the access.
If any of the conditions of this ATC are violated, the State reserves the right to require the
removal of all activities from the area.
The contractor is required to obtain Lane Closure Permits for work within State right of way.
This ATC is not a property right but a temporary authorization, revocable by the State upon
violation of any provision or special conditions, or for other reasons. All reasonable attorney's
fees and costs associated with legal or enforcement actions related to the terms and conditions of
this ATC will be borne by the Owner.
Department of Transportation Utility Pen-nits (or amendment, as appropriate) are required for
relocation or adjustment of any utilities within the State right of way.
A driveway constructed under permit within a highway right of way is the property of the State,
but all cost and liability arising from the construction, operation, or maintenance of a driveway
or approach road is at the sole expense of those lands served. The Department is not obligated to
change its maintenance practices to accommodate a driveway or approach road constructed
under a permit, or to incur any additional expense removing snow berms or other obstructions
from a driveway or approach road within a right of way resulting from the Department's
activities, or activities under a permit issued under 17 AAC 15 (Utility and Railroad Permits).

Extraction Plan
Rezonof Drive Material Site
The Department of Transportation and Public Facilities (DOT &PF) is proposing to develop a
material site on Rezanof Drive at approximately MP 5.7 across from Gibson Cove Road.
DOT &PF needs additional gravel material due to an increase in projects for the 2015
construction season.
The DOT &PF and the Department of Natural Resources (DNR), the owners of the land, have an
agreement in place for development of a material site at the Rezanof Drive site. Less than
5,000 cubic yards will be extracted on an annual basis.
The DOT &PF is proposing to build an entrance on the northeast corner of the lot to ensure a
safe pullout for loaded trucks. The visibility at this point allows the drivers to see in both
directions on the roadway to ensure there is no traffic before pulling out. Parking for vehicles
during the work day will be within the vicinity of the entrance. Equipment used for extraction
of material will be parked in this area when not in use.
Material extraction will start on the east side of the lot and progress to the west (see benching
map). A buffer of existing vegetation will be left around the perimeter of the site wherever
possible to inhibit erosion and runoff from leaving the site. A rumble strip will be placed at the
exit to remove soil material from the tires of trucks prior to entering the roadway. A broom will
be on site to clean the roadway periodically throughout the day when material extraction
activities are occurring. When the material has been exhausted at this site a remediation plan
will be put in place to revegetate the areas of excavation and return the land to the previous
state.
