Good morning Gena,
I've reviewed the applicable property files and have calculated the required parking for the use of Lot 4, Block 5, Miller
Point Subdivision as follows:
• Single- family residence = 3 spaces
• 3200 sq. ft. shop /office space at 1 space per 700 sq. ft. = 4.57 spaces (we have determined the outdoor storage
to be incidental and subordinate to the contractor shop /office space).
• Coffee Kiosk = 3 spaces
• A total of 11 off - street parking spaces are required (10.57 rounded up to 11). Those 11 spaces must include:
• 9- 9'x18' spaces.
• 1- handicapped accessible van space that is either 11' x 18' with an adjacent 5'x18' access aisle or 8'x18'
with an adjacent 8'x18' access aisle. This space (must be located near entrance to main building).
• 1- 10'00' loading space.
• The configuration of the spaces must comply with KIBC 17.175 (attached).
A site plan must be provided with your application for zoning compliance (a copy of the most recent site plan for the
property is attached). The new site plan must depict the following:
• Location of the main building and hoop house (already indicated on attached site plan).
• Location of Coffee Kiosk and the traffic flow to and from the Kiosk.
• Location of all required off street parking spaces.
Once you've completed your site plan, you may email it tome for review. Once reviewed, we will notify you of any
required changes. Once the site plan meets KIB Zoning Code requirements we can issue you zoning compliance.

THIS P)RM1T is issued and effective this] st day of January, 2015 at .Anchorage, Alaska, by the State of Alaska,
Department of Transportation and Public Facilities, Central Region Right -of -Way, whose mailing address is 4111
Aviation Avenue P.O. Box 196900 Anchorage, Alaska 99519 -6900, acting through its Commissioner and referred to as
the "State ", and Dayton Wandersee, referred to as "Permittee," whose hailing address is: P.O. Box 8516, Kodiak, AK
99615.
Perntittee may occupy the following described right -of -way, which is shown on the attached drawing, and is referred to
hereinafter as the "permitted area:"
A strip of land 40 feet wide by 200 feet long (8,000 sq.ft.) a portion of the Right of Way along Rezanof Drive, 35 feet west
from edge of pavement, bordered by chain link fencing, adjacent to lot 4, Block 5, Miller Point Subdivision (4545 E.
Rezanof Drive), Kodiak, as shown on the attached Right of Way Plat Map, sheet 5 of 5, QS- 0389(4), Kodiak -Mill Bay
Road, also made a pail hereof.
This permit is subject to the provisions of Alaska Administrative Code, Title 17, Chapter 010, and the following general
and special conditions:
Allowed Use: The permitted arm is to be used for parking, storage, beautification and no other purpose. The
parking spaces this encroachment creates may not be used to meet borough planning and zoning requirements.
Annual pee: Permittee will pay in advance and without notice, an annual fee in the amount of $1238.40.
Term: Pernittee may occupy the permitted area for a tern (not to exceed five years) commencing on 01 /01 /2015
and ending on 12/31/2019, unless sooner revoked as provided herein. Before the expiration of said term, and
before subsequent tern anniversary dates, Pernittee may request, in writing, renewal of this Permit for an
additional term. Permittee must pay a nonrefundable $100 reapplication fee each time a request is filed to renew
or modify this Permit,
It. Use by the State: The issuance of this Pemiit notwithstanding, the permitted area's primary use is for
transportation purposes. The State may revoke this permit (as stated below), and/or enter the permitted area at
any time, without notice, for emergency use, or for the plannily, design, construction, inspection, or maintenance
of existing or future transportation facilities. Any such use of the permitted area will in no way invoke the
protections provided under 23 USC Section 138 (Preservation of Parklands).
Compliance with Laws: Perntittee shall comply with ail laws, ordinances, regulations, and administrative agency
and /or court orders, including those relating to health, safety, noise, environmental protection, waste disposal,
hazardous or toxic materials, and water and air quality. No furl, hazardous or combustible substances are to be
stored in the Permit area. Should Permit tee's use of the permitted area cause any discharge, leak, spill, emission,
or pollution release of any type to occur at any time during this occupancy, Pernlittee shall immediately notify the
State and the appropriate federal, state, and local authorities. Pernittee shall act immediately to contain and/or
absorb the release, repair any damage, and clean up the release area, and to restore the permitted area to
compliance with all applicable state, federal, or local laws or regulations. Pernittee shall be held liable for any

and all costs incurred by the State to dispose of cicanup materials or to clean up the pennitted area unless
othenvise agreed to, in writing, by both parties.
h. Indemnification: Permittee shall indemnify, defend and hold harniless the State, and its officers, employees, and
contractors, from any claim resulting from injury, loss, or damage to any person or personal property resulting
from Permittre's use of the permitted area.
7. Waiver of Claims: Permittee waives any claim or right of action Pennittee may have against the State in the
event of damage to property, and injury to or death of any person in the permitted area that arises because of the
design, construction, maintenance, management, or operation of a highway in the right of way containing the
permitted area.
S. Reimbursement of Costs: Permittee shall reimburse the State for all costs and expenses incurred by the State,
including attorney's fees, in any action brought by the State to recover any delinquent fees, or for the breach of
any tenns or conditions contained in this Permit, or to recover possession of the penrdued area.
9. Non - discrimination: No person, on the basis of race, religion; color, national origin, age, or sex, shall be
excluded from participation in, denied the benefits of, or otherwise subjected to discrimination in that person's
use of the permitted area.
1 U. Assignment: Permittee may not assign or transfer this permit.
1 i . Revocation: This Permit is not a property right but a temporary authorization, revocable by the State. The State
may revoke this permit in its sole discretion and upon 30 days written notice unless a shorter period is agreed to
herein by Permittee. Said notice will be sent to Permittee's last known mailing address. Permittee shall have no
right of action against the State. Upon the expiration or revocation of this Permit, Perntittee shall remove all
encroaeliments and restore the permitted area to a clean and safe condition.
12, loss of Business: The State is not responsible for loss of business.
13. No Reloeation Benefits: Issuance of this Pennit does not entitle Permittee to a payment of just compensation or
relocation benefits under AS 34.00 if Permit is revoked, Permiltee elects not to renew, or the State denies
Pennittce's request for renewal.
14 Cancellation by Permittee: Pennnittee may cancel this Permit'by providing written notice to the State at the
above address. Permittee is not entitled to a refund of any fees or expenses related to the revocation or
cancellation of this Permit.
15. Abandonment by Permittee: Upon abandonment by Permittee of the permitted area, Permittee's rights under
this Permit will immediately terminate, but Permittee's obligations will survive until fulfilled.
16. SPECIAL CONDITIONS:
a) No commercial or outdoor advertising is permitted within the area. Suhiect to AS 19.05.020, AS 19.05.040,
AS 19.25.150, AS 19.25.200, 17 AAC 20.012 and 17 AAC 20.013
