Good afternoon Charlie,
The Community Development Department has received your Zoning Compliance Permit application to establish a Bed
and Breakfast on your Lot 6A, Woodland Acres 15` Addition property. We are unable to process the application due tc
the following:
1. KIBC 17.25.030 (B Definitions) requires that the operator of the B &B reside on the premises. It is our
understanding that the residence is vacant at this time. Since no operator is residing on site, no Zoning
Compliance Permit may be issued for a B &B.
2. Prior to any other zoning compliance being issued, zoning compliance must be obtained to abate noted zoning
violations on your property.
Our department has confirmed that your property currently has two unpermitted accessory buildings (8' x 40' storage
containers), one of which has been converted to a second dwelling unit (only one dwelling unit is permitted on RR zoned
parcels). To abate those violations, the kitchen must be removed from the converted container and zoning compliance
must be obtained for the placement of the two containers on your property (zoning compliance will not be issued until
the kitchen has been removed). A detailed site plan showing the location of the containers and distances from property
lines (to ensure setback requirements are satisfied) will need to accompany the Application for Zoning Compliance. To
ensure compliance with building code, the related building permits must also be obtained (the Building Department can
assist you with that matter).
We also noted that the As -built Survey (dated February 8, 2008) provided with your application depicts a 7.8' x 28.7'
mobile home on the parcel. Our department has confirmed that the mobile home is no longer on the parcel, but our
review of the applicable property file shows that no zoning compliance for the removal /demolition of that mobile home
was obtained. That action can be added to the permit required to abate the aforementioned violations.
A draft Application for Zoning Compliance that addresses the above issues is attached to this email. Upon removal of
the kitchen from the converted container (an inspection will be required to confirm removal), you may submit the
signed application with the required site plan. The sixty dollar check you provided with the B &B Zoning Compliance
Permit application will cover the required fee. If you would prefer the check be returned, we will do so upon your
request.
Please be advised that if future tenants (owners or renters) desire to establish a B &B on the property, they may apply
for zoning compliance, provided that they are residing on the premises and no noted zoning code violations exist
(renters would need property owner authorization). The application would have to be accompanied by a site /parking
plan showing three 9' x 18' off - street parking spaces for the single family residence and one additional space for up to
two B &B guest rooms, two additional spaces for three to four guest rooms, or three additional spaces for five guest
rooms (the maximum for a B &B).

Additional to the attached, we did find the ZCP for the 'shop'. It was not on the property file, but was with building
dept. However (as stated on the ZCP), this is null and void as the intended use has been abandoned for over 180 days
after the work has commenced. Therefore a new ZCP for placement of the containers, their use and subsequent
building permits are required as detailed in the email below.

To clarify our conversations yesterday and Wednesday:
On October 23, 2014 we received a written complaint regarding your property at 3989 Woodland Drive,
Kodiak. That complaint referenced the sea container apartment and referred us to the Zillow posting
for your property. We have conducted some preliminary research and discovered the following
information:
1. The only permitted structure or use on file for your property is the single - family residence.
2. The 2 shipping containers have not been permitted as any form of accessory building.
3. The 2 shipping containers also require building, plumbing, and electrical permits (contact
building officials for specifics).
4. You are zoned RR. Only one dwelling unit (the Principal Building) on the property is
permitted.

5. Accessory buildings are permitted, but they may not be a dwelling unit. The apartment in
the container is a clear violation of the zoning code and the building codes. At a minimum,
the kitchen must be removed and all other construction, plumbing, and electrical work must
meet the relevant codes.
6. RR zoning permits that a B &B may be established in a principal dwelling unit. That B &B
also requires a ZCP; we do not have this on file, nor is there any record of such.
The required actions to achieve compliance with KIBC are (in this order):
1. Apply for ZCP for the 2 sea containers as accessory buildings (this will be only be approved
subject to 2 and 3, below).
2. The kitchen must be removed from the container and all other construction associated with
the containers must obtain required building permits.
3. Discuss with the building official, apply for permits, and have approved all necessary permits
and work for the `installation' of the 2 sea container accessory buildings.
4. Once 1 -3 are complete to the satisfaction of the building officials, apply for ZCP for the
B &B. The CDD will require a parking plan which indicates the additional parking spaces (1
space per 2 guest rooms). We will need to verify that the B &B does not contain a kitchen.
Please provide me with time -line plan of compliance. Provision and adherence to a plan will allow us to
abate enforcement action.
