Assembly Regular Meeting
May 15, 2014
A regular meeting of the Kodiak Island Borough Assembly was held on May 15, 2014, in the
Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting
was called to order at 7:30 p.m.
The invocation was given by Major Michael Bates of the Salvation Army. Mayor Friend led the
Pledge of Allegiance.
Present were Mayor Jerrol Friend, Assembly members Carol Austerman, Aaron Griffin, Chris
Lynch, Frank Peterson, Jr., and Mel Stephens. Also present were Borough Manager Bud
Cassidy, Clerk Nova Javier, and Assistant Clerk Angela MacKenzie.
GRIFFIN moved to excuse Assembly members Bonney and Kaplan who were absent due to
personal leave.

AWARDS AND PRESENTATIONS
Mayor Friend proclaimed May 17 through 23, 2014 as Safe Boating Week urging everyone to
support the goals of the North American Safe Boating Campaign.
Kodiak Island Convention and Visitors Bureau (KICVB) Executive Director Chastity Stereo
provided an annual report and a presentation on the services of the KICVB and Discover
Kodiak.
Finance Director Karl Short provided a Power Point presentation on the Borough FY2015
Budget.
CITIZENS' COMMENTS
Ken Reinke, Threshold Services Director talked about the positive impact of Earth Day.
Scott Arndt spoke in favor of Contract No. FY2014-32.
Lorna Arndt voiced her concerns with Borough elected officials regarding a previous use of point
of order and how it was handled.

PUBLIC HEARING
Resolution No. FY2015-01 Establishing The Minimum Tax Levy And The Minimum Amount
Of Funds To Be Made Available From Local Sources For The Kodiak Island Borough
School District For The Fiscal Year Beginning July 1, 2014 And Ending June 30, 2015.
GRIFFIN moved to adopt Resolution No. FY2015-01.
KIBC 3.15.030B provided that the school district submit to the manager a proposed budget and
local support requirements by April 30. The School Board submitted its Budget at the joint work
session on April 24, 2014, requesting funding in the amount of $11,170,800. Alaska Statutes
14.14.060C provided that if the Assembly did not, within 30 days, furnish the School Board with
a statement (resolution) of the sum to be made available, the amount requested in the School
Board budget would automatically be approved.
Per KIBC 3.15.0308, the Assembly determined the total amount of money to be made available
from local sources for school purposes and furnish the School Board with a statement
(resolution) of the sum to be made available. KIBC 3.15.050 provided that by June 10 the
Assembly would appropriate the amount to be made available from local sources for that
purpose in the Borough budget.
KIBC 3.35.060E provided that the property tax levy for school and municipal purposes would be
separately made and fixed. KIBC 3.60.020 provided that all motor vehicle registration taxes
would be allocated to the area wide school system.
The Kodiak Island Borough School District (KIBSD) requested a local contribution of
$11,170,800. As a result of the May 8 work session the Assembly considered the funding
amount of$10,625,600.
Mayor Friend opened the public hearing.
Superintendent Stuart McDonald expressed gratitude to staff and elected officials for their hard
work and dedication.
Scott Arndt voiced concerns about the budget for Resolution No. FY2015-01 and expressed the
amount should stay the same.
Mayor Friend closed the public hearing.
STEPHENS moved to amend Resolution No. FY2015-01 by adjusting lines 40 and 511 mill rate
from 8.75 to 9.16; adjusting lines 40 and 41 education support funding from $10,150,000 to
$10,625,600; and adjusting line 48, FY2015 School District local source funding from
$10,649,720 to$10,905,600. Motion died due to a lack of a second.

GRIFFIN moved to adopt Ordinance No. FY2014-16.
On May 1, 2014, the Assembly amended Ordinance No. FY2014-16 to reflect the
implementation date on sections 5 and 6 to become effective January 1, 2014.
The summary below reflects what was originally presented to the Assembly before the
amendment:
The Assembly "accepted" the Fox Lawson & Associates (FLA) Compensation and Benefits
Final Report at its May 16, 2013 meeting. Implementing the conclusions arrived at in the report
was not recommended (see the May 16, 2013 Assembly agenda statement) or approved by the
Assembly because of the need for the Borough's Personnel Advisory Board (PAB) to review
and approve necessary changes to the Personnel Manual required to implement the
recommendations made in the study.
At its March 5, 2014 meeting, the PAB unanimously approved the changes to the Personnel
Manual (see Personnel Advisory Board packet and signed resolution), The March 5 meeting
was the third meeting held by the PAB to discuss the FLA recommendations and changes to the
Personnel Manual.
Changing the Personnel Manual to implement the recommendations of the FLA study meant a
number of things. It first and foremost developed a new employee classification system that
determined how a position was placed on the salary scale. Salaries would be based on the
"type and level" of decisions made and importance of the job to the organization. That was a
different method than was formerly used. The former "point system" method placed a position
on the salary schedule based on requirements like: minimum experience required for the job,
the educational and licensing requirements for the job, etc. The FLA methodology was market
based and compared decisions made by diverse positions in the Borough to answer the
questions: Are decisions made by accountants any different than those made by a planner or by
a project manager? And if the decisions were the same "type and level" shouldn't those
positions be paid similarly?
Though the ordinance focused on salary, current negotiations with the Union were focused on
particular benefits.
The FY2014 budget included $177,000 to implement the compensation recommendations made
in the FLA report. If the Assembly approved the ordinance, salaries would be increased
retroactively to July 1, 2013. The cost to implement those pay increases would be split between
various funds. The General Fund (general government fund paid for through taxes) included
approximately thirty positions. The five positions in the project's office and portions of positions
in the Engineering and Facilities Department would be funded primarily through Capital Project
Grants. The Enterprise Funds would pay for increases for three positions at the Kodiak
Fisheries Research Center and six positions associated with the operation and management of
the Landfill. One position would be funded through the Land Management Fund, and the Fire
Chief position would be funded through the budget of Fire Protection Area No. 1.
The results of the comprehensive effort would serve the Borough well in attracting and retaining
employees who work hard for the Borough. Retaining long-term employees was a cost savings
to the Borough; losing institutional knowledge was expensive and troublesome, as was having
to train new employees on a regular basis.

Lastly, adoption of the ordinance would affect those positions not covered by the Collective
Bargaining Contract immediately. Implementation of salary increases would occur for those who
were members of the IBEW only after the Assembly approved the negotiated contract with the
Union.

of retro pay.

BOROUGH MANAGER'S REPORT
Manager Cassidy reported on the following:
• Five bids were received and opened for the Womens Bay playground equipment.
• The Borough land sale was scheduled for Saturday, May 17, 2014 at 1 p.m. in the
Borough Assembly Chambers.
• Research Forester and Ecosystem Services Team Leader Dr. Robert Deal would be in
Kodiak May 27 -29, 2014.
• 81,520 lbs. of solid waste was collected on Saturday, May 3 and 62,620 lbs. of solid
waste was collected on Saturday, May 10 as a result from the Community Cleanup
days. Total cost to the Borough was$13,352 as opposed to $11,703 last year.
• Borough Attorney Joe Levesque would be in Kodiak on May 29 to meet with staff and
Assembly.
• Old Harbor Leadership summit was scheduled on May 23.
MESSAGES FROM THE BOROUGH MAYOR
Mayor Friend announced he and members of the Assembly planned to attend the Old Harbor
Leadership summit on May 23. He apologized to Mrs. Arndt regarding email issues and
attempted to clarify the point of order process.

NEW BUSINESS
Contracts
1. Contract No. FY2014-32 Project Management Services for the Kodiak High School
Addition and Renovation Project.
LYNCH moved to authorize the manager to execute Contract No. FY2014-32 with Wilson
Engineering, Inc. of Juneau, AK for Project Management Services for the Kodiak High School
(KHS)Addition and Renovation Project in an amount not to exceed$580,600.

On February 7, 2013, the Assembly approved Contract No. FY2013-17 with Wilson Engineering
to provide project management services for the Kodiak High School Addition and Renovation
project. The original contract term was through December 31, 2013. Staff proposed executing a
change order to extend the term through December 31, 2014. Based on Assembly comments at
the April 15, 2014 work session, staff proposed executing a new contract that would extend
through the completion of the KHS project.
There were several sections of the new contract that differed from the original contract:
1. Increased hourly rate charged for project manager from $120.00/hour to $123.25/hour
for up to 200 hours a month, and from $135/hour to$138.25/hour for any hours over 200
hours a month.
2. Included a provision for a month-to-month extension of the contract if necessary.
3. Deleted a provision allowing the Contractor to be reimbursed for travel to and from
Kodiak (the Borough would purchase plane tickets directly and avoid contractor markup).
4. Deleted a provision allowing the Contractor to add 10% markup to reimbursable
expenses.
The previously proposed change order included an increase in the monthly housing allowance
from $1,600 to $1,900. Based on Assembly comments, Wilson Engineering agreed to maintain
the$1,600 from the original contract.The amount included rent and utilities.
Since the KHS project began,Wilson Engineering employee Bruce Walter had been working out
of the Projects Office and monitored the day-to-day construction activities. He was an extremely
valuable addition to the project team, monitored the schedule progress and quality control of the
contractor, reviewed and negotiated change order amounts, coordinated the activities of the
design team, contractor, and KIBSD, and provided project updates to the Assembly and Board
of Education. Staff recommended approval of the contract to ensure the high level of project
management for the KHS project continued.

2. Contract No. FY2014-33 Furniture, Fixtures, and Equipment for the Kodiak High School
Addition and Renovation Project.
AUSTERMAN moved to authorize the manager to execute Contract No. FY2014-33 with School
Specialty for Furniture, Fixtures, and Equipment for the Kodiak High School Addition and
Renovation in an amount not to exceed $1,334,923.87.
In October 2013 staff advertised a Request for Proposals for a Furniture, Fixtures and
Equipment (FF&E) supplier/installer for the (KHS) Addition and Renovation project. Four
proposals were received and scored by a committee made up of Borough and (KIBSD)
personnel. School Specialty was selected as the top proposer, and in January 2014 the
Borough Manager approved a Memorandum of Agreement for them to assist with developing a
list of furniture and equipment necessary for the project and to prepare price quotes.
Since then School Specialty had worked with interior designer DLR Group and met with KIBSD
teachers and staff to develop a final FF&E list, including cost. KIBSD had agreed to use its
funds to purchase the larger equipment for rooms such as the music room, construction
technology room, weight/cardio room, and auto shop. The Borough would need to enter into a
contract with School Specialty for purchase and installation of a variety of general classroom

items (chairs, tables, desks, bookcases, bulletin boards, etc.). A detailed list of room-by-room
furnishings was available for review.
The Department of Education and Early Development (DEED) approved budget for the project
included $2,000,000 for FF&E. To date, approximately $635,000 had been
expensed/encumbered for assistance during the FF&E procurement process from Jensen
Yorba Lott, Inc. and DLR Group,a contract with Integrated Logic to provide IT equipment, and a
small amount of administrative expenses. Remaining was $1,365,000 for the purchase of the
FF&E items. The proposed contract with School Specialty totaled $1,334,923.87, making it
within the available budgeted. Staff recommended approval of the contract with School
Specialty to provide and install FF&E for the KHS project.

Resolutions
1. Resolution No. FY2014-31 Approving the Village of Karluk and Its Native Village Council to
Participate in the FY2015 Community Revenue Sharing Program.
GRIFFIN moved to adopt Resolution No. FY2014-31.
The resolution identified Karluk as an unincorporated community that met the Community
Revenue Sharing Program eligibility criteria established under AS 29.60.865, AS 29.60.879 and
3 AAC 180.110.
Karluk had more than 25 residents and provided fire protection, emergency medical response,

water and sewer, solid waste management, and public road maintenance to its residents.

LYNCH moved to adopt Resolution No. FY2014-08B.
There was currently $18,594 left in the FY2014 Non-Profit Funding Account. Applications were
received from the Girl Scouts of Kodiak and the Providence Kodiak Island Counseling Center,
The Non-Profit Subcommittee met and recommended supplemental funding in the amounts of
$1,200 to Girls Scouts of Kodiak and $17,394 to the Providence Kodiak Island Counseling
Center.

GRIFFIN moved to adopt Ordinance No. FY2015-01 in first reading to advance to public hearing
at the next regular meeting of the Assembly.
The ordinance budgeted for FY2015 Revenues and Expenditures for the General Fund, Special
Revenue Funds, Debt Service Funds, and Enterprise Funds. The ordinance also added multi-
year projects to the capital project funds. The ordinance sets FY2015 mill rates and sets the tax
rates for commercial aircraft.

Other Items
1. Vacation of Access and Utility Easements Identified on Plat 88-20 for Tracts D-1 and D-2 of

LYNCH moved to approve the vacation of access and utility easements identified on Plat 88-20
for Tracts D-1 and D-2 of Tract A, Bells Flats Subdivision.
At the April 16, 2014 Planning and Zoning Commission regular meeting, the Commission
approved the vacation of access and utility easements identified on Plat 88-20 for Tracts D-1
and D-2 of Tract A, Bells Flats Subdivision, subject to three specific conditions of approval. The
area to be vacated was within the Borough outside a city and had no monetary value to the
Borough. KIBC 16.60.060 required additional approval by the Borough Assembly prior to the
vacation becoming effective.

ASSEMBLY MEMBERS'COMMENTS
Assembly member Griffin spoke on Roberts Rules of Order and expounded on Dr. Deal's
presentation.
Assembly member Lynch congratulated Ocean Beauty and Kate Munsen for receiving the
ALPAR award. She announced the next Kodiak Fisheries Work Group regular meeting was
.scheduled for Monday, May 19, 2014 at 8:30 a.m. in the Borough Conference Room.
Assembly member Stephens expressed his views of Roberts Rules of Order and commented on
the responsibility of the community to keep Kodiak clean.
Assembly member Austerman spoke to the decorum issue. She expressed regret on missing
the Old Harbor Leadership Summit; due to her attendance of the Western Interstate Region and
National Association of Counties Conference. She expressed gratitude for the proclamation of
safe boating.
ANNOUNCEMENTS
Mayor Friend announced the Borough Land Sale No. 18 would be held by Public Outcry Auction
on Saturday, May 17, 2014 at 1 p.m. in the Borough Assembly Chambers.

The Mayor and members of the Assembly would be traveling to Old Harbor to attend the Old
Harbor 2014 Spring Leadership Summit on Friday, May 23,2014.
The public was invited to attend the dedication of the Earl Smith Jr. Memorial Fire Training
Center on Monday, May 26, 2014, 2 p.m. at the Fire Training Center located at the corner of
East Rezanof and Parkside Drive.
The Borough offices would be closed on Monday, May 26, in observance of Memorial Day.
The next Assembly work session would be held on Thursday, May 29 at 7:30 p.m. followed by a
special meeting in the Borough Assembly Chambers. The next regular meeting was scheduled
on Thursday, June 5 at 7:30 p.m. in the Borough Assembly Chambers.

SUMMARY STATEMENT:
Kodiak Island Borough code 3.30.020"Limitation of Manager's Authority"states that a
contract exceeding$25,000,00 requires Assembly approval.
This contract is for the Four School Generators project as shown in the construction
documents prepared by Jensen Yorba Lott, Inc. The work includes installing new electrical
generators at Port Lions, Karluk, Old Harbor, and North Star Elementary schools. Port Lions
and North Star are scheduled to be completed by January 6, 2015, and Karluk and Old
Harbor by July 15, 2015.
An invitation to bid was issued on June 4, 2014, and bids were opened on June 26, 2014.
Only one bid was received from Wolverine Supply, Inc. of Wasilla, Alaska.Wolverine Supply
is currently working on the KFRC Ventilation Modifications project, and has successfully
completed several KIB projects in the past.
The base bid scope of work includes installing new 60kw generators at Port Lions, Karluk,
and Old Harbor schools, including required site work. Two alternates for North Star
Elementary were also included in the bid: one to install a 60kw generator and one to install a
125kw generator. The larger generator will enable power to be provided to the whole school,
rather than just emergency functions. The base bid and alternate 2 can be completed within
the budget available, and staff is recommending that alternate 2 be included in the contract
award.
This project is funded by an Alaska Designated Legislative grant received in FY2012. The
grant was for installation of generators at Kodiak High School, East Elementary, and the four

SUMMARY STATEMENT:
This ordinance will place before the voters the question of issuing general obligation bonds on
the October 7, 2014 ballot. If approved, up to$10,230,000 in general obligation bonds will be
sold to pay for the cost of certain Renewal and Replacement projects in school facilities. The
projects to be funded with these bonds address worn out school building components such as
roofs, floors, underground storage tanks, etc. that have reached the end of their useful life
and require overhaul or replacement. Projects to be included are listed on the attachment.
The State of Alaska will reimburse the Borough 70% of the principal and interest costs
associated with the projects included in funding from this bond issue which amounts to
$8,249,945. The remaining 30%equals$3,535,690.
A corrected version of the ordinance is provided to the Assembly to incorporate the
changes/information that was requested at the July 10 work session.

Staff has been preparing an ordinance to place a$10,230,000 bond issue on the ballot for the
October 6,2014 election. Some suggestions were made at the July 10'"worksession. These
questions were related to setting some of the bond parametors before the question is put on the
ballot.
KIBC section 3.05.030,Debt Policies,states'Net debt as a percentage of the estimated market
value of taxable property should not exceed 15%." At the current time our certified tax roll is
$1,181,899,002.
Fifteen percent of this amount is$177,284,850. Our current debt after selling the last portion of
the High School project bonds is$47,090,475. If we sell the R&R bonds our total net debt will
go to$50,626,165. This is considerably lower than recommended by our Borough Financial
Policies.
The attached corrected ordinance and chart show what staff is recommending as changes to
Orinance No.FY2015-02.
The final maturity of the bonds will be no later than 10.5 years after their date of issuance and
the bonds will not be sold if the TIC is over 4 percent(4%).This is the actual amount of interest
paid over 10 years,not the coupon interest rates.
We have attached the proposed ad that shows the Borough's outstanding debt at this time. This
ad will be advertised per Borough code in the Kodiak Daily Mirror. We have attached a chart to
this memo. This chart shows the total outstanding debt by year for the next 20 years for all
general obligation bonds that have been sold. The Borough Assessor states that the assessed
value of the real property in the Borough is expected to increase at 1.5 to 2%per year for the
foreseeable future. For our charts we have used I%to calculate future assessed values.
These changes to the ordinance should address the Mayors and Assembly's concerns. If you

22 WHEREAS, under the provisions of AS 29.47.190, a municipality may incur general obligation
23 debt only after a bond authorization ordinance is approved by a majority of those voting on the

26 WHEREAS, the borough owns and maintains multi-million dollar school facilities;and

28 WHEREAS, the borough maintains a Renewal & Replacement Schedule which provides a
29 long term plan to renew and/or replace worn out building components within the school facilities;
30 and

32 WHEREAS, many of the Kodiak Island Borough's school facilities have worn out building
33 components such as roofs,floors, underground storage tanks,etc.that have reached the end of
34 their useful life;and
35
36 WHEREAS, the State of Alaska, Department of Education, has a program in which major
37 maintenance projects for school facilities are eligible for 70%reimbursement of the bonded debt
38 service on the eligible portion of bonds authorized by the qualified voters of the Borough; and
39
40 WHEREAS, the Borough views the renewal and replacement projects authorized herein as
41 necessary and beneficial to the community and acquisition of 70% reimbursement money from
42 the state as the most cost effective way of funding these projects;and
43
44 WHEREAS, bonds can be sold for a period of 10 to 20 years and qualify for State Debt
45 Reimbursement;and
46
47 WHEREAS, the True Interest Cost(TIC)is estimated to be 2.65 percent(2.65%);and
48
49 WHEREAS, per KIBC 7.10.0600, before a general obligation bond issue election, the
50 clerk shall publish the attached notice of the borough's total existing bonded
51 indebtedness (EXHIBIT A) at least once a week for three consecutive weeks. The first

59 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND

62 Section 1: This ordinance is not of a general or permanent nature and shall not become a
63 part of the Kodiak Island Borough Code of Ordinances.

65 Section 2: It is hereby determined to be for a public purpose and in the public interest of the
66 Borough to incur general obligation bonded indebtedness in an amount not to
67 exceed Ten Million Two Hundred Thirty thousand Dollars ($10,230,000) for the
58 purpose of paying for renewal and replacement projects (including planning,
69 design, construction, furnishings, and equipment) in an effort to carry out the
70 renewal and replacement schedule related to these facilities as described in
71 Section 4 and for similar projects if money is available after these projects have
72 been completed.

74 Section 3: The Borough is authorized to borrow the sum of Ten Million Two Hundred Thirty
75 Thousand Dollars($10,230,000)to finance the renewal and replacement projects
76 described in Section 4, and the borrowing shall be evidenced by the issuance of
77 general obligation bonds of the Borough; provided that bonds may not be issued
78 for any project unless the project is eligible for debt service reimbursement by the
79 State of Alaska, The full faith and credit of the Borough are pledged for payment
80 of the principal of and interest on the bonds, and ad valorem taxes upon all
81 taxable property in the Borough shall be levied without limitation as to rate or
82 amount to pay the principal of and interest on the bonds when due.

14 WHEREAS, the Port Lions School needs to be painted this Summer;and

16 WHEREAS, it is estimated that painting this school will cost$131,000; and

18 WHEREAS, the funds are available in the General Fund.

20 NOW,THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
21 BOROUGH that:

23 Section 1: This ordinance is not of a general application and shall not be codified; and

25 Section 2: The FY2015 budget will be amended by increasing the use of fund balance
26 and transfers out in the General Fund by $131,000 and increasing the
27 Transfers In and creating a Port Lions painting project in the Renewal and
28 Replacement Fund (Fund 469)for$131,000.

stipend for 1.0 FTE secondary teacher at Larsen Bay School:
Jennifer Wilcox - BA+0/0 in the amount of$44.643 for 1.0 FTE
Health Physical Education teacher at Kodiak Middle School: Keith
Gray- BA-0/6 in the amount of 558,482 plus $1.340 village
stipend for 1.0 VIE secondary teacher at Akhiok School; and
Barbara Gray- BA+18/7 in the amount of$63.840 plus 51,340
village stipend for 1.0 FTE elementary teacher at Akhiok School.
APPROVED: Motion to approve 2014/2015 administrative contracts to Chris
Aguirre in the amount of$1 10.660 for 1.0 FTE Kodiak High
School Principal for 220 days'. Brian Purnell in the amount of
593.890 for 1.0 FTE Kodiak High School Assistant Principal for
205 days; and Michael Pieper in the amount of 5126,208 for 1.0
FTE Chief Business Officer for 232 days.

Bonds in the Principal Amount of Not to Exceed $10,230,000 to Finance the
Renewal and Replacement Schedule Related to Borough Owned School
Facilities, Projects Which are 70% Reimbursable by the State of Alaska, and to
Submit the Question of the Issuance of Such Bonds to the Qualified Voters of the
Borough at the October 7, 2014 Regular Borough Election.
Recommended motion: Move to adopt Ordinance No. FY2015-02 in first
reading to advance to public hearing at the next regular meeting of the
Assembly.

Recommended motion: Move to convene into executive session to discuss the
Borough Manager's performance evaluation, a subject that qualifies for
executive session as a matter that may tend to prejudice his reputation or
character.
Please invite the Assembly members and Manager to join in the executive session.
After the vote, Mayor Friend recesses the regular meeting and convenes the
executive session.
Upon returning from the executive session, Mayor Friend reconvenes the regular
meeting and announces no action is to be taken as a result of the executive session
OR the Assembly may make a motion if necessary.
