FY2014-16 9 10 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND 11 BOROUGH ACCEPTING THE RECOMMENDATION OF THE PLANNING 12 AND ZONING COMMISSION FOR LONG-TERM DISPOSAL OF A 2.36 13 ACRE PORTION OF THE KODIAK ISLAND BOROUGH LANDFILL 14 TRACT (1203 MONASHKA BAY ROAD EAST) TO THE CITY OF 15 KODIAK. 16 17 WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each disposal of 18 Borough land to be reviewed by the Planning and Zoning Commission, with the 19 Commission making a recommendation on the requested disposal by resolution before it is 20 forwarded to the Borough Assembly; and 21 22 WHEREAS, a 2.36 acre site within the Kodiak Island Borough Landfill Tract (identified by 23 metes and bounds in Exhibit A) has been requested for disposal by the City of Kodiak to 24 allow the City to investigate the potential of the site for a long-term composting and to begin 25 the engineering and design work to be submitted for Alaska Department of Environmental 26 Conservation (ADEC) review; and 27 28 WHEREAS, the Planning and Zoning Commission has adopted Resolution No. FY2014- 29 01 at a public hearing on July 17, 2013 finding that a 2.36 acre site within the Kodiak Island 30 Borough Landfill Tract is surplus to the immediate need for landfill operations; and 31 32 WHEREAS, City and Borough staff have been working cooperatively to find a long-term 33 solution for the safe and affordable disposal of the community's biosolids, and a 2.36 acre 34 site has been identified at the south end of the landfill that may serve in the long term for 35 processing biosolids into Class A compost; and 36 37 WHEREAS, KIBC Section 18.20.030 states that Borough land disposals that are not 38 subject to approval by ordinance are subject to approval by Assembly resolution. 39 40 WHEREAS, in the interest of public outreach to better inform residents, the City has 41 given presentations recently at the Solid Waste Advisory Board (SWAB) meeting on 42 September 16, 2013 and at the Monashka Bay Road Service Area (MBRSA) meeting on 43 September 25, 2013 to explain operations and answer questions', and 44 45 WHEREAS, disposal by conveyance at less than fair market value according to KIBC 46 18.20.100.B to allow use of the land for a public purpose beneficial to the Borough would 47 return to the City for a public purpose 2.36 acres of the 17.6 parcel that the City deeded to 48 the Borough in 1996 "...in the best interest of the public." (letter from City Manager to 49 Borough Mayor, Jan. 29, 1996); and Kodiak Island Borough, Alaska Ordinance No. FY2014-16 Page 1 of 2 50 WHEREAS, disposal of this land to the City will be conditional on issuance to the City of 51 a permit for Class A composting by Alaska Department of Environmental Conservation 52 (ADEC) to ensure that all regulatory requirements related to the operation are met. 53 54 NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND 55 BOROUGH THAT: 56 57 Section 1: Consistent with the recommendation of the Kodiak Island Borough Planning 58 and Zoning Commission Resolution No. FY2014-01 for disposal of a 2.36 59 acre site within the Kodiak Island Borough Landfill Tract (Plat 96-31), the 60 Assembly finds that this property, identified by the survey description 61 (Exhibit A) attached, is surplus to the Borough's active landfill operational 62 needs; 63 64 Section 2: Representatives of the City of Kodiak are authorized to enter onto the 2.36 65 acre portion of the Landfill Tract to conduct engineering studies and field 66 tests to determine the suitability of the site for the concrete slab and 67 structural development that will be needed in support of facility that will 68 produce Class A compost; 69 70 Section 3: The Borough Manager is authorized on behalf of the Kodiak Island Borough 71 to convey by quitclaim deed to the City of Kodiak for less than fair market 72 value a 2.36 acre portion of land within the Kodiak Island Borough Landfill 73 Tract for the processing of biosolids. The Borough's request to acquire the City property adjacent to the existing landfill is j. prudent community planning and will he conveyed "in the best interest of the public" complying with Section 1820.030 of the Kodiak City Code. In a meeting with Mr. Bud Cassidy he indicated that a survey would be prepared and when replattcd a quit claim deed will be prepared and executed. We have not tied this conveyance to any exchange simply to avoid confusion or delay. MEMORANDUM TO: Bud Cassidy cop Bob Scholze FROM: Bill Roberts, Assessor DATE: August 2, 2013 SUBJECT:Value of proposed lease site at the Landfill Gentlemen: I have researched market sales of industrial zoned land within the Kodiak Island Borough and analyzed those sales with respect to valuing the proposed 2.36 acre site located adjacent to the landfill, which is tentatively being considered in a lease to the City of Kodiak for composting biosolids from their waste water treatment plant. My analysis included industrial zoned property sales from the Lash Dock Area in Womens Bay and the industrial zoned lots along Von Scheele and Selief Lanes. My analysis considered two values for the proposed site, one for the cleared gravel capped area and a lesser value for the buffer area which is mostly steep slopes.
