FY2014-04 7 8 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 9 BOROUGH REZONING THE REMAINDER PORTION OF THE KIB 10 LANDFILL TRACT AND LOT 2 SAWMILL SUBDIVISION FROM A 11 COMBINATION OF C—CONSERVATION AND PL — PUBLIC USE 12 LANDS TO NU—NATURAL USE (CASE NO. 13-027, LANDFILL) 13 14 WHEREAS, the Planning and Zoning Commission received a request to rezone the 15 remainder portion of the KIB Landfill Tract and Lot 2 Sawmill Subdivision; and 16 17 WHEREAS, at an advertised public hearing, consistent with KIB 17.205.040, the 18 Commission considered the merits of the rezone request; and 19 20 WHEREAS, the Commission voted to recommend to the Borough Assembly that the 21 remainder..portion of the KIB Landfill Tract and Lot 2 Sawmill Subdivision be rezoned 22 finding that the public necessity, convenience, and general welfare and good zoning 23 practice would be enhanced by such action; and 24 25 . WHEREAS, the Commission hereby recommends that this rezone request be reviewed 26 and approved by the Borough Assembly. 27 28 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 29 BOROUGH THAT: 30 31 Section 1: This ordinance is not of a general and permanent nature and shall not 32 become a part of the Kodiak Island Borough Code of Ordinances; 33 34 Section 2: The remainder portion of the KIB Landfill Tract and Lot 2 Sawmill 35 Subdivision is hereby rezoned from a combination of C—Conservation and 36 PL-Public Use Lands Zoning Districts to NU—Natural Use Zoning District. 37 38 Section 3: The findings of the Kodiak Island Borough Planning and Zoning 39 Commission are hereby confirmed as follows: 40 41 17.205.020 A. Findings as the Need and Justification for a 42 Change or Amendment. 43 The borough needs to maintain some or all of the remainder of the Kodiak Island 44 Borough Landfill Tract and Lot 2, Sawmill Subdivision for a greenbelt buffer to 45 mitigate the day-to-day impacts of landfill activities and commercial activities on Lot 46 1, Sawmill Subdivision from effecting residential properties in the general area. Kodiak Island Borough, Alaska Ordinance No. FY2014-04 Page 1 of 2 47 The borough land surrounding the current Industrial zoned landfill site also 48 provides for some recreational use at the present time and this potential could be 49 further realized if this area and Lot 2, Sawmill Subdivision were properly zoned and 50 managed for recreation purposes. 51 52 17.72.020 B. Findings as to the Effect a Change or Amendment 53 would have on the Objectives of the Comprehensive Plan. 54 A rezone of the subject parcel would be generally consistent with objectives of the 55 2008 Kodiak Island Borough Comprehensive Plan Update. A rezone of the subject 56 parcel would work to implement the Comprehensive Plan. 57 58 17.205.020 C.
