FY2013-17 9 10 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 11 REZONING A 3.92 ACRE PORTION OF TRACT 6, USS 5509 PORT LIONS 12 SUBDIVISION, AS IT MAY BE FIXED BY SURVEY AT THE CONCLUSION OF NEW 13 CONSTRUCTION IMPROVEMENTS, FROM RR2-RURAL RESIDENTIAL TWO TO 14 PL-PUBLIC USE LAND ZONING DISTRICT 15 16 WHEREAS, the Planning and Zoning Commission received a request to rezone a 17 Portion of Tract 6, USS 5509, Port Lions Subdivision which is or will be about 3.92 acres 18 in area, and 19 20 WHEREAS, at an advertised public hearing, consistent with KIB 17.205.040, the 21 Commission considered the merits of the rezone request; and 22 23 WHEREAS, the Commission voted to recommend to the Borough Assembly that these 24 lots be rezoned, finding that the public necessity, convenience and general welfare and 25 good zoning practice would be enhanced by such action; and 26 27 WHEREAS, the Commission hereby recommends that this rezone request be 28 reviewed and approved by the Borough Assembly. 29 30 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK 31 ISLAND BOROUGH THAT: 32 33 Section 1: This ordinance is not of a general and permanent nature and shall not 34 become a part of the Kodiak Island Borough Code of Ordinances. 35 36 Section 2: A Portion of Tract 6, USS 5509, as may be fixed by survey at the 37 conclusion of the planned construction improvements, is hereby rezoned 38 from RR2-Rural Residential Two to PL-Public Use Land. 39 40 Section 3: The findings of the Kodiak Island Borough Planning and Zoning 41 Commission are hereby confirmed as follows: 42 43 44 17.205.020 A. Findings as the Need and Justification for a Change or 45 Amendment. 46 47 The City of Port Lions needs to develop a sewage sludge lagoon in order to comply with 48 ADEC requirements. The Alaska Native Tribal Health Consortium is providing design 49 and construction for the proposed facility and the City of Port Lions is providing the land 50 for the facility. The proposed sewage sludge lagoon will be located adjacent to the Kodiak Island Borough, Alaska Ordinance No. FY2013-17 Page 1 of 2 51 existing community landfill which appears to be the most appropriate location for the 52 community which must balance transport distances and availability of land suitable for 53 the purpose. 54 55 17.72.020 B. Findings as to the Effect a Change or Amendment would 56 have on the Objectives of the Comprehensive Plan. 57 58 The 2008 Kodiak Island Borough Comprehensive Plan Update and the 1997 Port Lions 59 Comprehensive Community Plan both indicate this area should be developed for 60 residential purposes. This site is located adjacent to the existing solid waste landfill 61 which is designated for Public Use so that in this context the rezone appears to be 62 logical expansion of this designated site for a closely related land use. The overall 63 pattern of the plan map is not substantially altered as a result of this change.
