FY 2013 -30 9 10 A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY 11 ACCEPTING THE RECOMMENDATION OF THE PLANNING AND ZONING 12 COMMISSION APPROVING DISPOSAL BY LEASE OF CERTAIN BOROUGH LAND 13 AS SURPLUS TO THE PUBLIC'S NEED (P&Z CASE 13 -022, PILLAR CREEK) 14 15 WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed 16 disposal of Borough land to be reviewed by the Planning and Zoning Commission before 17 submission to the Assembly; and 18 19 WHEREAS, the Planning and Zoning Commission is required under KIBC 18.20.030 to 20 make a recommendation on the disposal(s) by resolution before it is forwarded to the 21 Borough Assembly; and 22 23 WHEREAS, the principal purpose of the Commission review is to determine if the land 24 identified for disposal is surplus to the Borough's need; and 25 26 WHEREAS, the parcel proposed for disposal by the Borough Resource Management 27 Officer has not previously been considered for disposal by the Borough Assembly; and 28 29 WHEREAS, the Planning and Zoning Commission has found that the parcel identified 30 below for disposal is surplus to the public's need based on its review; and 31 32 WHEREAS, the new lease area would have the benefit of including all hatchery 33 infrastructure as well as providing better access to Pillar Creek, the site of hatchery coho 34 salmon stocking; and 35 36 WHEREAS, the Planning and Zoning Commission held a public hearing on March 20, 37 2013 and is recommending the disposal of the parcel listed below. 38 39 NOW, THEREFORE BE IT RESOLVED, THAT THE ASSEMBLY OF THE KODIAK 40 ISLAND BOROUGH THAT: 41 42 Section 1: The Kodiak Island Borough Planning and Zoning Commission, in 43 accordance with Title 18 of the Kodiak Island Borough Code, recommends 44 disposal of the borough's interest in the following parcel of and comprising 45 2.61 acres of property described as a 2.61 acre, more or less, portion of Kodiak Island Borough, Alaska Resolution No. FY2013 -30 Page 1 of 2 46 Tract E, BLM Tract D, within Section 30, Township 27 South, Range 19 47 West, Seward Meridian. 48 49 Section 2: The Kodiak Island Borough Planning and Zoning Commission, in 50 accordance with Title 18 of the Kodiak Island Borough Code, has 51 determined after a public hearing on March 20, 2013, that the 52 aforementioned property is hereby surplus to the public's need. 53 54 Section 3: The aforementioned parcel should be offered to the Kodiak Regional 55 Aquaculture Association by lease for less than fair market value which will 56 allow the use of the land for a public purpose beneficial to the Borough. 57 58 ADOPTED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 59 THIS EIGHTEENTH DAY OF APRIL, 2013 60 61 KODIAK ISLAND BOROUGH 62 63 64 65 ATTEST: Jer•ine M.
