December 6, 2011 Work Session 5:30 p.m. in the Kodiak Fisheries Research Center Conference Room
CALL TO ORDER
CHAIR VINBERG called to order the Project Advisory Committee work session at 5:55 p.m.
ROLL CALL
Committee members present were Alan Torres, Andy Schroeder, Sonny Vinberg, Dan
Rohrer, Ted Panamarioff, and Oliver Holm. Excused were Casey Janz, Mark Anderson, and
Janet Buckingham. Ex- officio member absent was Louise Stutes.
A quorum was established.
Community Development Department staff present was Duane Dvorak, Bud Cassidy, and
Sheila Smith.
Others present were Bob Scholze (Resource Management Officer), Chris Beck (Consultant),
Steven Van Steenhuyse (consultant, teleconferenced about 1 hour), Beth Davis, and Maria
Painter.
APPROVAL OF AGENDA
COMMITTEE MEMBER TORRES said he would like to make a change to the agenda moving
Reports, the Meeting Schedule to right after Approval of Minutes.
COMMITTEE MEMBER TORRES MOVED to approve the agenda as amended.

REPORTS
Meeting Schedule: Discussion of next meeting
Chris Beck stated he prepared a schedule to move forward and he explained the schedule
and expectations of the committee. Beck also stated he expects they will get through Titles
16 and 18 tonight.
CHAIR VINBERG stated his take on the joint meeting was that there was regurgitation of
old information and the perspective from the public was that it seemed to be a more
complicated document and not simpler. Vinberg said he also heard that they want it done
right even if it requires spending more time on it.
Beck said there are people concerned about the code becoming more complex and as
Dvorak told him part of the reason people react regarding the complexity is there is a lot of

material to absorb, the impression is this is more pages than it used to be, and it's more
complicated. When interacting with this code on an actual basis rather than trying to
absorb it you find the certain sections that apply to you, you want them to be clear and well
organized, and 90% of it that you don't even see because you are working on one issue and
one zoning district.
Discussion of the code revision process.
COMMITTEE MEMBER TORRES suggested using the ordinance from the assembly
establishing the committee that gives some direction.
Dvorak said at the joint meeting he suggested that we pull out some past cases that were
difficult that were appealed and run those through the process. He's not sure if it's a fair do
over now. We have three under the contract that the consultants want to test and we just
need to make sure we get three cases that are representative but challenging.
CHAIR VINBERG said we will rehash the zoning sections in January and he will be out of
town until January 9th.
COMMITTEE MEMBER HOLM said he will be out of town January 14th tanner fishing.
Beck said we will set January 10th tentatively for the next meeting.
AUDIENCE COMMENTS AND APPEARANCE REQUESTS
CHAIR VINBERG said Dvorak just passed on to the committee 8 online submissions for
code changes.
Maria Painter stated she's read Title 17 in its entirety of every new version put out and
there are problems that need to be addressed; native lands and her issues, a business
owner that has a piece of land that's still being kept at a 35 foot height restriction in the
draft that should be 50 feet that still hasn't been changed. Painter has come to every
meeting and she doesn't know who to talk to. Another issue is there isn't anything in the
zoning that would apply to livestock owners and nowhere is it explained or in the codes.
Beck stated she's the only one to take the opportunity to talk to us and he suggests she
write a letter, email it to Dvorak and he will get it to the consultants and get it back to the
committee. The sooner she does this the sooner it will get in the next round of revisions.
That will give everyone a chance to look at Painter's comments and then think about them
and come back to the committee with our suggestions, and as a committee we'll look at
them systematically and reach some conclusions as a group.
Painter expressed concern about the process and stated every time she brings up a topic
it's put on the back burner and it's to be addressed at a further date but never is. It's her
understanding that PAC is directing the consultants but it feels like it's the reverse. Painter
explained she's gone through the process and written letters; she's directed them to the
consultants, PAC, and staff. Everyone has reviewed them and it's put on the back burner.
This is too important to just push it through. Painter stressed that we need to review the
important things so we don't have problems down the road.

Beck stated their job is to help the community prepare this. Beck apologized if it should
have been taken serious earlier and he assured her they will take her comments serious at
this point. Beck suggested waiting until the January meeting to discuss Painter's comments.
COMMITTEE MEMBER PANAMARIOFF stated we have audience comments on the agenda
but we don't have anything for external input other than the website.
OLD BUSINESS
A) Review of the Draft Code
Beck had the committee read the Titles 16 & 18 summary of issues to see if there is
anything that needs to be discussed first.
Beck led the discussion of flaglots, lighting, open spaces incentives, and Title 16. Any
changes were relayed to Beck.
COMMITTEE MEMBER ROHRER expressed concern about, for example, in Monashka Bay
people have purchased lots that are developable only by using flaglots because of ponds
being in the middle, and he doesn't want to prevent small development. We have a lot of
little ponds in Kodiak.
Due to an emergency COMMITTEE MEMBER TORRES had to leave the meeting and the
quorum was lost.

Due to a lack of quorum CHAIR VINBERG adjourned the meeting at 9:04 p.m.
