There is established the Architectural /Engineering Review Board, which shall consist of seven (7) voting members, to be appointed by the mayor. Parks and Recreation Committee 2.120.020 - Appointment, terms, and procedures. Members of the committee shall be appointed by the mayor subject to confirmation by the assembly. Planning and Zoning Commission 2.105.010 - Created -- Membership. Preferably, two out of the seven seats shall be designated to representatives from the construction and retail business community. ASSEMBLY APPOINTMENTS 3.35.050 Board of Equalization. A. Membership, Qualification, Duties, Terms. 1. Members. The Board of Equalization shall be composed of five (5) persons, not assembly members, appointed by the assembly. The term of each member shall be three (3) years. The terms of appointments to the Board shall be staggered so that two (2) members are appointed each year for two consecutive years and one (1) member is appointed the third year. The regular term of a member of the Board shall commence on January 1st of the year of appointment and shall expire on December 31st of the year the term expires. SUMMARY: Kodiak Island Borough has several projects planned that require the services of an Environmental Consultant/Abatement Contractor. After advertizing a request for proposals, KIB entered into a term contract with Satori Group Inc. for Environmental Consulting and Abatement Services for projects yet to be determined in accordance with KIBC procurement requirements. The term contract identifies terms and fees of agreement for work to be authorized in the future. The teacher's residence at Chiniak School experienced a rupture in an above ground fuel oil tank causing a fuel oil spill on the premises during the first week of December. Borough staff investigated and determined the estimated quantity spilled requires DEC notification. Satori was contacted and they notified DEC. John's Heating removed the old tank and plumbed in a replacement. Due to the continuous expansion of the oil plume, the Manager authorized immediate action in order to contain costs and environmental damage. Satori mobilized to assess and plan the clean -up effort. They provided an estimate to capture the contaminated soil and construct a temporary containment cell on site totaling $59,367. The proposed amendment to the Term Contract will authorize the work and provide for compensation based on actual time and expenses in accordance with the agreed fee schedule and all requirements contained in the Term Contract. Staff recommends authorizing Satori to perform work as described in an amount not to exceed $62,500.00, which includes approx. 5% contingency. The Site Superintendent will be the lead point of contact for execution of the contract. POL Remediation Satori will begin by identifying areas needing to be remediated on the ground around the spill area. The ground around the area will then be excavated and separated into contaminated and "clean" soil piles. All contaminated soil, as determined by an approved ADEC Qualified Sampler, will be segregated and placed into a stock pile area predetermined and prepared by Satori. All "clean" soil will be stock piled into a different location for eventual put back into the area. All contaminated soil in the stock pile area will be placed onto a Geomembrane material to comply with ADEC interim storage requirements for contaminated soil. The remaining clean soil will be placed back into the excavation area and additional materials will be used to return the area to existing grade for installation of a new stand and tank. For estimating purposes, 10 laboratory samples were included in our cost estimate and approximately three field days. Brechan Enterprises will provide equipment, shot rock and D1 fill for replacement of excavated materials and /or driveway(s) impacted by the spill. Satori Group will notify KIB if we feel the extent of the contamination exceeds the costs estimated using the time and materials schedule. Safety & Health Site Safety and Health Plans (SSHP) developed by Satori are tailored to exceed OSHA requirements and are reviewed multiple times before submission.
