A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AUTHORIZING THE BOROUGH MANAGER TO COMPLETE THE PURCHASE AND
LEASE OF NEW LOT 8A -1 MILLER POINT SUBDIVISION
WHEREAS, Kodiak Island Borough Code 18.10.1 10 (C) provides that the Borough
may acquire real property by negotiated purchase; and
WHEREAS, Kodiak Island Borough Code 18.10.020 provides that real property shall
be acquired pursuant to a resolution of the Assembly; and
WHEREAS, the Fire Protection Area No. 1 Board adopted a resolution requesting that
the Assembly purchase new lot 8A -1 Miller Point Subdivision for access and expansion
of the Bayside Fire and Training Complex; and
WHEREAS, the Manager contracted for an independent appraisal that determined that
the estimated fair market value of the property is $290,000; and
WHEREAS, the Borough Manager negotiated with the property owner, pursuant to
Assembly approval, and found the owner's last and final offer to be $300,000
including free rent for two years and that the Borough pay all closing, survey, and
platting costs including relocation of the sewer and water; and
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: In accordance with KIB Code Section 18.10.020, the Manager is
authorized to complete the purchase of Lot 8A -1 Miller Point Subdivision
for $300,000 and in addition shall pay all closing costs including $2,500
for the seller's attorney's fees and costs associated with utility relocation
pursuant to the plat requirements.
Section 2: The Kodiak Island Borough Assembly, in accordance with Title 18.40 of
the Kodiak Island Borough Code, authorizes the Manager or his designee
to negotiate with the seller Mary Cossette a lease of the residence on the
property to be acquired for a period not to exceed two years from the
date of close at no rent except minor maintenance and the cost of
utilities.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH THAT the Assembly recognizes that a premium is being paid for
the property, but also has balanced the cost of the premium with the additional
benefits to the Borough and chooses to allow this to take place due to the unique
value of the property to the Borough's adjoining property and the need for adequate
access for future expansion and additional utility of the property.
