A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH CONCURRING
WITH THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION
TO ACCEPT THE ACQUISITION OF TAX FORECLOSED PROPE

WHEREAS, KIB Code 18.10.140 requires the Borough Assembly to review all
recommendations made pursuant to KIBC 18.10.030; and,
WHEREAS, the Borough Assembly, by resolution, may concur in, modify or deny the
recommended real property use recommended by the Planning and Zoning Commission; and,
WHEREAS, the Borough Assembly may at any time, on its own motion or upon
recommendation of the manager, review the status of any real property previously reviewed
and change the designation of the availability with conformance to the Borough comprehensive
and use plan; and,
WHEREAS, any resolution stating real property availability may include such terms, conditions,
and procedures as may be required to protect the Borough's interest consistent with KIBC Title
18;
NOW, THEREFORE, BE IT RESOLVED BY THE KODIAK ISLAND BOROUGH ASSEMBLY THAT:
The Kodiak Island Borough Assembly concurs with the recommendation of the
Planning and Zoning Commission to accept the acquisition of certain tax
foreclosed properties without designating the properties for a public purpose.
The following properties were reviewed by the Planning and Zoning Commission
and, subsequent to a public hearing on March 20, 2002, determined to be non-
essential to meet existing or future Borough needs based on a review of
applicable Borough plans and policies.
