2002-15 Borough Land Disposal ContractKODIAK ISLAND BOROUGH RESOLUTION NO. 2002 -15 Introduced by: Manager Carlson Requested by: Manager Carlson Drafted by: Manager Carlson Introduced: 04/02/2002 Adopted: 05/02/2002 A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY SURPLUSING A PORTION OF BOROUGH LAND LOCATEL AT THE HEAD OF MILL BAY AND AUTHORIZING THE BOROUGH MANGER TO NEGOTIATE THE DISPOSAL CONTRACT WHEREAS, Kodiak Island Borough Code 18.20.120 allows the borough Assembly to authorize the Borough Manager to negotiate directly with parties interested in acquiring Borough land; and WHEREAS, Kodiak Island Borough Code 18.20.060 allows the public to apply for disposal of Borough land; and WHEREAS, Kodiak Island Borough Code 18.20.090 allows the public to bid for disposal of Borough land subject to a development plan; and WHEREAS, the Planning and Zoning Commission determined by resolution that certain lands on Lott A, U.S. Survery 3462, adjacent to Mill Bay, are surplus to the Borough's need; NOW, THEREFORE, BE IT RESOLVED BY THE KODIAK ISLAND BOROUGH ASSEMBLY THAT SECTION 1: that a portion of Lot 1A, U.S. Survey 3462, as depicted on the attached map, are surplus to the Borough's need. SECTION 2: the Assembly, in accordance with Kodiak Island Borough Code Title 18, authorizes the manager or his designee to negotiate with the applicant Pirelli- Jacobson, Inc., and /or other interested parties, in order to complete the disposal of the surplused area pursuant to Kodiak Island Borough Code Title 18, subject to the following conditions: 1. The express intent of the easement is to allow the underground installation, maintenance, operation, repair, and removal of a fiber optic cable or related system components for purposes of telecommunications. 2. The dimension of the easement interest over Lot 1A, U.S. Survey 3462 will be a minimum of 20 feet wide by approximately 180 feet in length, unless the petitioner can show compelling reason why the easement width should be less than the normal utility easement width. 3. Pirelli- Jacobson, Inc., or another certified communications utility, shall pay the Borough fair market value for the easement, as determined by the Borough Assessor. The applicant shall coordinate all cable installation activities within the easement with the Alaska Department of Transportation and Public Facilities and the Alaska Department of Natural Resources. 5. The applicant shall provide the Borough an as -built survey of the easement within 90 days of the conclusion of improvement construction within the easement.
