A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING
THE MAYOR TO ENTER INTO NEGOTIATIONS FOR CONTRACT WITH THE CITY OF PORT
LIONS FOR SCHOOL CONSTRUCTION.
WHEREAS, the Kodiak Island Borough has responded to the crisis of
the gym fire in Port Lions and is now designing a replacement facility, and
WHEREAS, the Kodiak Island Borough is satisfied with the progress
on the current contract with the City of Port Lions and Davis Constructors
and Engineers and continues to be very concerned that local village
residents be employed on this project to the maximum extant possible; and
WHEREAS, adequate technical expertise, bonding and insurance are
necessary to protect the public interest and have been provided after a
public competition by Davis Constructors and Engineers; and
WHEREAS, AS 29.35.010(13) and Kodiak Island Borough Coda
3.16.070(D) provide for direct negotiated contracts.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough
Assembly that the Mayor is authorized to enter into negotiations for
contract modification with the City of Port Lions for construction of the
school gymnasium replacement facility with the following requirements to be
mat:

1. The City of Port Lions must extend their contract with Davis
Constructors and Engineers to include the gymnasium construction
to assure technical expertise is present on the project. All
Professional Construction Management Service will be subject to
inspection by the Kodiak Island Borough.
2. The City of Port Lions must guarantee maximum local hire for the
project.
3. The City of Port Lions must obtain bonding and insurance coverage
for the project at the same levels required of other contractors.
4. The contract returned shall present a fixed price for the
construction project.
BE IT FURTHER RESOLVED that the mayor is authorized to amend the
existing contract with Port Lions to proceed with the excavation, backfill
and concrete foundations for the proposed gymnasium for a sum not to exceed
$120,000.
By
BE IT FURTHER RESOLVED that the Mayor is authorized to go out for
bids if the negotiations break down or reach an impasse.
PASSED AND APPROVED this 17 day of December, 1987 by the Kodiak
Island Borough Assembly.
