1987-69 Supporting Study of the Single Unit of Local Government Concept.Resolution No. 87 -69 -R pa.-o 1 By: Lorne White Introduced: 11/05/87 Adopted: 11/05/87 KODIAK ISLAND BOROUGH RESOLUTION NO. 87 -69 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH RELATING TO FORMATION OF A CONSOLIDATION COMMITTEE TO STUDY THE SINGLE UNIT OF LOCAL GOVERNMENT CONCEPT. The Borough Assembly and the City Council acknowledge the importance of the following general principles and agree that they should serve as guidelines for the formation and functioning of any committee which is formed to study the possible combination of local governments: '1. The study committee to be formed as a result of the passage of Proposition No. 2 on the October 6, 1987 Borough ballot requires the cooperation of the Borough Assembly, the City Council, and other local governmental entitles within the Kodiak Island Borough in order to function efficiently and productively. 2. It is of considerable importance that the committee not prejudge the issues which it will study and that it not become identified with or regarded as a „creature of any particular political faction or level of government. 3. Both appointments to the study committee and the development and implementation of procedures for its operation should be handled in such a way as to promote the goal of assuring both the appearance and the reality of ifairness and open- mindedness. 4. In order to function most effectively, the study committee should have 'access to competent legal advice and reasonable staff support. NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly, in order to further the foregoing principles, the Assembly agrees to the following: E 1. The Borough Assembly shall appoint the Borough's representative and the City Council the City's representative to the study committee. All other individuals selected to serve on the committee will be appointed jointly by the Borough Assembly and the City Council, the concurrence of both bodies being a prerequisite to each such appointment. 2. The committee will study and report upon all alternatives for local government within the Kodiak Island Borough and will not initially focus upon any single predetermined option or procedure for combining local governmental entities or allocating powers and responsibilities between them. After the initial investigation period, the group shall focus upon consolidation and one other form of combining local governments. The final report shall be submitted no later than December 31, 1988. 3. The mandate of the committee will be to collect information and to provide a forum for public testimony and discussion relating to the cost, quality and method of delivery of local governmental services and the procedures for avoiding or reducing duplication of effort and conflict between different bodies of agencies of local government. The committee will not draft, circulate, or endorse any petitions seeking or recommending specific changes in local governmental entitles within the Kodiak Island Borough and the Borough Assembly and City Council will comply with all requirements of Alaska law with actions r♦ to any Nnns ..hich. b� suggested by rtz recommendations -- - .._.. ._.... may _. a ^ ^ ...,. .. . Both the Borough Assembly and the City Council will authorize their respective attorneys to provide advice and counsel to the committee and the committee will be encouraged to seek such advice on appropriate issues of both procedural and substantive law. The Borough and City attorneys will be encouraged to cooperate with one another and copies of any written opinions rendered to the committee by either shall be made available to both the Borough and the City. 5. The Committee shall be composed of nine individuals as follows: one from the Borough Assembly of the Assembly's choice; one from the City Council of the Council's choice; one representing the villages of Port Lions, Old Harbor, and Ouzlnkle of their choice; one representing the villages of Akhiok, Karluk, and Larsen Bay of their choice; and the remaining five members to be jointly agreed upon by the Assembly and the Council with two representing the City, two representing the area outside the City and one at- large. In the event of east -side villages and /or the west -side villages submit more than one name each the Assembly and the Council will jointly make the final choice. The Borough and the City agree to equally share the travel costs of the village representatives' attendance at the committee meetings. 6. The name of the task force shall the Consolidation Committee and shall operate under the procedures provided in KIB Code Section 2.39. PASSED AND APPROVED this 5 day of November , 1987.
