1986-27 Amending Chapters 17.06, 17.13, 17.16, and 17.18 Relating to Home Occupations missing signatureKODIAK ISLAND BOROUGH ORDINANCE NO. 86-27-0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTERS 17.06, 17.13, 17.16 AND 17.18 RELATING TO HOME OCCUPATIONS. The Kodiak Island Borough Assembly hereby ordains that: #I Section 1: This ordinance is of a general and permanent nature and shall become a part of the code of ordinances of the Kodiak Island Borough. Section 2: Section 17.06.320 of the Borough Code is hereby repealed and replaced as follows: Section 17.06.320 Home Occupations. Means a business, profession, occupation or trade, located entirely within a residential building, or an accessory structure which use is accessory, incidental and secondary to the use of the residential building for dwelling purposes and does not change the essential residential character or appearance of such building or neighborhood. A home occupation may be conducted in a dwelling unit or in a building accessory to a dwelling unit provided that: A. Only one nonresident, at a time, and the resident(s) of a r dwelling unit may be engaged in the home occupation on the premises. B. If a nonresident is engaged in the home occupation on the premises an additional off-street parking space shall be provided. C. The home occupation shall occupy no more than twenty-five (25) percent of the dwelling's floor area including storage of wholesale or retail stock -in -trade (excluding the basement and garage from this calculation). D. There shall be no change in the outside of the building or premises nor shall there be other visible evidence of the conduct of such home occupation on the property other than one sign not exceeding four (4) square feet in area and non -illuminated. E. Vehicles making deliveries shall not be parked on the site for a period exceeding two hours and only between the hours of 8:00 a.m. and 8:00 r— p.m. F. No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes or odors detectable to the normal senses off the lot. No equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises or causes a fluctuation in line voltage off the premises. Section 7: Section 17.18.030 of the Borough Code is hereby amended by deleting: A. Home Occupations; and relettering the subsequent items. None Unanimous C. Ordinance No. 86-27-0 Amending Chapters 17.06, 17.13, 17.16 and 17.18 Relating To Home Occupations. BARKER, seconded by GREGG moved to adopt Ordinance No. 86-27-0. The presiding officer called for public testimony; there being none, public hearing was closed. Linda Freed explained the purpose of the ordinance was a result of a large number of cases coming before the Commission. She said in changing the code to reflect current conditions, home occupations as a "right" would be allowed in residential zoning districts without applicants having to appear before the commission for a public hearing. RUBLE, moved to adopt Ordinance seconded by GREGG No. 86-29-0. The presiding officer called for public testimony. Wayne Sewell, President of Firefighters Local 3054 and secretary to the Island Firefighters Association, stated that inflation, austerity budgets, and declining state and federal revenues were causing cutbacks in fire protection services. He felt that re- sponsible, planned, efficient consolidation of the present three fire service districts into one district would be a cost effec- tive way of combating the problem.
