May 14, 2009
A special meeting of the Kodiak Island Borough Assembly was held Thursday, May 14, 2009 in
the Borough Conference Room of the Kodiak Island Borough Building, 710 Mill Bay Road. The
meeting was called to order at 7:30 p.m.
Present were Mayor Jerome Selby, Assembly members Pat Branson, Jerrol Friend, Judy Fulp,
Dave Kaplan, Chris Lynch, and Louise Stutes. Staff members present were Manager Rick
Gifford, Finance Director Karl Short, Borough Clerk Nova Javier, and Deputy Clerk Marylynn
McFarland.
BRANSON moved to excuse Assembly member Jeffrey who is out on personal leave.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
CITIZENS' COMMENTS
Theresa Peterson spoke about the rock fish pilot program and it being the first limited access
fish program to go through the NPFMCI process under the reauthorized Magnuson Stevens Act.
Brian Younq, Dennis Hilsinaer, Glenn Mathes, Kelly Younq, Sara Reed, Gary Carver, Janet
Wente, Nichole Witt le, Mary Mathes, Tom Schwantes, and Dale Rice spoke regarding the "B"
tracts located in Womens Bay, the maintenance of the haul roads, the issue of putting the lease
out for bid, and the conditions of the existing and future leases.
Shawn Dochtermann and Stephen Taufen spoke to the issue of the North Pacific Fishery
Management Council taking action that reduced the total number of longline and pot cod Limited
License Permit (LLP) holders in the Gulf of Alaska.
Mike Anderson spoke in support of Brechan Enterprises, Inc. leasing the "B" tracts located in
Womens Bay.
Jascha Zbitnoff, representative from Brechan Enterprises, explained the road maintenance
procedure for the haul roads and the role the service area board plays in the process.
CONSIDERATION OF MATTERS IN THE CALL FOR THE SPECIAL MEETING
A. Resolution No. FY2009 -33 Authorizing the Approval of a Renewed Short-Term Lease and
Material Sales Agreement with Brechan Enterprises, Inc. For Tracts B1, 62, B3 AND B4 -A,
Bells Flats Alaska Subdivision.
FRIEND moved to adopt Resolution No. FY2009 -33.
The Kodiak Island Borough and Brechan Enterprises, Inc. entered into a material site
agreement for gravel extraction on the "B" tracts located in Womens Bay. The material found at
this site was a valuable source of aggregate for the concrete and asphalt produced on the
island. The value of this material and its limited supply had been identified by the Kodiak Island
Gravel Taskforce as the best quality material that was readily available. Staff recommended
granting Brechan Enterprises, Inc. a one year extension to the existing lease to expire on June
30, 2010. During this time period, staff and Brechan Enterprises, Inc. would finalize a long term
lease and material sales agreement.
