2000-10-19 Regular MeetingKODIAK ISLAND BOROUGH Regular Assembly Meeting October 19, 2000 A regular meeting of the Kodiak Island Borough Assembly REGULAR MEETING was held October 19, 2000 in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. The invocation was given by Chaplain White of the Star of the Sea Chapel, followed by the Pledge of Allegiance. There were present: Assemblymembers: Tom Abell Scott Arndt Tuck Bonney Absent: Mayor Gary Stevens Pat Branson Robin Heinrichs Greg Spalinger Darlene Turner comprising a quorum of the Assembly; and Dave Jensen, Manager Judi Nielsen, Borough Clerk Patti Kirkpatrick, Deputy Clerk Karl Short, Finance Director Assemblymembers Branson and Turner were absent and asked to be excused. VOTE ON MOTION TO APPROVE MOTION CARRIED Unanimous voice vote AWARDS AND AWARDS AND PRESENTATIONS PRESENTATIONS A. Proclamation PROCLAMATION Deputy Mayor Bonney proclaimed the week of October 15-21, 2000 as National School Bus Safety Week urging the community to recognize school bus drivers, the school district, and private school bus contractors for their efforts in providing safe transportation to our children, and for the citizens of Kodiak to do their part by driving carefully. B. Student of the Month STUDENT OF THE MONTH Deputy Mayor Bonney presented the Student of the Month Award for October 2000 to LeeAnn Schmelzenbach, a senior at Kodiak High School. C. Certificate of Achievement for Excellence in CERTIFICATE OF Comprehensive Annual Financial Reporting for fiscal EXCELLENCE IN year 1999. FINANCIAL REPORTING Manager Jensen presented a Certificate of Achievement for Excellence in Financial Reporting for fiscal year 1999 to Karl Short, finance director; Marian Royall, revenue accountant; and Mary Munk, general accountant. D. Employee of the Quarter EMPLOYEE OF THE QUARTER Manager Jensen presented the Employee of the Quarter Award to Gale Gardner, accounting technician/accounts payable in the Finance department. CITIZENS' COMMENTS CITIZENS' COMMENTS Beryl Lassen Senior Citizens of Kodiak president, thanked the Assembly continuing to support senior programs. Without Borough support, the senior center would be unable to provide meals on wheels or donate community service to Island Cove. Regular Assembly Meeting Volume XXVI October 19, 2000 Page 147 Pat Roth Army Corps of Engineers, advised he was no longer the project manager for the clean-up in Kodiak. He advised there would be a presentation at Safeway on Friday, October 20 from 2-6 p.m. and invited the Assembly and community to stop by. Jeff Brownlee, State of Alaska, advised he reviewed the reports and plans submitted by the Army Corps of Engineers and said they were doing a great job and was pleased with their progress. Greg Razo, Kodiak Arts Council, advised it was National Arts and Humanities month and their theme was "Arts Matters." He asked residents to examine how arts played a role in themselves and their children. COMMITTEE REPORTS None. PUBLIC HEARING A. Ordinance No. 2000-10A Amending Ordinance No. 2000-10 Fiscal Year 2001 Budget to Reflect Amendments. HEINRICHS, moved to adopt Ordinance seconded by ARNDT No. 2000-10A. Abell, Arndt, Bonney, Heinrichs, Spalinger None Branson, Turner Unanimous Manager Jensen noted this was a mid -year adjustment, which reflected actual revenues and expenses. He advised that the cash deficit in the inactive Mental Health Fund had been decreased, which allowed the fund to be closed and accurately reflected the overall financial position of the Kodiak Island Borough. Deputy Mayor Bonney called for public testimony; hearing and seeing none, he reconvened the regular meeting. Assemblymember Arndt was pleased that the mental health deficit had been resolved. Regular Assembly Meeting October 19, 2000 COMMITTEE REPORTS PUBLIC HEARING ORDINANCE NO. 2000-10A Volume XXVI Page 148 VOTE ON MOTION TO ADOPT AS AMENDED Ayes: Noes: Absent: MOTION CARRIED Arndt, Bonney, Heinrichs, Spalinger, Abell None Branson, Turner Unanimous BOROUGH MANAGER'S REPORT MANAGER'S REPORT Manager Jensen reported that the National Marine Fisheries Services (NMFS) had failed for three years to provided an adequate report and were now requesting an extension of the October 31 deadline set by Judge Zilly. He noted that Judge Zilly could not rule on his decision until NMFS submitted their report, which would hurt local residents and businesses. He would prepare a letter to Senator Stevens asking for support and relief should NMFS receive an extension. MESSAGES FROM THE BOROUGH MAYOR MESSAGES FROM THE None. MAYOR UNFINISHED BUSINESS UNFINISHED None. BUSINESS NEW BUSINESS NEW BUSINESS A. CONTRACTS CONTRACTS 1. Contract No. 2000-26 Kodiak Island Borough Oil CONTRACT Spill Response Equipment Project. NO. 2000-26 ARNDT, moved to approve Contract seconded by SPALINGER No. 2000-26 with Foss Environmental Worldwide in an amount not to exceed $227,628.77 FOB Kodiak (Lash Terminal). Manager Jensen noted the Borough received $400,000 in 1998 from the Alaska Department of Environmental Conservation (ADEC) to purchase oil spill response equipment for the Kodiak villages cities. Since then, staff secured a signed Local Response Agreement (LRA) between Akhiok, Larsen Bay, Old Harbor, Ouzinkie, and Port Lions and the ADEC. The LRA's allowed that each village would accept ownership once the equipment was placed in their communities. Equipment bids were advertised and four bids were received. He recommended the Assembly award the bid to Foss Environmental Worldwide in an amount not to exceed $227,628.77 FOB Kodiak (Lash Terminal). Regular Assembly Meeting Volume XXVI October 19, 2000 Page 149 In response to Assemblymember Heinrichs, City Manager Linda Freed noted the bid was competitive and that Foss was a reputable business. Resolution No. 2000-30 Ratifying and Certifying RESOLUTION the Results of the Municipal Election Held NO. 2000-30 October 3, 2000. ARNDT, moved to adopt Resolution seconded by SPALINGER No. 2000-30. Clerk Nielsen said the corrected version was available to the public and included the absentee and questioned votes. Resolution No. 2000-31 Adopting an Alternative RESOLUTION Allocation Method for the Fiscal Year 2001 NO. 2000-31 Shared Fisheries Business Tax Program and Certifying That This Allocation method Fairly Represents the Distribution of Significant Effects of Fisheries Business Activity in the Kodiak Island Borough. SPALINGER, moved to adopt Resolution seconded by ARNDT No. 2000-31. Manager Jensen said this annual resolution was required by the Department of Community and Economic Development to provide for alternative distribution of the shared fisheries business tax, which shifted more funds to the villages and away from the Borough. This program was designed to provide funding to villages that home port fishing vessels, but have no processing plants. He said the allocation formula was the same as previous years; however, he noted in fiscal year 2000, because the City of Regular Assembly Meeting Volume XXVI October 19, 2000 Page 150 Kodiak used the long form, the Borough was required to use the long form. Assemblymember Heinrichs hoped the City and villages would agree to the use the short form method, noting the smaller communities relied on the funds. Ordinance No. 2000-15 Authorizing the Kodiak Island Borough to Issue General Obligation School Bonds, 2000 Series A, in the Principal Amount of Not to Exceed $1,485,000 to Provide Funds for School and Related Capital Improvements in the Borough, Fixing Certain Details of Such Bonds and Authorizing the Sale. ARNDT, moved to adopt Ordinance seconded by HEINRICHS No. 2000-15 in first reading to advance to public hearing on November 2, 2000. Manager Jensen said Kodiak voters approved the issuance of general obligation bonds at the October 3, 2000 election. He said issuance of these bonds would take advantage of the state's debt reimbursement for approved capital projects, which included the high school roof. Assemblymember Spalinger was pleased the high school roof would be repaired. Ordinance No. 2000-16 Authorizing the Kodiak Island Borough to Issue General Obligation School Bonds, 2000 Series B, in the Principal Amount of Not to Exceed $1,175,000 to Provide Funds for School and Related Capital Regular Assembly Meeting October 19, 2000 ORDINANCES FOR INTRODUCTION ORDINANCE NO. 2000-15 ORDINANCE NO. 2000-16 Volume XXVI Page 151 Improvements in the Borough, Fixing Certain Details of Such Bonds and Authorizing the Sale. HEINRICHS, moved to adopt Ordinance seconded by ARNDT No. 2000-16 in first reading to advance to public hearing on November 2, 2000. Manager Jensen advised this would allow the Borough to issue taxable bonds to take advantage of the state's debt reimbursement for approved capital projects, which included the repairs and upgrades to Peterson Elementary. Assemblymember Heinrichs was pleased to take advantage of the state's provisions to recoup 70% of the funds expended on Peterson Elementary. Assemblymember Spalinger was pleased and hoped the excess funds could be used for other needed school repairs and upgrades. VOTE ON MOTION TO ADVANCE Ayes: Noes: Absent: MOTION CARRIED D. Borough Clerk Nielsen administered the Oath of Office to newly -elected Assemblymembers Greg Razo and Wayne Stevens. 2. Presentation to Outgoing Assemblymembers. This item was removed from the agenda. CITIZENS' COMMENTS None. ASSEMBLYMEMBER COMMENTS Assemblymember Abell welcomed the new assemblymembers. Assemblymember Spalinger congratulated Wayne Stevens and Greg Razo on their election to office. Assemblymember Heinrichs congratulated the Student of the Month, the Finance department on the Achievement in Excellence Award, and the Employee of the Quarter. Regular Assembly Meeting October 19, 2000 OTHER ITEMS OATH OF OFFICE TO NEWLY -ELECTED ASSEMBLYMEMBERS CITIZENS' COMMENTS ASSEMBLYMEMBER COMMENTS Volume XXVI Page 152 Assemblymember Heinrichs was pleased with the reports on the extension of the Steller sea lion issues. He felt the manager should draft a resolution urging the state to approve the NMFS extension. He suggested Manager Jensen contact the governor. Assemblymember Heinrichs congratulated Wayne Stevens and Greg Razo and said he was looking forward to working with them. Assemblymember Arndt congratulated the Employee of the Quarter, Wayne Stevens, and Greg Razo. He said his term as an assemblymember had been challenging and rewarding. Assemblymember Bonney welcomed Wayne Stevens and Greg Razo aboard. He enjoyed working with Assemblymembers Spalinger and Arndt and would miss them. Deputy Mayor Bonney announced that the Assembly would meet in a work session on Thursday, October 26 at 7:30 pm in the Borough conference room and a regular meeting on Thursday, November 2, at 7:30 pm in the assembly chambers. He reminded the community that the general election is Tuesday, October 3, 2000, and voters who would be out of town on election day could vote absentee in-person at the Borough clerk's office October 23 through November 6. Anyone unable to vote absentee in-person should contact the Borough Clerk's office to request a ballot by mail.
