1984-124 Authorizing The Purchase Of Protions Of Lots 1 And 3, Block 8, Miller Point Subdivision, At A Price Higher Than Appraised Value.A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
PURCHASE OF PORTIONS OF LOTS 1 AND 3, BLOCK 8, MILLER POINT SUBDIVISION, AT A
PRICE HIGHER THAN APPRAISED VALUE.
WHEREAS, the Kodiak Island Borough Assembly, by Resolution 83 -61 -R,
on June 2, 1983 authorized the Borough Manager to obtain appraisals of and
negotiate the purchase of land needed for additional right -of -way to
accommodate the construction of Lilly Drive Phase II, and
WHEREAS, the owner of Lots 1 and 3, Block 8, Miller Point Alaska
Subdivision First Addition disagreed with the appraised value, $6,100 for
9,445 square feet to be taken from Lot 3 and $1,400 for 2.114 square feet to
be taken from Lot 1 when contacted by Dale Tubbs on November 15. 1984, and
WHEREAS, the owner of Lots 1 and 3 offered to sell the necessary !.
right -of -way for $10,612 based on the reported selling price of Lot 4, Block
9, MPAS 1st, at $40,000 per acre, and
WHEREAS, Lot 4, Block 9 actually sold for a total of $40,000 for a
1.26 -acre parcel (54,886 square feet) on June 4, 1984 and was appraised for
I I $44,000 on July 9, 1984 by Joan Hughes of Island Valuation Service, Inc.. and
WHEREAS, the actual sale price of Lot 4, Block 9 would establish a
value of $8,427 for the right -of -way to be obtained from Lots 1 and 3, and
WHEREAS, the July 9 appraisal value of Lot 4, Block 9 would
establish a value of $9,270 for the right -of -way to be obtained from Lots 1

WHEREAS, Mr. Tubbs feels that the costs involved in negotiating a
counter offer will probably exceed the difference between the owner's asking
price and the price based on the July 9, 1984 appraisal.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly,
that the Borough Manager is authorized to purchase the following parcels:
Lot 1, Block 8 MPAS First 2.114 i square feet $1.941
Lot 3, Block 8 7,445 r square feet $10,612
