( INC. TO OPERATE AS A SEWER UTILITY WITHIN THE KODIAK ISLAND

WHEREAS, the Department of Commerce, Public Service
Commission issued its Certificate of Public Convenience and Necessity
No. 84 to Karluk Land, Inc. authorizing the aforesaid to operate as'
a sewer utility within the confines of the Kodiak Island Borough
which Certificate is dated March 29, 1967, and covers property
within the Kodiak Island Borough described as:
Lots Four (4), Five (5), Six (6), Seven (7),
Eight (8) and Nine (9), Block Four (4)
Southeast Addition No. 2 U.S. Government
Surveys No. 3468, 3098, 3511, 1822, 2843, 3467,
2739, 3233, 3099, 3469, 3218, 3465, 3466, 3104,
3103, 3102, 3219, 3463, 3462, 1682, 3512, 3100,
and 3101, and

WHEREAS, some of the area above described has since been

' annexed into the City of Kodiak and can better be served by extension.

area above described is being serviced by a sewer line constructed
by Champion Construction Company for the Kodiak Island Borough to
service the East Elementary School and a portion of the area above
described and on which Karluk Land Inc. has constructed a portion
of its sewer was being purchased by them on contract from the State:
of Alaska, which contract has now been terminated and a large portion
of the area above described is not now being served by Karluk Land,'
Inc., nor are any lines now being constructed to serve the said
area nor is any such construction contemplated in the foreseeable
future and the Kodiak Island Borough Assembly being of the opinion
that the Certificate of Public convenience and Necessity issued to
Karluk Land, Inc. as it now exists serves no useful purpose but is
rather a detriment to the property owners in said areas and the
community as a whole.

NOW THEREFORE BE IT RESOLVED that the Kodiak Island
Borough: Assembly go on record as protesting the Certificate of
Public Convenience and Necessity No. 84 issued to Karluk Land, Inc.
on March 29, 1967, by the Alaska Public Service Commission as it
now exists and that the Alaska Public Service Commission be asked
to reconsider the confines of the service areas set forth therein
and reduce the same to the area actually occupied by a sewer line
owned by Karluk Land, Inc. and being serviced by it.
