1967-05 Approving Of Vacation Of A Certain Portion Of Fourth Avenue (Elledge, Keplinger, Wenholz, Cannon).)
WHEREAS, J. W. ELLEDGE, RONALD and JEANINE KEPLINGER,
RICHARD and CAROL WENHOLZ, W. A. CANNON and MARGARET CANNON have
P. petitioned the KODIAK ISLAND BOROUGH for the vacation of a certain
portion of Fourth Avenue, situated in the City of Kodiak, Third
Judicial District, State of Alaska, and described as:
That platted but unimproved avenue in the plat
of the East Addition to the Townsite of Kodiak
between Blocks Thirty (30) and Thirty -one (31)
known as S. Fourth Avenue, extending in a generally
Northeasterly and Southwesterly direction from
"J" Street, known as Rezanof Drive, to the North
and Mission Road on the South, and on which Lots
One (1), Two (2) Three (3), and Four (4) o f
Block Thirty (305, and Lots Eight (8) Nine (9),
Ten (10), Eleven (11), and Twelve (12), Block
Thirty -one (31) of the East Addition to the
Townsite of Kodiak abut, and
WHEREAS a public hearing in accordance with law was
held by the Planning and Zoning Commission of the Kodiak Island
Borough on the twenty- eighth (29th) day of December, 1966, and
WHEREAS, after said hearing, the Planning and Zoning
Commission approved the vacation of said avenue as indicated in
Drawing No. MIS670130T0, prepared by Barr and Associates of
P Kodiak, Alaska, a copy py of which is attached hereto, and
WHEREAS the CITY OF KODIAK has approved said vacation
by its Engineer, R. A. Jones, and
KODIAK ISLAND BOROUGH
RESOLUTION NO. 67 -5 -R
WHEREAS all owners of property affected by said vacation
and whose property adjoins said Fourth Avenue have approved the

vacation and have indicated their approval by signing said Drawing,
and
WHEREAS the relief
prayed for in said petition is
consistent with good planning and zoning practices and promotes

ATTEST:
NOW, IHEREFORE, BE IT RESOLVED that Fourth Avenue in
the City of Kodiak be vacated in accordance with AS 40.13.140
et seq. and the title to said avenue attached to the lots or
lands bordering on the area in equal proportions, as provided
by AS 40.15.180.
