A regular meeting of the Kodiak Island Borough
Assembly was held May 20, 1993 in the Assembly
Chambers of the Kodiak Island Borough Building
710 Mill Bay Road. The meeting was called to order
at 7:30 p.m.
Presiding Officer McFarland led the Pledge of
Allegiance.

COMMITTEE REPORTS
Tom Peterson, Planning and Zoning Commissioner,
reported on Commission approval of nine new rural
development rezone requests. He was available to
answer questions.
Assemblymember Hancock informed the Assembly that the
vote by the Kodiak College Advisory Board on leasing
property to Carr's Grocery Store was scheduled for
May 27, 1993. She said public input was valued.
All ordinances and resolutions presented at this
meeting were introduced by title only and copies made
available to the public.

Presented for consideration was Ordinance No. 93 -26
which, if adopted, rezoned land consistent with the
type of development that private land owners want to
develop in remote areas of Kodiak Island.

Mayor Selby deferred to Duane Dvorak, Community
Development Department associ planner, to respond
to Assemblymember questions. Mr. Dvorak directed
attention to maps available in the chambers and
explained that since the property was a non-
conforming lot, a small scale lodge was not permitted
without a conditional use permit. He noted that the
property was presently vacant.
In response to questions raised, Mr. Dvorak stated
there were four rural development zoned properties in
Ugak Bay and Hidden Basin. He explained that a
minimum lot size of five acres was required to
conform with rural development zoning guidelines.
Presiding Officer McFarland opened the public
hearing.
Nell Murray asserted that a clearly defined coastal
management plan was needed for rural Kodiak.
Willie Heinrichs, rezone applicant, contended that
previous rezone requests were approved and urged the
Assembly to consider subsequent rezone requests on an
individual basis. He agreed that review of the
coastal management plan was necessary.
Mr. Henrichs and Assemblymember Fitzjearl discussed
the attributes of a moratorium to stop future rural
development zoning.
Claudia Echavarria informed the Assembly of her
studies of Kodiak's eco system. She contended that
the eco system was fragile and suffered with
increased public use. She said the Karluk Lake area
embraced critical bear and salmon habitat and
cautioned the Assembly to look carefully to the
future. She submitted four letters to the Clerk
opposing the Karluk Lake rezones.
Toni Munsey, lifetime Kodiak resident, was not
opposed to lodges but felt it was important to
establish a clear plan for development.
Mike Munsev, owner of Munsey's Bear Camp, was
confused at the effect of a moratorium. He was
concerned that lodges would not continue to operate
because of conservation zoning restrictions but
agreed that impact to natural resources was a
concern.
Presiding Officer McFarland closed the public hearing
and reconvened the regular meeting.

VOTE ON MOTION TO ADOPT
Assemblymember Gould was of the opinion that the
Assembly moved in a positive direction by hiring Jon
Isaacs and Associates to complete the Coastal
Management Plan study. He was generally opposed to
rural development zoning.
Assemblymember Austerman was concerned not with
coastal areas but with interior areas of Kodiak
Island.
Assemblymember Fitzjearl gave a synopsis of permitted
uses in rural development and conservation zoning
districts. She had mixed emotions regarding rural
development zoning and suggested a moratorium until
completion of the Jon Isaacs and Associates' study.
Assemblymember Monroe hoped for additional discussion
and public input.
Assemblymember Milligan envisioned quality life on
Kodiak and questioned whether there was sufficient
information to deny rezone requests.
Assemblymember Hancock noted the lack of response to
public hearing notices and agreed that all rezone
requests required individual review.
There was general discussion with Mr. Dvorak on
permitted uses in wildlife habitat, conservation and
rural development zoning districts.

mailed and 41 received opposing the rezone.
Presiding Officer McFarland asked for staff comments.
Duane Dvorak, Community Development Department
associate planner, explained that rural development
zoning allowed small scale lodges on a minimum of
five acres, set net sites with multiple units, and
large scale lodges with conditional use permits. He
said lots under five acres were non - conforming and
allowed limited permitted use of one dwelling per
acre. He added that lots less than one -half acre had
revised set back requirements appropriate for the lot
size.
Mr. Dvorak highlighted the physical characteristics
of the property in each ordinance:
Ordinance No. 93 -27: A non - conforming lot of 4.72
acres with four cabins /accessory structures that
supported a fish site.
Ordinance No. 93 -28: Conservation zoning allowed one
public access cabin. Rural development zoning
permitted conversion of the cabin to a lodge
operation for a maximum of ten guests. A conditional
use permit allowed additional guests.
Ordinance No. 93 -29: The property supported
commercial hunting, fishing, and a recreational lodge
for a maximum of ten guests. A conditional use
permit allowed additional guests.
Ordinance No. 93 -30: Rural development zoning
permitted property owners to develop three cabins on
the property into lodges.
Ordinance No. 93 -31: The existing cabins were
established by the fish and wildlife service prior to
acquisition by Koniag. The property owner indicated
a desire to develop a lodge and airstrip with
ancillary facilities.

Ordinance No. 93 -32: There was one cabin on the
property for recreational use There was a desire to
establish a small scale lodge in the future.
Ordinance No. 93 -33: Rural development zoning would
bring the existing Zachar Bay Camp into compliance
with the code.
Ordinance No. 93 -35: The intention was to convert
the old Rendezvous site into a personal residence.
It was noted that it was down - zoning in that it
allowed less intensive development and use.
Ordinance No. 93 -36: Contained six parcels in an
urban area near Woodside Manor, a multi - family
residential development permitted by exception.
After a ten minute recess at 9:10 p.m., Presiding
Officer McFarland reconvened the regular meeting.
Bob Pfutzenreuter, on behalf of the Audubon Society,
urged the Assembly to establish an appropriate land
management plan to safeguard critical bear habitat.
He contended that people caused irreparable damage to
the environment.
Mike Munsev stated that the Karluk area was a prime
bear denning area and human presence displaced the
bears.
Wes Wiley, Ordinance No. 93 -27 rezone applicant,
telephoned to explain that his fish site would comply
with borough code if rezoned rural development.
Marty Shuravloff, Kodiak Island Housing Authority
representative, was available to answer questions.
Paul Chervenak, Ordinance No. 93 -33 rezone applicant,
answered questions regarding the number of guests
utilizing his lodge.
Nell Murray asked the Assembly to consider the
negative impact of four lodges on the Karluk River.

the property. He anticipated the number of lodges to
be minimal as it was not economically feasible to

MESSAGES FROM THE BOROUGH MAYOR MESSAGES FROM
MAYOR
Mayor Selby welcomed Prince William Sound Regional
Citizen's Advisory Council members to Kodiak. He
thanked the Council for efforts to include Kodiak in
plans to prevent future oil spills.
He reported that the National Guard was to transport
king salmon smolt to Kodiak. He anticipated a
reduced death loss of five percent over the previous
year.
He announced that the Capital Grants Project Bill and
Offshore Fish Tax Bill were passed by the legislature
while he was in Juneau.
He reported that fiscal year 1994 work plan comments
submitted to the Exxon Valdez Trustee Council urged
the Council to use the comprehensive restoration plan
as a funding guideline. He anticipated funding of
the Red Lake restoration project and the Fish Tech
Center.
He foretold that construction amounting to $35
million was planned in Kodiak.

building was a financial drain to the Borough.

Presented in first reading was Ordinance No. 93 -10
which, if adopted, set the tax levy for fiscal year
1994.

Mayor Selby explained that the budget was increased
from 5.5 mils to 6.0 mils over the previous year. He
said the increase represented a revenue increase of
approximately $370,000. He gave a synopsis of
specific changes.
Presiding Officer McFarland contended that budget
discussion was important, he felt the aaee...t..iy
was fiscally responsible in their approach. He 7
strongly urged the press to report on the budget
process in a factual manner to avoid prejudices.

The Assembly generally agreed that minutes of
Planning and Zoning Commission meetings were required
on rezone issues before the Assembly for public
hearing.
Presiding Officer McFarland requested that the Clerk
research Roberts Rules of Order for fabling
procedures.
Assemblymember Gould appreciated those who spoke to
zoning issues.

Assemblymember Fitzjearl requested a tour of the
hospital. She asked that Koniag, Inc.
representatives be present during Karluk rezone
discussion. She appreciated fellow Assemblymembers
for the budget process. She announced that Kalsin
Bay Inn was hosting a fund raiser for Hope Cottages
on May 21, 1993. She reported that representatives
of the Governor's Council on Disabilities and Special
Education were meeting in Kodiak.
Assemblymember Austerman asked for a narrative budget
report with a fifteen -year analysis of the tax rate.
Assemblymember Monroe thanked those who spoke on
rezone issues. She appreciated Jane Edmonds, records
coordinator, for maintaining the Clerk's Office with
limited staff.
Assemblymember Hancock was sensitive to remote area
concerns and appreciated public input.
Assemblymember Milligan thanked Charlie Cole and
Ralph Eluska for their efforts to purchase Seal Bay.
He was sensitive to potential bonding in the fall.
He thanked those who spoke to rural development
rezoning.
Presiding Officer McFarland announced the Assembly
would meet in work sessions on Wednesday, May 26,
1993, at noon and Thursday, May 27, 1993, at 7:30
p.m. in the borough conference room and regular
meeting on Thursday, June 3, 1993, in the assembly
chambers.
