The meeting was called to order by Presiding Officer Betty Springhill at 7:32 p.m.
in the Courtroom of the State Office Building, Kodiak, Alaska.

A. Assembly - regular meeting - 12/4/69 - one correction noted. insert word "out"
in Paragraph B title, under XII to read "taxation without Representation"
Mr. Sutliff asked for unanimous consent in approval of the minutes as corrected,
there no objections the minutes were so a c�ov .
A. P&Z - regular meeting 12/10/69 - There were no comments
B. School Board - regular meeting 12/8/69 - It was noted in the minutes that the
Borough Chairman has been requested by the School Board for a clarification of •
the action taken during the rezoning of the Bells Flats' area. The Chad/min
has written to the School Board requesting a resume of the discussion held on
this matter and specific questions concerning same in order that a reply can be
given. The intent of the Borough Assembly in this matter was discussed and the
point node that since it has not been determined exactly where the larger part
of the population would be in the Bells Flats area that the reserve for a school
site should be made once this has been determined. Further there is ;xdlii tional
land availabi: that might be more suitable.
V CORRESPQIDIIaZ AND APPEARANCE REQUESTS - NONE
A. 2nd Reading and Public Hearing, Ordinance: Nov. 69 -35 -0 Ammdinng Chapter 6,
adding Section 3.2 which allows repurchase of tax foreclosed lands by recorded
owner. The Ordinance: was read in full by the Borough Chairman, at whist time
a brief background was given on the reason for the ordinance. The Borough Code
he r na.provisiai for disposal of tax foreclosed land other than by public auction
this amendment would allow for re-purchase by the owner or norgatee prior to a
public auction. D. Naughton moved for the adoption of Ordinance 69 -35 -0,
seconded by Mr. Arndt. The regular meeting was recessed and the Public Hexing
opened. Mr. Stetter voiced the opinion that this would be a very good orin:nce:
to pass. Mr. Naughton asked if the land were not re.- purchased by the recorded
owner would it then go up for public auction and this was answered in the affirmar
Further noted by thee Chairman that as read in the Ordinance, the property would ix
sold for the full amount applicable to the property under the Judgement of
Rareclosure: would mean the court costs plus the taxes, penalty and int.sest.
The Public Hearing was closed and te regular meting reconvened. The question
was called and motion passed by unanincus roll call vote.
B. 2nd bearing, Public Hearing, Ordinance 69.36 -0, Amending Chapter Three: by dufinirm
"R_al property" for purpose of taxation. The Ordinance was rued in full by the.
Borough Chaiaeun. Mir. Sutliff moved for the :dcption of Ordinanc 69 -36 -0,
seconded by Mr. Naughton. The regular meeting was recessed and the Public huarine
opened. The Borough Chairman gave short resume on the ordinance, noting that it
was drawn up in order that persons wiShing to improve their property world not
be penalized for this by have the assessed valuation increase. There: w&n_ no
moments from the audience and the Public Hearing was closed. The meeting re-
convened; the question was called and the motion passed by =mimes roll call
vote.

C. 2nd Reading, Public Nearing, Ordinance 69 -3 -0 zoning of Russian Cre k Subdivision
am Gills Flats Sdhalvlsion, road in full by the Borough Chairman. Mr. Sutliff
moved for the adoption of Ordinance 69 -30 -0 s domed by Mr. Arndt. The mating
was recessed and the Public Hearing Opened. Mr. Largo indicated that he would
like to have. the 'r'ca known as Tract A classified 's 'Unclssifi:d" and felt that
otters in the: area walla go along with this action. During the discussion of
this point, :ir. Naughton mead from the. Cc& the stipulations of both zonings
"Unclassified" and "Imustri 1" If Tract A were to be zoned unclassified"
this would tend to make others in the rata corking borrow sites illegal u,,dar the
zoning. The Borough Chairmen suggustua that .Ir. Large should seek an exception
for his imm di'te area as Mr. Large hod indicated that he planned to live on this
particular picce of land; a cretker residence is allowed under Irdustria1.1
Thera being no other comments the Public Flooring was closed and the regular m eta

Ordinno` 69 -37 -0 in tlx:: first reading, seconded by Mr. Naughton. The: Borough
Chrimran read from tlx: minutes of the Planning & Zoning Commission, stating that
this was being requested as the majority of the area is businss and zoning would
be in keeping with the present use:. The: question was called and motion carried

C. Setting Date for January Meetings: Since there are five Thursdays in the nu nth
o anuary awn s suggested that the nusirngs be moved back
one Thursday, thereby setting January 8th and 22nd as Borough Assembly mating
data and January 15th and 29th for City Council. The assembly was in agr.,umnt
with this if tlx: City Council concurs.
The Borough Chiba' coin stated that a letter had boom written to the State. Division
of Lads and Mr. Ftllbcrk and Mr. Tubbs will be present at the first mating in
January to discuss mn.ny of the questions that haw: arisen in the. past months
on possible Lend sales; Bells Flats; Port Lions and lots in the Mmashka Bay
and Puller Point Subdivisions as well as re -sale of the Kedisk Subdivision.
The Chairman further stated that he was of the opinion that Lads in the Port Lim
area should be sold.- with the proceeds rcturnd to Port Liens for d velopmnt Of
that &nnsnity as long as the survey its are recovered for the Borough.
It is hoped that in the future surveys can be paid for in advance nether than
waiting -for the sale of the land after survey.

A. Letter fran Civil Def.zse received for informntion pies noting ustabtis rent

pest City Council mating and it was indicated that the Council was in agrament
the Director should be the City inrgur's office rather than the person, another

access to emergency crews and .equipment, the School Superintere nt and President

for the Villages. The Borough Assembly concurred with this idea and the
Borough Ch..iaren will proceed in this direction.

C. Sale of ldutien Homes - as this had been previously discussed at the Qty Counci,
The Borough Chairman asked one of the City represonttivcs to give short resume.
The City Council had discovered that the houses were up to the present building I
coda, the utilities are in fact owned by the City and that the:: was no reason
that the hags should not be sold or in fact that the City hal any rue son to b:,
involved. It was pointed out by another minter of the assembly that the Borough
might be interested in so far as the sale prig: might not be as high as tlx:
assessed valuation and there_ might be a possible loss in the dollars
D. Request for Executive Session - The Borough Chairman requested a short executive'
session at the close of the regular meting in order to discuss the applications_
for the position of Clerk/Treasurer.

A. Trailer Park Ordinance - Mr. Arndt requested to know At.) status of the ordinance
and it was noted that the P &Z Commission is working on the revision of the
ordinance.
B. Mr. Naughton - the Civil Defense representatives when hre for conference
indi.catled that the School had full responsibility for the welfare and safety
of thaw. t1dron while in school and An iv..ughton felt that this night be useful
in s dbm; a radio set -up for the village schools in order that warnings could

The Presiding Office thanked the many delegates from the School that were present
in the audience.
A. bit. Large - wanted to suggest that perhaps the Borough might be able to select
sane of the surplus laud that is located at present on the Naval Reservation.
The Borough Chairman indicated that in a conference: not long ago, the Navy stated
that they were in the process of oh:dicing on any surplus land in tlx.: area and
old advise the Borough of sane: if any were - vail:ble.
