1976-45 Relating To The Acquisition By The Kodiak Island Borough Of The Power To Provide Recreation Facilities In The Borough Area Outside Of The Cities.KODIAK ISLAND BOROUGH RESOLUTION NO. 76 -45 -R A RESOLUTION RELATING TO THE ACQUISITION BY THE KODIAK ISLAND BOROUGH OF THE POWER TO PROVIDE RECREATION FACILITIES IN THE BOROUGH AREA OUTSIDE OF THE CITIES. WHEREAS, the Kodiak Island Borough is authorized by the provisions of AS 29.48.030(a)(14) to exercise the powers necessary to provide recreation facilities; and, WHEREAS, the Kodiak Island Borough is prohibited by AS 29.48.030(b) from exercising the powers to provide recreation facilities until the power has been assumed in the manner pro- vided by AS 29.38.010 through .050; and WHEREAS, the procedures for acquisition of the power require the assembly to hold at least one public hearing on the question and following such hearing to evaluate the ability of the Borough to exercise the powers and to make such findings public; and, WHEREAS, a public hearing was held on the 2 day of „e , 1976, in the municipal offices for the Kodiak Island Borough and based on the information produced at that public hearing and other information available to the members of the Assembly, the Assembly has made findings which are attached to this resolution and have determined to order an election on the question in the Borough area outside of cities. NOW THEREFORE, be it resolved by the Kodiak Island Borough as follows: SECTION 1. An election is to be held on Tuesday, October 5, 1976, in and for the Kodiak Island Borough, Kodiak, Alaska and the following proposition shall be submitted to the qualified voters of the Kodiak Island Borough residing Page One, Resolution No. 76 -45 -R r *? 7 ATTEST: outside the cities for approval or rejection. A majority of those electors qualified and voting in favor of the proposition shall be required for approval. PROPOSITION NO. Shall the Kodiak Island Borough assume and exercise the powers necessary to provide recreational facilities. SECTION 2. The foregoing proposition shall be printed in full on a ballot and the following words shall be added below or next to the proposition as appropriate and next to a square provided for marking the ballot. A person may vote on this proposition at the general election who resides in the Borough area outside the cities and who possesses the qualification as set forth in AS 14.04.010 and Section 2.04.190 of the Kodiak Island Borough Code of Ordinances. The election shall be conducted in compliance with procedures established by Cha ter 2.04 of the Kodiak Island Borough Code of Ordinances.
