RESOLUTION NO. 89-40-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
DISPOSAL OF BOROUGH LAND IN WOMENS BAY TO THE KODIAK ELECTRIC ASSCOIATION FOR
PUBLIC PURPOSES.
WHEREAS, Section 18.20.030 of the Borough Code requires the review and
recommendation by resolution of each disposal of Borough real property by the
Planning and Zoning Commission; and
WHEREAS, Section 18.20.170 defines "disposal" as any transfer of real
property; and
WHEREAS, Section 18.20.100 allows for property disposal at less than fair
market value to a non- profit association upon a finding by the Assembly that
the disposal will allow the use of the land for a public purpose beneficial to
the Borough; and
WHEREAS, the Planning and Zoning Commission has held an advertised and
noticed public meeting on the disposal and recommends that the property be
declared surplus to Borough needs; and
WHEREAS, the Planning and Zoning Commission determines that it is in
appropriate to dispose of a partial Borough interest in this property in order
to economically provide improved electrical service for the Russian Creek
Alaska Subdivision area.
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island Borough Assembly
finds that it is in the public interest to dispose of a partial interest in
Borough real property for an electrical easement to the Kodiak Electric
Association on a portion of Lot 1, U.S. Survey 2519, and Tract B -1, Bells Flats
Alaska Subdivision as depicted in the preferred alternative and authorizes the
Mayor to negotiate a less than fair market value disposal. Subject to the
following conditions;
Condition 1: If it is determined by the Borough that the easement
described herein is not used for electrical power purposes,
said easement shall be revoked by the Borough.
Condition 2; Overhead electrical lines will be permitted on borough land
only for the purpose of crossing the stream bed of Russian
Creek. Electrical lines located on other borough lands
will remain underground.
