1989-26 Establishing a Committee of the Assembly to Obtain Input from Borough Employees Concerning Methods of Improving Communication among the Employees, the Assembly, and the Administration.By: Drafted by: Introduced: Public Hearing: Amended: Adopted: KIB Assembly Borough Attorney 4/20/89 4/20/89 4/20/89 4/20/89 KODIAK ISLAND BOROUGH RESOLUTION NO. 89 -26 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY ESTABLISHING A COMMITTEE OF THE ASSEMBLY TO OBTAIN INPUT FROM BOROUGH EMPLOYEES CONCERNING METHODS OF IMPROVING COMMUNICATION AMONG THE EMPLOYEES, THE ASSEMBLY, AND THE ADMINISTRATION WHEREAS, the employees of the Borough desire to have a mechanism for providing input to the mayor and assembly on issues which will affect the terms and conditions of Borough employment, and WHEREAS, the assembly desires to obtain this input so that employee desires can be considered in making decisions which affect the employees, and WHEREAS, the Borough is permitted under state law to seek employee input; and WHEREAS, the assembly regards such input as beneficial to both employees and to the Borough, and WHEREAS, establishing a dialogue among the employees, the assembly, and the administration would be useful in furthering harmony and efficiency in the daily operations of the Borough, and would therefore enhance the public health, safety, and welfare, and WHEREAS, the employees have the right under the constitutions of the United States and the State of Alaska to organize themselves, or to refrain from organizing themselves, in any manner which they choose for the purpose of lobbying the assembly and administration for particular rights in the employee /employer relationship, and WHEREAS, the assembly respects this right and does not desire to interfere with the employees' exercise thereof, and WHEREAS the Kodiak island Borough is located in a remote geographic location and is responsible for providing essential public services such as water, sewer, fire protection, road maintenance, garbage disposal, health care, animal control, recreation, and planning and zoning, which cannot be provided by any other entity, and Resolution No. 89 -26 -R Page 1 of 3 WHEREAS, all revenues received by the Kodiak Island Borough are used for the purpose of providing these essential public services, and WHEREAS, the Kodiak Island Borough does not operate for profit, and its economic concerns and motivations are therefore different from those of employers in the private sector, and WHEREAS, for these reasons it is essential that the Borough maintain local control over labor relations and over the Borough's budgetary process, and WHEREAS, since 1977 the Borough has had a comprehensive system of personnel rules and regulations which has provided, for the most part, a stable atmosphere of labor relations for many years, and WHEREAS, the assembly desires to consider input from the employees on ways these personnel rules and regulations can be improved to further enhance stability, harmony, and efficiency in Borough employment and operations, and WHEREAS, by its terms the National Labor Relations Act does not apply to the Borough, and WHEREAS, by Resolution No. 80 -5 -R enacted January 22, 1980, the Borough exempted itself from the Alaska Public Employment Relations Act, in accordance with provisions of the Act which authorize such action, and WHEREAS, because of these exemptions no procedure exists 'whereby the assembly and administration can obtain input on a regular basis from employees, and WHEREAS, the assembly desires to establish such a procedure, and to consider the employees' input in this regard; NOW, THEREFORE, BE IT RESOLVED by the Assembly of the Kodiak Island Borough that: 1. The assembly make a legislative finding and determination that the statements contained in the Whereas clauses in this resolution are true and re 2. The presiding office shall appoint a committee of the assembly to obtain input from the employees of the Borough. More specifically, the committee shall obtain input from the Borough employees concerning the best way to establish a procedure by which the assembly and administration can regularly receive input from the employees concerning the terms and conditions of their employment. 4 . The presiding officer shall set the date, time and place for a meeting at which the committee shall accomplish the goals contained in paragraphs 2 and 3. This meeting shall be scheduled at a time which is reasonably convenient to the committee and employees. 5 . The Borough Clerk shall post notices of this meeting at prominent places throughout the Borough offices. 6. All interested employees are hereby invited to attend this meeting and to inform the assembly committee of their desires concerning a system for regular communication among the assembly, the administration, and the employees. 7 . After considering the desires of the employees, the committee shall develop and present to the assembly a recommendation for establishing such a procedure. 8. The assembly reaffirms the decision previously made in Resolution No. 80 -5 -R, dated January 22, 1980, to reject application of the Alaska Public Employment Relations Act, which is codified as AS 2 3,40.070 et seq.
